>>> WE WILL MOVE TO OUR PRESENTATIONS AND

[5A. Presentation of a grant for four Sensit gas leak detectors awarded to the Rowlett Fire Department from Atmos Energy.]

PROCLAMATIONS SECTION. WE'LL START WITH 5 A WHICH IS PRESENTATION OF A GRAND FOR FOUR SEN SILT GAS LEAK DETECTORS -- SENSIT GAS LEAK DETECTORS AWARDED TO THE ROWLETT FIRE DEPARTMENT FROM ATMOS ENERGY.

THANK YOU FOR JOINING US. >> OH, THANK YOU.

JUST TO BE FORMAL AND EVA HUMLE OF ATMOS ENERGY.

I JUST WANT TO THANK THE COUNCIL AND MAYOR FOR PUTTING US ON THE AGENDA THIS EVENING.

FOR A SPECIAL PRESENTATION TO THE ROWLETT FIRE DEPARTMENT. BEFORE I GET STARTED I JUST WANTED TO SHARE A LITTLE BIT ABOUT AN INITIATIVE THAT ATMOS ENERGY STARTED THIS FISCAL YEAR BUT WE ACTUALLY, YOU KNOW, STARTED THIS DURING THE PANDEMIC AND IT IS OUR FEELING SAFE AND THRIVING COMMUNITIES AND OUR FOCUS WE HAVE THREE AREAS OF FOCUS.

ONE OF THEM IS CHILDHOOD LITERACY AND HUNGER, ANOTHER FOCUS IS FEELING HOPE AND WARMTH TO OUR NEIGHBORS THROUGH ENERGY ASSISTANCE, THAT'S HELPING THEM WITH THEIR GAS BILLS. AND OUR THIRD IS HEROES OF SAFETY. OUR FIRE, RESCUE, POLICE AND HEALTHCARE. THAT'S WHY I'M HERE TODAY TO PRESENT THE ROWLETT FIRE DEPARTMENT WITH SOME SENSIT GOLD GAS LEAK DETECTORS. IT'S ACTUALLY COMBUSTIBLE

[00:05:01]

GAS INDICATORS AND THEY'RE USED FOR GAS LEAKS SURVEYS, INVESTIGATIONS, GAS LEAK PINPOINTING, GAS PIPELINE PURGING IN CONFINED SPACES AND APPLICATIONS.

THIS IS A GO-TO TOOL FOR ATMOS ENERGY EMPLOYEES AND IT IS A VERY IMPORTANT TOOL FOR OUR FIRST RESPONDERS TO HAVE TOO. WE WORK VERY CLOSELY WITH OUR FIRE DEPARTMENT AND WE RECEIVED A GRANT REQUEST FROM CAPTAIN PATRICK MURPHY IN TRAINING REQUESTING SOME GAS DECKORS. SO WE ARE VERY HAPPY TO TONIGHT -- DETECTORS. SO WE ARE VERY HAPPY TONIGHT TO PROVIDE FOUR. ONE FOR EACH DEPARTMENT.

THESE ARE THE LATEST AND GREATEST SO THEY DO SOME PRETTY COOL STUFF. AND THEY WILL HELP KEEP THIS COMMUNITY SAFE. SO WITH THAT I WOULD LIKE TO SHOW THIS PICTURE. THIS IS A PHOTO FROM EARLY TODAY. WE WENT AND VISITED THE FIRE DEPARTMENT AND PROVIDING THEM THESE SENSIT DETECTORS.

I WILL GO AHEAD AND TURN THIS OVER TO CHIEF HOWARD.

BUT JUST KNOW HOW MUCH WE APPRECIATE THE RELATIONSHIP WE HAVE WITH THE ROWLETT FIRE DEPARTMENT WE WORK VERY CLOSE WITH THEM AND JUST REALLY GIVING THANKS FOR KEEPING OUR COMMUNITIES SAFE.

>> IF YOU. MAYOR AND COUNCIL WE'RE VERY FORTUNATE TO HAVE A PARTNERSHIP AS WE DO WITH ATMOS ENERGY. THESE DETECTORS WILL DETECT SIX DIFFERENT TIPTS OF GAS THAT WE USE IN OUR EVERYDAY -- TIPTS OF GAS THAT WE USE IN OUR EVERYDAY -- ONCE THEY LEAVE THAT CONTAINMENT SOURCE THEY BECOME VERY HAZARDOUS. THIS WILL GIVE US AN OPPORTUNITY TO DETECT THEM EARLY AND BE ABLE TO PROVIDE A SAFE EVERY COMMUNITY AND A SAFER WORKING ENVIRONMENT FOR OUR FIREFIGHTERS. WE REALLY APPRECIATE THIS.

THIS IS GREAT THIS WILL HELP US TO PROVIDE SAFER COMMUNITY FOR OUR CITIZENS SAFETY.

>> THANK YOU VERY MUCH. WHEN WOULD YOU USE THIS.

IF SOMEONE THINKS THEY HAVE A LEAK OR WITH A FIRE?

>> WE WILL BE ABLE TO USE THEM ON GAS ALEX.

IF WE HAVE REPORTED GAS LEAK SOMEWHERE.

IT WILL HELP US DETECT IT EARLIER.

ISOLATE THE AREA UNTIL ATMOS CAN GET OUT THERE AND CONTROL THE LEAK FOR US. SO IT'S A HUGE BENEFIT TO US TO PROTECT OUR CITIZENS BECAUSE IF WE HAVE A NATURAL GAS LEAK AND WE'RE ABLE TO DETECT THE SOURCE WHERE IT'S COMING FROM THEN WE CAN THEN EVALUATE HOW MUCH OF AN AREA WE NEED TO EVACUATE TO MAKE SURE WE PUT PEOPLE IN A SAFE PLACE. IT'S A HUGE HELP TO US.

>> SO YOU HAVE ONE FOR EACH FIRE STATION, IS THAT

CORRECT? >> YES, MA'AM,.

>> ANYTHING ELSE? EVA OR CHIEF OR BRIAN?

>> EVA, THANK YOU SO MUCH. >> YOU ARE SUCH A GREAT COMMUNITY PARTNER ATMOS IS SUCH A COMMUNITY PARTNER YOU'RE A WONDERFUL REPRESENTATIVE WE APPRECIATE EVERYTHING THAT WE DO WITH OUR PARTNERSHIP WITH ATMOS.

>> THANK YOU, I APPRECIATE ALL OF YOU.

HAVE A GOOD EVENING. >> YOU TOO.

>> ALL RIGHT. WE'RE GOING TO MOVE TO ITEM

[5B. Hear presentation on the fourth quarter investment report for September 30, 2020.]

5B WHICH IS FOUR A PRESENTATION FOR SEPTEMBER 30TH, 2020. WHO IS GOING TO TAKE THAT

ROBERT YOU ARE MUTED. >> AS SOON AS I FIND THE BUTTON. GOOD EVENING COUNCIL.

MY NAME IS ROBERT I'M GOING TO INTRODUCE THE INVESTMENT REPORT FOR THE FOURTH QUARTER, OUR FOURTH QUARTER ENDING SEPTEMBER 30TH, 2020. THEN OUR INVESTMENT ADVISOR BARRY BOWER FROM P.F.M. IS HERE HE WILL WALK THROUGH THE REPORT WITH YOU. SO FIRST OFF, I WANT TO GO OVER BY REMINDING COUNCIL OF OUR INVESTMENT POLICY AND OUR REQUIREMENTS. SO WE HAVE REQUIREMENTS AS OF OUR CITY ROWLETT INVESTMENT POLICY AS WELL AS REQUIREMENTS FROM THE TEXAS PUBLIC FUNDS INVESTMENT ACT.

THESE ARE ANNUAL ADOPTION OF LOCAL INVESTMENT POLICY BY COUNCIL. QUARTERLY INVESTMENT REPORT PRESENTED TO COUNCIL AS CURRENTLY PREPARED BY PFM ASSET MANAGEMENT WHO IS HERE WITH US TONIGHT.

WE HAVE THREE INVESTMENT OBJECTIVES.

THIS IS SAFETY, LIQUIDITY AND RATE OF RETURN.

THEN WE HAVE TWO PERFORMANCE MEASURES TO MEASURE OUR INVESTMENTS. SHORT-TERM PERFORMANCE MEASURES, EXCUSE ME, IS TO EXCEED THE WEIGHTED AVERAGE

[00:10:06]

RETURN AND OUR LONG-TERM PERFORMANCE MEASURE IS TO EXCEED THE ONE TO 3-YEAR TREASURY INDEX.

WITH THAT I'M GOING TO TURN IT OVER TO BARRY FROM P.F.M.

TO WALK THROUGH THE FOURTH QUARTER INVESTMENT REPORT FOR THE QUARTER ENDING SEPTEMBER 30TH, 2020.

>> THANK YOU, ALBERT, THANK YOU VERY MUCH COUNCIL AND MAYOR. HOPEFULLY ON THE SCREEN YOU SHOULD SEE THE INVESTMENT REPORT FOR THE QUARTER ENDED SEPTEMBER 30TH. THIS WILL BE FOR YOUR FOURTH QUARTER OF THE FISCAL YEAR. SO IT'S A GREAT TIME TO TAKE A LOOK BACK AT THE YEAR AND HOW THINGS WENT.

WHAT I WOULD LIKE TO DO FIRST IS GIVE YOU AN OVERVIEW, ECONOMIC SNAPSHOT OF WHAT'S GOING ON IN THE MARKET HERE. RATHER THAN PUT A BUNCH OF WORDS I WANT TO TALK THROUGH SOME OF THE MAJOR NUMBERS THAT WE LOOK AT. IN THE LABOR DEPARTMENT THE UNEMPLOYMENT RATE IS ABOUT 7% TO 8% RIGHT NOW.

AS YOU KNOW WHEN WE ENTERED THE PANDEMIC IT HAD GREATLY ACCELERATED UP INTO THE TEENS PERCENTAGES AND SINCE THEN WE GRADUALLY REOPENED WE'RE KIND OF WORKING OUR WAY THROUGH THE PANDEMIC IN DIFFERENT PARTS OF THE COUNTRY GRADUALLY REOPENING. THE OTHER PART -- UNEMPLOYMENT RATE HAS DECLINED ACTUALLY THAN A FASTER RATE THAN ANTICIPATED.

THIS IS A 7.9% NUMBER AS OF SEPTEMBER AND OCTOBER OF LAST YEAR. AS FAR AS GROWTH A SCARY NUMBER FOR REAL G.D.P. IT WAS DOWN 31% IN THE SECOND QUARTER WHICH WAS APRIL, MAY AND JUNE.

THAT WAS OUR FUEL THREE MONTHS OF JUST DEALING WITH THE PANDEMIC WE JUST BASICALLY WENT INTO A VIRTUAL SHUT DOWN FROM COAST-TO-COAST.

WE WERE DRIVING ALONG IN A CAR PULL OVER ON THE SIDE OF THE ROAD AND TURNED THE ENGINE OFF.

WE JUST SHUT EVERYTHING DOWN.

YOU EXPECT A PRETTY LOW NUMBER THERE.

AGAIN THIS IS OF THE SECOND QUARTER.

BUT SINCE THEN WE'VE HAD THE SEPTEMBER 30TH NUMBER COME OUT. IT HAS REBOUNDED BACK TO THE UPSIDE 33%. SO EVEN WITH THE KIND OF HARSH SPORADIC REOPENING OF THE COUNTRY WE ARE SEEING A VERY NICE REBOUND IN GROWTH. SO THAT'S A GOOD THING TO BE ABLE TO REPORT. AS FAR AS INFLATION, INFLATION HAS BEEN AROUND THE 1%, 1.50% RANGE SEVERAL MONTHS GOING ON YEARS NOW. THEY WILL MAINTAIN INFLATION TARGET OF 2%. THAT BEING SAID, THEY WILL KEEP RATES LOW AND HAVE IFFLATION RAISES AS LONG AS THEY MAINTAIN AVERAGE OF ABOUT 2% OVER A PERIOD OF TIME. WITH THAT BEING SAID, IF YOU MOVE TO THE NEXT SLIDE WE WILL LOOK AT WHAT INTEREST RATES DOING. ON THE TOP LEFT THERE YOU WILL SEE THE U.S. TREASURY YIELD CHART.

YOU SEE THE CURRENT YIELD CURVE AS OF SEPTEMBER 30TH.

WHAT THIS TELLS US IT'S NORMAL SLOPING TO THE RIGHT.

MEANING THE FURTHER OUT THE -- THE HIGHER YOU ARE COMPENSATED. SO THAT'S A NORMAL THAT'S A GOOD THING. EVEN THIS REPORT ALL THE YIELDS SAW THAT SEE IN THE BOTTOM LEFT FOR THE ONE YEAR GOING AFTER THE 30 YEAR. ALL THOSE YEARS HAVICKED UP SLIGHTLY. WHAT THAT'S DONE IS ALLOW THE CURVE TO BECOME EVEN STEEPER.

WHAT'S HAPPENED IS AS WE HAD NEWS ABOUT VACCINE MONEY IS STARTING FLOW BACK IN TO THE NOTITY MARKETS PUSHING YIELDS UP. WE'RE STARTING TO SEE SOME INCREASED YIELDS THAT'S ENCOURAGING.

SO WE ARE GLAD TO SEE THAT. IF YOU WILL GO TO THE NEXT PAGE, PLEASE. SOME OF THE BACKDROP.

WE HAVE BEEN IN THE FASTEST GROWTH SINCE MARCH WE ARE STILL IN THAT 0 PERCENT INTEREST RATE ENVIRONMENT THE OVERNIGHT RATE FOR THE SHORT-TERM LIQUID RATE IS TARGETED AT 0 TO .25% THAT MEANS ONE QUARTER OF 1%.

OVERALL THE FINANCIAL MARKETS ARE GRADUALLY COMING BACK. WE HAVE ACTUALLY RECOVERED A LITTLE MORE THAN EXPECTED WITH THAT 33% REBOUND IN GROWTH WE ARE BY NO MEANS BACK TO THE ACTIVITY ECONOMIC ACTIVITY LEVELS THAT WE WERE BEFORE THE CRISIS. BUT WE ARE GRADUALLY GETTING THERE. IT'S JUST A FUNCTION OF GRADUALLY RESTARTING THE ECONOMY.

THERE'S OF COURSE THE BACKDROP IS WHAT'S GOING ON IN THE FISCAL MARKET. WE'RE WAITING ON POTENTIAL STIMULUS ANOTHER STIMULUS PACKAGE FROM CONGRESS THAT'S

[00:15:03]

BEING DELAYED BECAUSE OF THE ELECTIONS WE THOUGHT WE WOULD BE IN SEPTEMBER HASN'T HAPPENED YET.

THEY'RE STILL TALKING ABOUT A TRILLION DOLLAR PACKAGE FOR OTHER STIMULUS BUT WE DON'T KNOW WHEN THAT COULD OCCUR BUT THEY ARE TALKING ABOUT IT.

OF COURSE WE HAVE THE ELECTION HAS OCCURRED WE'RE NOT SURE WHAT THE NEXT ADMINISTRATION WILL DO BUT IT DOES LOOK LIKE WE WILL STILL A BALANCE OF POWER IN THE SENATE. THAT IS CALMING TONE THAT'S COMING TO THE MARKET THERE. IF YOU WOULD GO FORWARD TO THE NEXT PAGE, PLEASE. OTHER THAN GENERAL COMMENTS FEEL FREE TO STOP ME IF THERE ARE ANY QUESTIONS.

IF THERE'S NOT WE'LL MOVE AHEAD INTO THE ACTUAL PORTFOLIO. THIS IS A SUMMARY OF THE WAY WE LOOK AT THE DIFFERENT THINGS.

YOUR POOLED FUNDS, LONG-TERM POOLED.

WE LOOK AT IT QUARTER OVER QUARTER FROM JUNE TO SEPTEMBER HERE. THE NUMBERS THAT I REALLY WANTED TO POINT OUT FOR YOU THE LONG-TERM POOL FUND THE THIRD ITEM DOWN. THE INCREASE FROM JUNE TO SEPTEMBER. $22 MILLION UP TO ABOUT $34 MILLION. THE ACTIVELY MANAGED PORTION WHAPS IS WORKING WITH -- WHAT HAPPENED IS WORKING WITH THE STAFF AND ANALYZING THIS CASH FLOW WE WERE ABLE TO ADD $12 MILLION CORE OPERATING FUNDS TO THAT ACT THROUGH EARNED ADDITIONAL EARNINGS FOR THE CITY GOING FORWARD. THAT'S A GOOD THING WE WERE ABLE TO DO. YOU SEE THE FLAT CHANGE BECAUSE THE $12 MILLION CAME OUT OF THAT INTO THE LONG-TERM POOL FUND. WE ALSO HAD SOME BAND ISSUES THOSE ARE IN THE TEXT POOL ACCOUNT IN THE LIQUID FUNDS.

YOUR EARNING POOL IN THE MIDDLE OF THE PAGE GOOD TIMES THE TOTAL FISCAL YEAR AND THE BOTTOM RIGHT JUST OVER 1.4 MILLION AS YOU CAN SEE TOWARD THE END OF LAST YEAR AS WELL AS THE BEGINNING THE EARNINGS WERE MUCH HIGHER. AS YOU CAN SEE -- THAT'S WHAT YOU MIGHT CALL THE COVID OR PANDEMIC EFFECT, IF YOU WILL AS WE HIT IT THE -- THAT AFFECTED OF COURSE LAT OF YOUR LIQUID FUNDS. BUT I'M ENCOURAGED TO SEE THAT WITH THE ECONOMIC WE GOOD OPPORTUNITIES TO INVEST AND WE WILL CONTINUE DOING THAT.

THIS IS A SUMMARY OF YOUR PORTFOLIO.

$.2 MILLION ON COMMERCIAL PAPER.

THOSE ARE THE ACTUAL INDIVIDUAL SECURITIES ON BEHALF OF THE CITY. THOSE ARE LIQUID FUNDS AT THE BANK. AND AN OVERNIGHT LIQUID FUND AS WELL SO THOSE -- LIQUIDITY FUND AS WELL.

EVEN THOUGH THE ADDITIONAL $12 MILLION THAT WAS PUT INTO INDIVIDUAL SECURITIES YOU STILL KNOW THERE'S A TREMENDOUS AMOUNT BUT THE BALANCE IS A AMERICAN NATIONAL BANK. AS FAR AS HIGH DENSE FUNDS YOU CAN SEE ON THE BOTTOM THERE'S GOOD CONCENTRATION WITH THE OVERNIGHT LIQUIDITY.

YOU CAN SEE PRETTY MUCH SPREAD SIX MONTHS.

THAT'S THE PORTION OF THE PORTFOLIO THAT WAST STRATEGY.

SOME OF THE CORE FUNDS ARE ZERO TO ONE YEAR STRATEGY.

WE DON'T NECESSARILY THEM TO BE OVERNIGHT AS WELL.

SO SPREAD ACROSS SIX NOTES GOING OUT TWO TO THREE YEARS. NEXT SLIDE, PLEASE.

FURTHERMORE BY THE INVESTMENT POLICY OF THE CITY. WHICH WAS REVIEWED I BELIEVE BY THE CITY THIS PAST QUARTER WHICH REQUIRED TO DO ANNUALLY. WHAT THIS SLIDE SHOWS IS YOU'RE STILL WELL WITHIN THE POLICY LIMIT.

THE DIFFERENT SECURITY TAX THAT WE'RE ABLE TO INVEST

[00:20:03]

IN. SO MORE AND MORE CONCERNS APPROACHING OR GETTING OUT OF THE POLICY PARAMETERS.

THROWS SET BY THE CITY THOSE AREN'T DESIGNATED WITHIN THE PUBLIC FUNDS ACT ITSELF. SO THAT'S WHAT THE CITY HAS ENACTED TO ENSURE PROPER DIVERSIFICATION OF THE PORTFOLIO THAT'S SOMETHING WE ENCOURAGE AS WELL.

WITH THAT, I'M HAPPY TO ANSWER ANY QUESTIONS THAT YOU HAVE AT THIS TIME. I WILL ENTERTAIN ANY COMMENT.

>> THANK YOU SO MUCH BARRY AND ROBERT.

COUNCIL ANY QUESTIONS? AND THE FINANCE COMMITTEE HAD A CHANCE TO GO OVER THIS EARLIER TODAY, ALSO.

WHICH IS CONDUCT A PUBLIC HEARING AND TAKE ACTION ON AN ORDINANCE REGARDING REQUEST BY BOBBY NICOLES, CHANDLER SIGNS ON BEHALF OF HOME 2 SUITES FOR MAJOR WARRANTS TO ARTICLES 4.41 WALL SIGNS AND 4..11 MONUMENT SIGNS TO ONE INCREASE THE MAXIMUM PERMITTED SWAP SPACE AND TWO INCREASE THE MAXIMUM PERMITTED WALL SIGN FROM 30 SQUARE FEET TO 64 SQUARE FEET AND SOUTH FACING FACADE. THREE ALLOW A MONUMENT SIGN ALONG SUNSET BOULVARD, GOOD EVENING.

>> GOOD EVENING MAYOR AND GOOD EVENING COUNCIL.

THANK YOU FOR READING OUT THE CAPTION.

MAYOR, THANK YOU LAWYER AUTO FOR PUGS OUT THE PRESENTATION. A RATHER STRAIGHT FORWARD MAJOR WARRANT REQUEST THAT IS CONTINUELY UNDER CONSTRUCTION. AS YOU CAN SEE ON THE SCREEN IN IN FRONT OF YOU WE HAVE SUPERIMPOSED THE SITE PLANNING THAT REFLECTS THE HOME2SEITZ -- HOME2 SUITES.

AGAIN THE SITE IS LOCATED WITHIN BAY SIDE MALL DISTRICT. THE PARCEL IS A REGULARLY SHAPED AND IT ONLY HAS APPROXIMATELY 30 FEET OF FRONTAGE ALONG SUNSET BOULVARD THAT IS THE PRIMARY ACCESS CONTINUELY AS IT STANDS FOR THIS SITE.

THERE WOULD BE ADDITIONAL ACCESS.

A DEVELOPMENT PLAN WAS APPROVED FOR THIS PROJECT WHICH INCLUDES THE HOME2SUITES AS WELL AS THE RETAIL PAD SITE ON MAY 31ST IN 2019.

THE AM KANT IS REQUESTING THREE SPECIFIC VARIANCES OR

[00:35:01]

MAJOR WARRANTS TO THE SIGN REGULATIONS IN THE FORM OF -- AS YOU CAN SEE ON THE SCREEN IN FRONT OF YOU THERE ARE THREE LETTERS A, B AND C, LETTERS A AND B ARE THE PROPOSED LOCATIONS OF THE WALL SIGNS OR THE AND C IS A MOCK PROPOSED SIGNAGE SIGN. THE APPLICANT IS REQUESTING TO INCREASE PERMITTED FOR THE WALL SIGN ALONG THE EAST ELEVATION WHICH IS REFLECTED AS A ON THAT IMIMAGINE IN FRONT OF YOU FROM THE MAXIMUM SQUARE FEET TO 31 SQUARE FEET. LIKEWISE ALSO PROPOSING TO INCREASE THE WALL SIGN ALONG THE ELEVATION TO THE SOUTH I WOULD CALL IT WHICH IS REFLECTED AS B ON THE SITE PLAN FROM 30 SQUARE FEET TO 64 SQUARE FEET.

AS PART OF THE DEVELOPMENT PROGRAM THE BUSINESS MODEL THE APPLICANT IS ALSO REQUESTING A MONUMENT SIGN SIX FEET IN HEIGHT. SIX FEET IN HEIGHT AND SEVEN FEET AND 10 INCHES IN WIDTH ALONG SUNSET BOULVARD AS SHOWN ON THE LETTER C ON THE SITE PLAN.

NEXT SLIDE, PLEASE. IT ONLY PERMITS ONE 30 SQUARE FOOT WALL SIGN THAT HAS TO BE LOCATED 12 FEET OR HIGHER THE WARRANT IS ADMINISTRATIVELY APPROVED.

THE APPLICANT REQUESTED A MINOR WARRANT TO ALLOW FOR THE SIGNS A AND B. ON THE EAST AND SOUTHERN ELEVATIONS. THOSE WERE APPROVED BY STAFF AS A MINOR WARRANT AND ADMINISTRATIVE APPROVAL TO ALLOW THE ADDITIONAL WALL SIGNS.

BUT POST THAT THE ACTION IS NOW BEFORE US IN THE SIGN AREA FOR 41 SQUARE FEET AND 64 SQUARE FEET RESPECTIVELY FOR SIGNS A AND B. NEXT SIGN PLEASE, LAURA.

THIS DESCRIPTION HERE THIS IMAGE PROVIDES MORE A BETTER ILLUSTRATIVE EXAMPLE -- SO THE REQUEST TO INCREASE THE MAXIMUM PERMITTED AREA FROM 30 SQUARE FEET TO 41 SQUARE FEET FOR SIGN A AS YOU CAN SEE REFLECTS THE HOME2SUITE LOGO ON THE EASTERN FACADE. THEN JUST TO GIVE YOU SOME BACKGROUND. SIGN A IS LOCATED APPROXIMATELY 235 FEET FROM SUNSET BOULVARD.

IT IS AT ABOUT 45 FEET ABOVE GRADE.

THE INCREASE SIGN AREA FROM OUR ANALYSIS FROM STAFF ANALYSIS IS APPROPRIATE AS APPROACHING THE LIGHTS PEOPLE TRAVELING FROM SUNSET BOULVARD DOWN SUNSET BOULVARD. AS YOU CAN SEE THE TWO IMAGES THE EASTERN IMAGES REFLECT WHAT THE 30 SQUARE FOOT SIGN WOULD LOOK LIKE AND AGAIN AN INCREASE.

NEXT SLIDE PLEASE, LAURA. SIGN B THE REQUEST IS TO INCREASE THAT TO 64 SQUARE FEET AGAIN THE SAME DISTANCE PARAMETERS DO NOT APPLY BECAUSE SIGN B IS CLOSER TO SUNSET BOULVARD APPROXIMATELY 190 FEET AND ALSO 35 FEET ABOVE GRADE. FROM A VISIBILITY CORRIDOR PERSPECTIVE THE INCREASED SIGN AREA IS APPROACH AS APPROACHING TRAFFIC WILL LIKELY BE TRAVELING AND SOME OF THOSE WORDS GOT LEFT OFF AND I APOLOGIZE FOR THAT.

BUT WILL BE TRAVELING FROM SUNSET DOWN ALONG I-30.

NEXT SLIDE, PLEASE. AS PART OF THIS REQUEST AND THE THIRD COMPONENT THREE OF REQUEST IS A MAJOR WARRANT TO ALLOW A MONUMENT SIGN ALONG SUNSET BOULVARD.

COUNCIL, THE CODE DOES NOT PERMIT MONUMENT SIGNS WITH THE EXCEPTION AND THOSE ARE LIMITED TO FRONTAGESES ALONG LAKE VIEW PARKWAY, AND BROWSING LANES PER SECTION 5411 C. THE APPLICANT IS INDICATING THEY NEED THAT SIGNAGE SO PATRONS TO THE HOTEL ARE ABLE TO EASILY SEE AND REALIZE WHERE THE HOTEL IS.

AGAIN THE DIMENSIONS OF THE SIGN ARE SIX FEET IN HEIGHT IT'S APPROXIMATELY SEVEN FEET IN WIDTH A LITTLE OVER THAT. IT'S LUNCH SQUARE FEET IN AREA WHICH -- IT'S 31 SQUARE FEET IN AREA.

THE LOCATION THAT THE AM CAN'T IS PROPOSING IS APPROXIMATELY 10 FEET FROM THE PROPERTY LINE ALONG SUNSET BOULVARD TO THE SOUTH OF THE SIGN.

NEXT SIGN PLEASE, LAURA. HOWEVER THIS SIGN IS ALSO CONTAINED WITHIN A PROPOSED WITHIN A 50 FOOT DRAINAGE AND UTILITY EASEMENT. NOW, IF THE SIGN WAS TO BE RELOCATED TO THE INTERIOR TO THE SIDE OR SET BACK FURTHER INTO THE SITE THE MONUMENT SIGN WOULD BE OVER 25 FEET

[00:40:01]

FROM SUNSET BOULVARD WHICH WOULD COMPROMISE THE VISIBILITY OF THAT SIGN REGARDLESS.

IF APPROVED, HOWEVER, THIS MAJOR WARRANT COULD POTENTIALLY SET A PRECEDENT ALLOW FOR INCREASED MONUMENT SIGNAGE OR FREESTANDING SIGNAGE FOR OTHER DEVELOPMENT NOT JUST WITHIN THE BAY SIDE AREA BUT OTHER DEVELOPMENT. THE INTENT IS NOT TO COMPROMISE THE PEDESTRIAN ROAD OF THESE DEVELOPMENTS.

NEXT SLIDE PLEASE, LAURA. THEN FOR THE VIEWING AUDIENCE AND YOURSELF A BETTER IMAGE OF WHAT WHERE THOSE SIGNS WOULD BE LOCATED AS YOU CAN SEE THIS IS OFF OF DOW ROCK ROAD AND SUNSET BOULVARD LOOKING WEST TOWARDS THE HOTEL WHICH IS CURRENTLY UNDER CONSTRUCTION. YOU CAN SEE THAT SIGN REALLY IS REFLECTED RIGHT THERE BUT WOULDN'T BE ENTIRELY VISIBLE FROM THIS ANGLE. THEN THERE'S SIGN A MORE LIKELY SIGN B BE WOULD BE BETTER VISIBLE OFF OF SUNSET BOULVARD ITSELF. IN KEEPING WITH THE PUBLIC HEARING PROCESS, NEXT SLIDE, PLEASE, LAURA, IN KEEPING WITH THE PUBLIC HEARING PROCESS NOTICE WITHIN THE REQUIRED 200 FOOT RADIUS OF THE SUBJECT PROPERTY AS WELL AS A 500 FOOT RADIUS BUFFER NOTICE AS A COURTESY.

RESPONSES TO THIS REQUEST WERE ONLY RECEIVED IN OPPOSITION AND THOSE WERE WITHIN THE 500 FOOT BUFFER.

NEXT SLIDE PLEASE, LAURA. THE PLANNING AND ZONING COMMISSION DID HEAR THIS AT THEIR OCTOBER 27TH MEETING.

THEY DID RECOMMEND APPROVAL OF THE WALL SIGN AS PRESENTED. HOWEVER THEY ALSO RECOMMENDED DENIAL OF THE REQUEST TO ALLOW MONUMENT SIGN ALONG SUNSET BOULVARD WHICH IS REFLECTED AS SIGN C ON THE IMAGE. NEXT SLIDE, PLEASE.

STAFF'S RECOMMENDATION UPON ASSESSING THE VISIBILITY OF THE BUILDING, THE INCREASED COPY AREA OF THE WALL SIGN STAFF IS RECOMMENDING APPROVAL OF THE MAJOR ONE TO INCREASE THE PERMITTED WALL SIGN OR ELEVATION EAST AND SOUTHERN ELEVATION FROM 30 SQUARE FEET TO 41 SQUARE FEET. AND 64 SQUARE FEET RESPECTIVELY. THE INCREASED AREA OF THESE SIGNS ARE REASONABLE IN SCALE AND ALSO MEET THE INTENT OF THE FORM-BASED CODE.

THEY DO NOT COMPROMISE THAT VISIBILITY CORRIDOR.

FOR, STAFF IS RECOMMENDING DENIAL OF THE MAJOR WARRANT TO ALLOW MONUMENT SIGN ALONG SUNSET BOULVARD.

IF APPROVED, THIS SIGN COULD POTENTIALLY CREATE A PRECEDENT TO ALLOW FREESTANDING SIGNAGE WITHIN THIS DISTRICT AND OTHER AREAS.

WOULD NOT MEET THE SPIRIT AND INTENT OF THE FORM BASED CODE WHICH IS TO CREATE THAT HIGH QUALITY PEDESTRIAN-ORIENTED ENVIRONMENT.

NOW THE FORM-BASED CODE SPECIFICALLY SAYS THAT FREESTANDING MONUMENT SIGNS ARE LIMITED TO THOSE SPECIFIC AREAS TO SERVICE ROAD THEN PARKWAY AND OF COURSE THE ROUNDING LANE. THAT'S HOW THOSE AREAS ARE DESIGNED TO ACCOMMODATE THEM. WITH THAT I WILL BE HAPPY TO ANSWER ANY QUESTIONS THAT YOU MAY HAVE.

>> THANK YOU. BEFORE I OPEN THE PUBLIC HEARING. COUNCIL ANY QUESTIONS?

>> DO WE HAVE THE APPLICANT HERE TONIGHT AND DO THEY HAVE ANYTHING THEY WOULD LIKE TO SAY, DO YOU KNOW?

>> UNFORTUNATELY, I DON'T THINK, I THIS THINK MIGHT HAVE SLIPPED THROUGH THE CRACKS FOR THEM TO NOTE THIS MEETING. THEY WERE PRESENT AT THE THEY DID MAKE A PRESENTATION AND EXPLAIN WHY IT WAS NECESSARY PERHAPS FOR THEM TO HAVE THAT SIGNAGE BUT

THEY'RE NOT PRESENT TONIGHT. >> I DID JUST SPEAK IF YOU ALLOW, I DID JUST SPEAK WITH THE APPLICANT AND HE MENTIONED THAT HE HE CALLED IN TO THE PUBLIC HEARING NUMBER SO HE MIGHT BE ABLE TO REACH THROUGH THERE.

I'M NOT SURE IF WE CAN WAIT UNTIL THE PUBLIC HEARING MOMENT OR UNTIL, OR IF WE CAN SOMEHOW REACH HIM NOW? HE SHOULD BE AVAILABLE. HE JUST TEXTED ME HE'S ON.

SO HE'S AVAILABLE DURING THAT PUBLIC HEARING LINE.

>> YOU CAN TALK OUTSIDE OF THE PUBLIC HEARING, ALSO.

>> WELL, HE'S AVAILABLE ON THAT LINE.

>> I AM SEEING A PHONE. SO, CALLER CAN YOU IDENTIFY YOURSELF. YOU'RE ON MUTE RIGHT NOW.

DO WE HAVE THE APPLICANT ON THE LINE?

>> HE SAYS HE CAN'T UNMUTE HIMSELF.

>> STAR 6. >> YOU JUST UNMUTED

YOURSELF. >> HELLO.

>> HANG ON A SECOND THIS IS MAYOR.

WE JUST HAD A PRESENTATION WITH YOUR ITEMS. BEFORE I OPEN THE PUBLIC HEARING I WANTED TO SEE IF

[00:45:01]

YOU HAD ANY COMMENTS YOU WOULD LIKE TO MAKE.

IF YOU WOULD PLEASE IDENTIFY YOURSELF.

>> CASH PATEL 221 TANNER HILL CIRCLE.

HOW IS EVERYONE. >> DOING WELL.

GOOD TO HEAR FROM YOU. >> YEAH, SO CARLOS JUST LITERALLY TEXT ME AND CALLED ME TWO MINUTES AGO BECAUSE I I.P. SEND SEND US A ZOOM LINK SO APOLOGIES FOR NOT BEING ON THE CALL. YEAH, I MEAN THE BUILDING SIGNAGE JUST HOW FAR SET BACK WE ARE.

BUILDING SIGNAGE WERE SET FAR BACK INCREASE OF THAT WE HAVE A DIRECTIONAL SIGN LATER ON.

WE WERE WANT TO PROPOSE THE MONUMENT SIGNAGE.

WHAT WE ARE REALLY LOOKING FOR APPROVAL IS JUST FOR THE TWO BUILDING SIGNS. WHERE WE ARE LOCATED WITH THE RETAIL BUSINESSES OUT FRONT AND THE HOTEL SITTING BACK FOUR STORIES THE APPROVED SIGNAGE ALLOWANCE THAT WE HAVE RIGHT NOW IT WILL BE VERY, VERY SMALL COMPARED TO HOW HIGH UP WE ARE AND ALSO HOW BACK WE'RE SITTING IN. SORRY I WEAN PREPARED FOR THIS. THAT'S ALL.

>> THANK YOU MR. PATEL. DID I HEAR YOU CORRECTLY THAT YOU'RE WITHDRAWING THE PORTION FOR THE MONUMENT SIGN, I THINK I SAW A LOOK OF SURPRISE?

>> THAT IS CORRECT. I WORKED WITH CARLOS WE CAN DO SOME KIND OF DIRECTIONAL SIGN THAT'S NOT A MONUMENT OR PHYSICAL STRUCTURE THAT'S MORE ALONGSIDE THE COMMUNITY. THAT'S MY UNDERSTANDING,

YES. >> DID YOU WANT TO SAY ANYTHING BEFORE I OPEN THE PUBLIC HEARING?

>> THANK YOU, MAYOR AND COUNCIL.

ABSOLUTELY WE WOULD BE WILLING TO LOOK AT OTHER OPPORTUNITIES AVAILABLE. I THINK WE NEED TO SIT DOWN AND HAVE A CHAT. I'M COMFORTABLE WITH THE APPLICANT WITHDRAWING THE MONUMENT SIGN.

>> JUST ONE OTHER COMMENT FOR THE MONUMENT SIGN THE MAIN REASON IF YOU PULL ON ON SEN SET WE DON'T HAVE A LEFT TURN LANE GOING INTO THE PROPERTY.

SO THE RETAIL KIND OF OVERSHADOWS IT.

SO WE JUST DON'T WANT CONFUSION OF GUESTS OF HOW TO ENTER INTO THE PROPERTY. THAT'S WHY WE'RE JUST LOOKING NOT FOR A HUGE MONUMENT SIGN TO BE OVER GAWDY IT'S MORE ABOUT JUST MAKING SURE PEOPLE KNOW WHERE TO TURN IN TO THE ACTUAL HOTEL ACCESS OF IT.

BECAUSE IF YOU DRIVE UP AND DOWN WE HAVE DELIVERIES ALL THE TIME RIGHT NOW DURING CONSTRUCTION PEOPLE ARE MISSING IT MAKING A U-TURN GOING BACK TO DOW ROCK ANDIC MAGAZINE U-TURNS. I KNOW PEOPLE HAD GOOGLE MAPS EVERYONE HAS GOOGLE MAPS.

IT'S SUCH A BRAND NEW ADDRESS IF YOU GOOGLE MAP IT 8609 PULLS UP FURTHER INTO THE NEIGHBORHOOD FURTHER

INTO MULTIFAMILY. >> THANK YOU SO MUCH, APPRECIATE THAT. SO COUNCIL BEFORE I OPEN THE PUBLIC HEARING DOES ANYBODY HAVE ANY QUESTIONS FOR MENAL OR CARLOS OR FOR THE APPLICANT?

>> I'M NOT SEEING ANY SO AT THIS TIME I WILL OPEN THE PUBLIC HEARING. ANYONE WHO WISHES TO COMMENT ON THIS ITEM IS ALLOWED TO DO SO.

LAURA DO WE HAVE ANYBODY ELSE ON THE LINE FOR PUBLIC

HEARING STANDPOINT? >> NO, MA'AM, JUST THE

APPLICANT. >> SO AT THIS TIME I WILL CLOSE THE PUBLIC HEARING AND I WILL ENTERTAIN A MOTION.

>> BLAKE I SAW YOUR HAND UP FIRST.

>> OH, SORRY. MATT DID YOU WANT TO GO

AHEAD. >> GO AHEAD, BLAKE.

I WILL MAKE A MOTION TO APPROVE I GUESS YOU WOULD SAY APPROVE A AND B WITHIN THE PRESENTATION BUT NOT APPROVE C. DO THOSE HAVE TO BE SEPARATE MOTIONS OR CAN THEY BE IN ONE MOTION?

>> SO I'M GOING TO SAY IT THIS WAY.

IT'S NUMBERED 1, 2, 3 ON THE AGENDA I KNOW IT WAS A, B, C ON THE MAP. BUT IF YOU LOOK AT YOUR AGENDA YOU COULD TALK ABOUT 1AND 2 AND DON'T EVEN

MENTION 3. >> I WILL MAKE A MOTION THEN TO APPROVE 1 AND 2 LOCATED WITHIN THE PACKET OF THIS

AGENDA ITEM. >> I HAVE A MOTION TO APPROVE THE WALL SIGN FROM 30 SQUARE FEET TO 41 SQUARE FEET ON THE OTHER FACADE FROM 34 SQUARE FEET TO 64

SQUARE FEET. >> MATT.

WILL YOU SECOND THAT? >> YOU HAD YOUR HAND UP.

>> SECOND. THANK YOU VERY MUCH.

COUNCIL ANY COMMENTS BEFORE WE TAKE A VOTE? WITH THAT ALL IN FAVOR OF THAT MOEGS PLEASE RAISE YOUR HAND. -- MOTION PLEASE RAISE YOUR HAND. THAT ITEM PASSES 7-0.

THANK YOU VERY MUCH. AND THANK YOU MR. PATEL FOR JOINING US. SORRY FOR THE CONFUSION THERE. WE APPRECIATE AND LOOKING FORWARD TO THAT OPENING OF THAT HOTEL.

>> YES. FEBRUARY 1ST IS WHAT WE'RE PROJECTING. THANK YOU GUYS.

[00:50:01]

>> VERY GOOD. THANK YOU.

THANK YOU FOR BEING HERE. >> THAT CONCLUDES OUR REGULAR PORTION OF OUR MEETING.

WE STILL HAVE TWO EXECUTIVE SESSION ITEMS TO BE
