NEXT SLIDE, PLEASE. HERE ARE THE HIGHLIGHTS OF WHAT HAPPENED FOR PHYSICAL YEAR 2020 -- AS PART OF THE CITY FACILITY ASSESSMENT THE LIBRARY HELD TWO PUBLIC FOCUS GROUPS.

WE MET TO DISCUSS POSSIBILITIES FOR THE LIBRARY PERMANENT LOCATION. IN JANUARY 2020, LIBRARY DIRECTOR CATHY FREEHEART RETIRED AND LAURA TURNER WAS NAMED OUR DIRECTOR. MARCH 16, THE LIBRARY CLOSED TO THE PUBLIC DUE TO COVID-19. TO MEET PATRON NEEDS THERE WERE DIGITAL CARDS TO CHECK OUT ELECTRONIC MATERIALS.

STAFF PROVIDED VIRTUAL STORY TIMES, SOMETIMES WITH THE HELP OF PD AND ONLINE ACTIVITIES REPLACED IN PERSON PROGRAMS. TUTORS BEGAN OFFERING INSTRUCTION VIA ZOOM AND TELEPHONE. THE LIBRARY OFFERED CURBSIDE CHECKOUT TO PATRONS. THE LIBRARY THEN REOPENED TO PATRONS WITH LIMITED HOURS. CURBSIDE CHECK OUT WAS GREAT FOR FAMILIES ON THE GO AND THOSE WITH MOBILITY ISSUES.

STAFF BEGAN OFFERING CRAFTS AND STEM ACTIVITIES ON A TO GO BASIS. THE LIBRARY OPERATED WITH -- DUE TO THE PANDEMIC, THE SUMMER READING PROGRAM WAS HELD VIRTUALLY. THE EVENT KICKED OFF WITH A

SOCIALLY DISTANCED SCAVENGER HUNT WHERE KIDS MATCHED PICTURES WITH DOWNTOWN ROWLETT. THERE WAS A CHANCE TO WIN GIFT CARDS AND GRAND PRIZES OF KINDLE FIRES.

KIDS WERE ELIGIBLE TO PICK UP ITEMS TO ENCOURAGE READING.

PROGRAMS CONTINUE TO BE HELD VIRTUALLY AND FAMILIES PICKED UP CRAFT ACTIVITIES ON SATURDAYS. THERE WAS A ZOOM FAIRY TALE BALL. NEXT SLIDE, PLEASE.

FOR THE 16TH YEAR IN A ROW, THE LIBRARY RECEIVED THE ACHIEVEMENT OF EXCELLENCE AWARD FROM THE TEXAS MUNICIPAL LIBRARY DIRECTORS ASSOCIATION. I BELIEVE WE HAVE A SHORT VIDEO THAT EXPLAINS WHAT IS ENTAILED IN RECEIVING THIS AWARD.

>> THE ACHIEVEMENT OF EXCELLENCE IN LIBRARIES AWARD IS CONFERRED ANNUALLY BY THE TEXAS MIE ANIES PAL ASSOCIATION, TO RECOGNIZE OUTSTANDING CONTRIBUTIONS BY PUBLIC LIBRARIES TO THEIR COMMUNITIES. TO RECEIVE THE AWARD, RECIPIENTS MUST ACHIEVE EXCELLENCE IN 10 SERVICE AREAS IN THE PAST YEAR.

PROVIDE SERVICES TO UNDERSERVED POPULATIONS IN THE COMMUNITY THROUGH OUTREACH, SPECIALIZED PROGRAMS OR COLLECTIONS OR THROUGH COLLABORATIONS WITH OTHER ORGANIZATIONS.

DEMONSTRATE ENHANCED SERVICE TO THE PUBLIC THROUGH INCREASE IN SERVICE OR A CHANGE IN TYPE OF SERVICES.

USE INFORMATIVE AND INNOVATIVE MARKETING MATERIALS TO HIGHLIGHT LIBRARY SERVICES AND PROGRAMS. CONDUCT CULTURAL, TOPICAL AND EDUCATIONAL PROGRAMMING FOR ADULTS AND FAMILIES.

PROVIDE LITERACY SUPPORT FOR ALL AGES INCLUDING STORY TIME, BILINGUAL PROGRAMS, ESL PROGRAMS AND TUTORING PROGRAMS. CONDUCT A SUMMER PROGRAM FOR YOUTHS, TEENS OR ADULTS.

INVEST IN COLLABORATIVE EFFORTS WITH COMMUNITY ORGANIZATIONS SUCH AS SCHOOLS, VOLUNTEER PROGRAMS AND NON-GOVERNMENTAL AGENCIES. SUPPORT WORK FORCE DEVELOPMENT IN THE COMMUNITY THROUGH CAREER AND SKILL BUILDING CLASSES, SERVICES AND RESOURCES. SUPPORT DIGITAL INCLUSION BY PROVIDING PUBLIC INTERNET ACCESS, DIGITAL LITERACY TRAINING AND ONLINE LIBRARY SERVICES.

ESTABLISH PROFESSIONAL STAFF TRAINING TO INCLUDE OPPORTUNITIES FOR LIBRARY STAFF AT ALL LEVELS.

IN 2020 OF THE 568 PUBLIC LIBRARIES ACROSS TEXAS, 56 LIBRARIES ACHIEVED THE AWARD FOR PROVIDING OUTSTANDING SERVICES AND PROGRAMS TO THEIR COMMUNITY. CONGRATULATIONS TO ALL 2020 ACHIEVEMENT OF EXCELLENCE IN LIBRARY AWARDS RECIPIENTS.

IN FEBRUARY 2021, THE LIBRARY ENCOUNTERED A CHALLENGE WHEN WE EXPERIENCED SUBZERO PERIODS FOR AN EXTENDED PERIOD OF TIME.

THE PRIOR SUPPRESSION SYSTEM FROZE.

WATER BEGAN COMING THROUGH THE LIBRARY THROUGH THE CEILING.

BECAUSE STAFF ANTICIPATED SOMETHING LIKE THIS MIGHT HAPPEN, MOST OF THE COLLECTION WAS SAVED AND COVERED WITH LARGE TARPS, THIS FORESIGHT MINIMIZED THE DAMAGE.

NEXT SLIDE. LIBRARY ADVISORY BOARD ACCOMPLISHMENTS INCLUDE ATTENDING THE TASTE OF DIVERSITY IN OCTOBER OF 2019, PARTICIPATING IN THE LIBRARY FOCUS GROUP MEETINGS IN OCTOBER 2019, HELPING ASSIST IN 2019, ATTENDING THE CHAMBER OF COMMERCE CASE IN TRADE IN 2019.

HEAR PRESENTATION ON THE FINDINGS OF THE PROOF OF CONCEPT FOR THE TWO WASTE WATER FLOW METERS CALCULATING VOLUME INTO THE SEWER TREATMENT PLANT. SHOULD I READ BOTH OF THEM? CONCURRENTLY WE'LL CONSIDER ITEM 3C WHICH DISCUSSES THE TERMS OF A NEW CONTRACT FOR WASTE WATER SERVICES.

MAYOR, OUR APPROACH TONIGHT IS TO PRESENT APPROVED CONCEPT RESULTS BEFORE THE WASTE WATER CONTRACT DISCUSSION TO PROVIDE COUNCIL WITH CONFIDENCE IN THE METER CERTAINTY. WHAT THAT MEANS, THE TECHNOLOGY PRESENTED TONIGHT WILL REDUCE THE RISK OF INACCURATE DATABASED ON THE WASTE WATER CONTRACT LANGUAGE.

ON DECEMBER 17, 2020, COUNCIL APPROVED A CONCEPT STUDY WITH METER METHODOLOGY TO CAPTURE WASTE WATER FLOW DATA AS DESCRIBED AS PRESENT RESULTS TO COUNCIL.

THE REASON NICHOLS PERFORMED THE STUDY AND TO SHARE THE SUMMARY OF FINDINGS FROM THE STUDY. MICA IS PRESENTING TONIGHT AND PLEASE FEEL FREE TO ASK QUESTIONS --

SUBSEQUENTLY, BASED UPON FURTHER DISCUSSIONS, YOU ALL GAVE DIRECTION TO PURSUE UNDER A DDS CONTRACT AND WE ARE HERE TO PRESENT THE PROOF OF CONCEPT RESULTS.

SO JUST A RECAP, WHAT AV OR AREA VELOCITY METER IS, YOU CAN IN LAY TERMS IT IS ESSENTIALLY A DEVICE THAT ACTS LIKE A PERSON AND LITERALLY MEASURES THE FLOW DEPTH AND THE FLOW VELOCITY, HOW FAST IT IS GOING, AT A PARTICULAR LOCATION IN THE PIPE.

BASED UPON THE GEOMETRY OF THE PIPE, A PROCESSER ESSENTIALLY CALCULATES THE AREA BASED ON THE LEVEL.

THAT IS APPLIED TO THE Q EQUALS VA EQUATION.

THAT GIVES YOU A SINGLE -- THAT IS THE FLUB RATE AT THAT PARTICULAR TIME. IN METERING, THOSE INTERVALS ARE REGULARLY SPACED AND ESSENTIALLY ALL THOSE POINTS GO TOWARDS DETERMINING THE VOLUME OF FLOW THAT PASSED THAT SENSOR OVER THE LAST DAY, MONTH, YEAR, SO ON AND SO FORTH.

NEXT SLIDE. TO RECAP WHERE THINGS ARE AND WHAT WE DID, THE PROOF OF CONCEPT BASICALLY INVOLVED INSTALLING A TEMPORARY METER WHICH IS THE HOCK METER AT THE MANHOLE OF THE EXISTING SPRINGFIELD METER.

THE GARLAND AV METER WAS USED WHICH IS THE CURRENTLY PIPELINE ANALYSIS AV METER THAT IS USED FOR BILLING WHICH IS AT THE ACTUAL WASTE WATER TREATMENT PLANT.

AS YOU SEE ON THE MAP, THE SPRINGFIELD METER EVENTUALLY GETS TO THAT 48-INCH GAR LAPD INTERCEPTER AND DOWN TO THE PLANT. GARLAND AV METER IS NOW WHAT IS NOW ON YOUR NEW 60-INCH INTERCEPTER.

NEXT SLIDE. THE REASON WHY WE DID THIS IS SIMPLE -- WITH THE METER BEING DOWNSTREAM OF EXISTING SPRINGFIELD METER, WE WILL SEE WHAT THE CURRENT METER IS SEEING AS WELL AS ALL THE FLOW CONDITIONS WHICH WE GO OVER, WHICH IS THE TYPES OF THINGS THAT ARE GOING ON BASED UPON RAINFALL AND THINGS OF THAT NATURE.

THAT GARLAND METER REPRESENTS THE CONDITIONS THAT THE NEW METEOROLOGIST ON THE 60-INCH INTERCEPTER IS GOING TO SEE BECAUSE ESSENTIALLY THAT METER IS A COUPLE OF HUNDRED FEET UPSTREAM OF THE GARLAND METER. NEXT SLIDE.

SO PROOF OF CONCEPT STUDY, WE HAD A METER DEPLOYED FOR 56 STRAIGHT DAYS, GOING BACK TO WHAT I WAS SAYING WITH THE INDIVIDUAL POINTS OVER THAT PERIOD TO GIVE YOU AN IDEA OF HOW MANY READINGS ARE TAKEN, 16,128 READINGS.

IT WAS A GOOD METERING PERIOD P RAINFALL INFLUENCES AND THE LIKE. IN A FIVE-DAY PERIOD THERE WERE 6 INCHES OF RAIN AND IN THE 56-DAY PERIOD THERE WERE OVER 10 INCHES OF RAIN. THERE WERE EIGHT SURCHARGE EVENTS WHICH IS ESSENTIALLY WHERE THE FLOW LEVEL GOES ABOVE THE TOP OF THE PIPE AT THE GARLAND A V METER.

DURING EIGHT OF THOSE, THERE WAS ALSO A SURCHARGE EVENT AT THE SPRINGFIELD OR HACH AV METER. THE GRAPH ON THE RIGHT IS ESSENTIALLY SHOWING YOU THE RAW DATA AS WHAT HAPPENED DURING A SURCHARGE EVENT. THIS GOES TO WHAT GARY WAS SAYING EARLIER THAT THIS SUPPORTS ALL OF THE FLOW DATA OR FLOW VOLUME THAT YOU ALL SEE. EVERYTHING IS INDEPENDENTLY MEASURED AND TOTALLY TRANSPARENT.

THE ORANGE LINE ESSENTIALLY SHOWS WHAT HAPPENED AT THE ROWLETT TREATMENT PLANT, WHERE THE LEVEL WENT UP.

WITH AV, IF IT IS A SURCHARGE EVENT, THE VELOCITY GOES DOWN.

THAT IS TO CORRELATE THE TWO SITES FOR YOU AND GIVE YOU AN IDEA WITHOUT BOGGING DOWN WITH ALL THE TECHNICAL MUMBO JUMBO.

BOTH AV METERS PERFORMED BRILLIANTLY FOR THE PERIOD, THE SPRINGFIELD METER ESSENTIALLY RECORDED FLOW CONTINUOUSLY.

THE SENSOR -- THE FLOW SENSOR WHICH READS LEVEL AND VELOCITY HAD NO ANOMALY, SAME THING WITH THE GARLAND AV METER.

WRKED FOR 56 STRAIGHT DAYS. THE GRAPH ON THE RIGHT GIVES YOU AN INDICATION OF IF YOU WANT THEORETICAL VERSUS WHAT THE METER IS READING. THAT BASICALLY DEMONSTRATES THERE IS NO ANOMALY, IE, IT IS SOMETHING HAPPENING WITH THE METER THAT WASN'T EXPECTED. NEXT SLIDE.

WHAT DID THE PROOF OF CONCEPT STUDY FIND? BOTH LOCATIONS, THE SPRINGFIELD METER STATION, THE PROPOSED EXISTING AND AND THE RALEIGH CREEK STATION EXPERIENCED A VARIETY OF FLOW CONDITIONS, WHAT WE CALL FREE FLOW, IT IS BEHAVING THE WAY IT IS SUPPOSED TO.

THE TAIL WATER, BACK WATER AND SURCHARGE CONDITIONS.

WHAT WE SAW ALL THESE TYPES OF FLOW CONDITIONS OVER THE STUDY PERIOD AND THE AV METERS CONTINUOUSLY RECORDED FLOW REGARDLESS OF THE FLOW CONDITION, WHICH IS WHAT YOU WANT WITH THE BILLING METER. THERE WERE NO CONDITIONS ENCOUNTERED WHERE THE DATA WAS NOT USABLE.

BECAUSE OF THAT, IT DEMONSTRATED THE AV METERING IS CAPABLE OF MEASURING FLOW WITH A HIGH DEGREE OF CERTAINTY.

YOU WILL NOT HAVE PERIODS WHERE YOUR METER WILL BE DOWN, FAILED, NOT ABLE TO RECORD. THE BIG THING IS THE FLOW CONDITIONS WE PHYSICALLY SAW AND WERE MEASURE D DURING THE STUDY PRECLUDES THE USE OR ELIMINATES THE USE OF ANY OTHER TYPICAL GRAVITY THAT WE DISCUSSED, WHICH IS DEPENDENT ON ESSENTIALLY A FREE FLOW CONDITION. NEXT SLIDE.

WHAT WE SAW, THE CONFIGURATION WE ARE RECOMMENDING THE DC POWERED THAT HAS A CELLULAR COMMUNI COMMUNICATIONS. IT SHOULD COMPRISE OF TWO SENSORS, ONE IS WET AND ONE IS DRY.

THE DATA LOGGER OR UNIT HAS A LOGGER COMMUNICATIONS, IF YOU WANTED TO PLUG THAT INTO A HIGHER LEVEL CONTROL, YOU COULD.

IT IS SOLAR POWER CAPABLE. THIS TYPE OF SYSTEM ESSENTIALLY IS COMPLETELY AUTONOMOUS. THE INTERESTING THING IS, LIKE WE WENT THROUGH WITH OUR VALENTINE'S DAY FREEZE WOULD BE UNAFFECTED BY POWER OUTAGES OR ANYTHING ALONG THAT LINE BECAUSE IT IS AUTONOMOUS. NEXT SLIDE, PLEASE.

SO, AGAIN, THE BENEFITS ARE, IT IS AUTONOMOUS POWER COMMUNICATION, IT IS PROGRAMMABLE SO ANY ISSUES OR ALARMS THAT COME UP CAN BE SENT TO EVERYONE WHO IS A -- ON THE LIST ESSENTIALLY. THAT WOULD BE ROWLETT AND GARLAND. IT ALLOWS FOR CONTINUOUS MEASUREMENT OF THE FLOW RATE AS WELL AS THE CONDITIONS ENCOUNTERED IN THE SEWER. THE REDUNDANT SENSEOR ARRAY,

CAN'T SAY ELIMINATE BUT FOR THE MOST PART DROPS THE PROBABILITY OF FLOW MEASUREMENT DUE TO MALFUNCTION.

IF ANYONE WAS INCLINED TO ENTER THE SEWER TO PHYSICALLY MEASURE THE FLOW AND VELOCITY TO COMPARE TO THE METER CAN DO THAT.

THAT IS A BIG PLUS ON VERIFICATION AND DISPUTE.

NEXT SLIDE. ONE OF THE THINGS WE MENTIONED WAS THE DATA DELIVERY SERVICE OPTION WHICH IS ESSENTIALLY BUYING THE DATA. ONE OF THE THINGS THAT THE DDS, AGAIN, HELPS WITH MAKING SURE YOU DON'T HAVE DOWN TIME, YOU DON'T LOSE DATA, THINGS ARE NOT FUNCTIONING PROPERLY, THAT SERVICE PROVIDER PROVIDES EQUIPMENT FOR THE FLOW REPORTING. MOST OF THEM HAVE ENOUGH TIME TO GUARANTEE, HOP DOES OF 95% WHICH MEANS THAT AT ANY GIVEN TIME YOU WOULD POTENTIALLY LOSE 1.5 DAYS OF DAYTONA GIVEN MO -- DAYTONA GIVEN MONTH. IT REPORTS VOLUME STATISTICS TO ALL PARTIES. THERE IS FORMAL INSTALLATION, CALIBRATION AND DATA ANALYSIS. ALL THE EQUIPMENT IS INSTALLED.

ALL THE MAINTENANCE IS PROVIDED. QUARTERLY METER CALIBRATIONS ARE PROVIDED. TECHNOLOGY UPDATE PROVIDED.

WE ARE NOW ALL ON 5G, I THINK IT IS.

EVENTUALLY THE 4G IS GOING TO BE PHASED OUT, THAT WOULD BE AUTOMATICALLY UPDATED. THE REAL IMPORTANT THING IS IT IS AN AUTOMATED UPDATE FROM THE LOGGER.

THEY PULL OR RETRIEVE THE DATA EVERY HOUR FROM THE LOGGER IN THE FIELD SO THAT YOU HAVE A REDUNDANT BACKUP FOR THE DATA.

THE LOGGER HAS IT IN ITS MEMORY. THEY PULL WHAT THAT MEANS IS WHEN THEY PERFORM THE CALIBRATION, THEY HAVE TO GO THROUGH THE UNIT PROGRAMMING.

IT WILL NOTE THE DATE AND TIME IT WAS CALIBRATED IN THE LOG OF DATA IN THE LOGGER. THEY PROVIDE AN ONLINE WEB BASED FLOW DATA MANAGER WHICH YOU GET A LOGIN AND YOU CAN GO TO THE WEB PORTAL AND SEE WHAT IT IS DOING AND SEE WHAT IT DID THE PREVIOUS WEEK, SO ON AND SO FORTH.

AGAIN, YOU GET 24/7 ACCESS TO THAT THE DATA AND RAW DATA AND LIVE SUPPORT. ONE CRITICAL THING, WE TOUCHED ON THIS BACK WHEN WE STARTED, THE HOP DDS IS ACCEPTED AND USED BY GARLAND CUSTOMERS FOR BILLING.

IT IS SOMEWHAT OF, I WOULD SAY PLUG AND PLAY.

THAT. THANK YOU FOR YOUR TIME TONIGHT TO DISCUSS THE WASTE WATER CONTRACT TREATMENT FOR THE GARLAND WASTE WATER PLANT, ENTERED INTO A CONTRACT ON JUNE 8, 1994. THE 25-YEAR CONTRACT EXPIRED IN MAY 2020 AND WAS EXTENDED UNTIL A NEW CONTRACT COULD BE APPROVED FOR THE PURPOSE OF THIS ITEM IS TO DISCUSS THE NEW TERMS AND RECEIVE DIRECTION ON THE CONTRACT RENEWAL WITH COUNCIL.

AND BRIAN IS PRESENTING TONIGHT. >> THE TECHNICAL ISSUES RELATED TO THE METER SO NOW WE'LL MOVE TO THE CONTRACT ITSELF.

ORIGINALLY -- GO TO THE NEXT SLIDE.

THE CITY OF GARLAND PROVIDES TREATMENT FOR SEVERAL CITIES INCLUDING ROWLETT AND SAXIE AS WELL AS PORTIONS OF DALLAS, RICHARDSON AND SUNNIVILLE. THEY HAVE TWO BIOLOGICAL TREATMENT FACILITIES. THE ONE THE CITY OF ROWLETT USES IS THE CREEK WATER TREATMENT PLANT, THAT'S THE ONE THAT GARY WAS TALKING ABOUT WHERE THE METERS WOULD COME IN.

AS HE INDICATED, THEY HAVE -- A COUPLE OF YEARS AGO THEY PUT IN A CHECK METER. THAT WAS SOMETHING THEY DID NOT HAVE IN THE PREVIOUS TIME. NEXT SLIDE.

THE PREVIOUS CONTRACT WAS A 25-YEAR AGREEMENT.

WE ENTERED INTO THAT ON JUNE 8 OF 1994.

IT DID EXPIRE APRIL 1, BUT THAT IS -- WE HAVE BEEN WORKING THROUGH THE ISSUES WITH THE PROOF OF CONCEPT AND TO BE ABLE TO GET THE DRAFT OF THE AGREEMENT RENEWED SO THAT WE COULD GET TO THIS STAGE TONIGHT AND HAVE BOTH OF THESE READY TO GO. THE MAIN THINGS WE HAVE BEEN NEGOTIATING IS THE AGREEMENT ON THE NEW SEWER METER SOLUTION WHICH IS WHY WE DID THE PROOF CONCEPT AND THE NEW TERMS. JUST A LITTLE PERSPECTIVE, THEY DIDN'T COVER THIS IN THE METER DISCUSSION, BUT WE TREAT -- OR THEY TREAT ABOUT 1.6 BILLION GALLONS A YEAR FOR ROWLETT. NOW, AS YOU KNOW, WE ACTUALLY RECEIVE OR USE AROUND 2.3 TO 2.4 BILLION GALLONS OF WATER.

SOME OF THAT GOES STRAIGHT INTO, YOU KNOW, INTO THE STORM SEWER, THE DRAIN. PEOPLE WATER THEIR LAWNS AND THINGS LIKE THAT. THIS IS MOSTLY INTERNAL DOMESTIC AND COMMERCIAL USE. IT GOES DOWN TO THE TOILET SYSTEM, THE SINK, IT GOES INTO THE SYSTEM TO BE TREATED.

NEXT SLIDE. WHAT WE'LL COVER IN THE NEXT FEW SLIDES IS REALLY THE MAIN DIFFERENCE BETWEEN THE 1994 VERSION OF THE CONTRACT AND THE REVISED.

ONE THING I WILL POINT OUT, IT IS FIVE YEARS LESS.

IN 1994 IT WAS A 25-YEAR AGREEMENT.

AGAIN, THEY ARE TRYING TO STANDARDIZED THIS TEMPLATE FOR ALL OF THEIR CUSTOMERS. THEY PREFER AND WANT TO GO TO A 20-YEAR AGREEMENT. ONE THING WE WERE EXTREMELY SENSITIVE TO IN THE DISCUSSIONS WITH THIS IS THAT THERE WOULD BE NO TAKE OR PLAY CLAUSE, NO MINIMUM WE WOULD HAVE TO PAY FOR. WE WERE SUCCESSFUL IN MAKING SURE THAT DID NOT HAPPEN. AS A RESULT, THAT IS NOT AN ISSUE IN THE NEW AGREEMENT. NEXT SLIDE.

IN TERMS OF THE METERING, I KNOW GARY, THEY TOUCHED ON THIS.

ONE OF THE BIGGEST THINGS WE HAD WITH THE DISAGREEMENT WITH GARLAND A FEW YEARS AGO WAS WHEN DID THE METER BECOME INACCURATE? THERE WERE TIMES WE HAD CALIBRATION DONE BUT AS WE FOUND OUT THROUGH A STUDY, THE CALIBRATION WAS NOT DONE CORRECTLY. AND THE TECHNOLOGY -- THIS IS THE FUNDAMENTAL PART OF IT, THE TECHNOLOGY WAS NOT DESIGNED FOR THAT, FOR THAT LOCATION. WHEN THEY HAD STORM LIKE CONDITIONS AND THEY BACKED UP IT WAS NOT CORRECTLY CALCULATING THAT WATER. AS A RESULT, THAT'S WHERE YOU GOT THESE UP AND DOWN SITUATIONS.

SOMETIMES EVEN DAYS WITHOUT ANY READING AT ALL.

WHAT THEY HAVE PUT IN PLACE IN THIS AGREEMENT IS THAT THERE IS A 5% OVERAGE OR UNDERAGE BEFORE WE GET INTO AN ISSUE.

IN OTHER WORDS, WHAT THEY ARE SAYING, THIS IS THE VARIANCE.

THEY ARE OKAY WITH 5% EITHER WAY.

WE ARE OKAY WITH THAT AS WELL. IF THE METER IS AT 90% AND THEY BELIEVE IT SHOULD BE AT 100%, THAT'S WHEN THEY'LL RAISE THE ISSUE. IF IT IS RUNNING AT 97%, WE ARE ALL GOOD AND WE KEEP GOING. THAT WAS ONE THING THAT WAS CHANGED TO THE AGREEMENT THAT WE REALLY LIKED.

WHEN YOU TRY TO FIGURE OUT WHEN THE METER BECAME INACCURATE, EVERY SIX MONTHS THEY HAD A CALIBRATION.

THAT IS WHEN THE METER CAN BE CHECKED IS WORKING AS DESIGNED.

IT SHOULD BE A SIMPLE THING TO GO BACK TO THE LAST CALIBRATION.

OR IF WE KNOW WHEN IT BECAME INACCURATE, SOME OTHER WAY WE HAVE FOUND OUT, THEN WE WOULD ONLY GO BACK TO THAT POINT.

LET'S SAY WE ARE FIVE MONTHS INTO IT, YOU CAN DETERMINE, THERE WAS AN EVENT TWO MONTHS PRIOR, WE WOULD ONLY GO BACK TO THAT. IF WE DON'T, WE CAN GO BACK TO THE LAST CALIBRATION. IF THERE IS AN ERROR MARGIN OF 5%, THAT'S WHEN WE WOULD DO SOMETHING ABOUT IT.

THE SECOND PIECE OF THAT, IF FOR SOME REASON THAT METER, WE CANNOT DETERMINE EVEN THROUGH THE CALIBRATION OR WHEN THE

INACCURACY STARTED, THEY WOULD GO BACK TO THE AVERAGE USE OF THE LAST 12 MONTHS -- BASICALLY, IT IS A PRO RATIO, THEY WOULD USE THE AVERAGE FOR THE PAST YEAR.

THAT IT WOULD BE -- THIS IS MUCH SIMPLER THAN THE PREVIOUS METHOD AND WHAT CAUSED US TO HAVE THIS LONG, YOU KNOW, MEDIATION WITH GARLAND THAT TOOK SEVERAL YEARS TO RESOLVE.

STAFF IS VERY PLEASED WITH THIS PART OF THE AGREEMENT.

NEXT SLIDE. IN TERMS OF RATES AND CHARGES, THE CALCULATION TO DETERMINE RATES AND CHARGES DID NOT CHANGE. THEY'LL USE THE SAME METHODOLOGY AS BEFORE. THE SECOND THING, IF FOR SOME REASON WE GO BACK TO THAT DISPUTE WITH THE METER OR THERE IS STRICTLY A BILLING DISPUTE, WHAT WILL HAPPEN IS THAT WE COULD -- WE COULD PAY THE AMOUNT, THE DISPUTED AMOUNT.

IF WE RESOLVE IT IN OUR FAVOR, WE WOULD OBVIOUSLY GET OUR FUNDS BACK PLUS ANY INTEREST. IF IT IS RESOLVED IN THEIR FAVOR, THERE IS NO INTEREST BECAUSE THEY'VE HAD THE MONEY ALL ALONG. THE OTHER THING LIKE WE DID BEFORE, IF FOR SOME REASON WE CANNOT AGREE IN PRINCIPAL ON HOW TO DO THIS, WE CAN BRING IN A THIRD PARTY EXPERT, BOTH PARTIES WOULD PAY FOR HALF THE COST AND THEN IF WE HAVE TO GO TO NON-BINDING MEDIATION AGAIN, AND WE HAVE GONE THROUGH THAT PROCESS BEFORE. BUT I THINK AS YOU'LL SEE AS WE GO THROUGH THESE SLIDES, THERE ARE MANY STEPS TO ENSURE WE DON'T GET TO THIS POINT. AGAIN, THIS IS SOMETHING THAT WE FEEL VERY COMFORTABLE WITH. NEXT SLIDE.

ONE THING IN READING THROUGH IT DOES CAUSE CONCERNS.

IT IS NOT REALLY CONCERNS THAT GARLAND INSISTED ON THE LANGUAGE IN HERE. IT IS JUST A CONCERN AND THE REALIZATION OF WHAT HAPPENS IN A TRUE EVENT.

YOU KNOW, AS YOU GUYS KNOW, EVERY TIME WE HAVE A STORM THAT KNOCKS OUT POWER, THEN WE HAVE 13 STATIONS THAT DON'T HAVE GENERATORS. PLUS THOSE THAT DO, SOME OF THEM ARE SMALL. YOU STILL HAVE TO GO CHECK ON THEM. WE HAVE BEEN FORTUNATE TO HAVE VERY FEW SPILLS RELATED TO OUR STATIONS, BUT WHAT GARLAND IS SAYING IS THE SAME THING. IF THEY HAVE SOME EVENT, GRANTED YOU WON'T HAVE A METEOR HIT IT. LET'S SAY THE METEOR HIT THE SYSTEM, YOU CAN'T BLAME GARLAND FOR THAT.

IN ADDITION TO THAT, WE ARE RESPONSIBLE FOR ALL WHAT THEY CALL -- THE INFILTRATION AND THE INFLOW.

AS LONG AS WE CONTINUE TO KEEP UP AND PLACE OUR SEWER PIPES, WE CAN REDUCE THAT AMOUNT. SEWER PIPES ARE NOTORIOUS FOR STARTING TO GET ROOTS IN THEM AND FOR ALLOWING BASICALLY WHAT WOULD BE STORM WATER TO GET INTO -- SENT DOWN TO THE PLANT THAT HAS TO BE TREATED. THERE IS AN EXPENSE TO THAT.

WHAT THEY ARE SAYING IS THAT FOR SOME REASON AN EVENT IS CAUSED BY US THAT CAUSES THE PLANT TO HAVE TO TREAT THAT WATER, WE ARE STILL RESPONSIBLE FOR IT. NEXT SLIDE.

IN TERMS OF DETERMINATION, AGAIN, THIS IS NOT MANAGER YOU WOULD EXPECT IN A 20-YEAR AGREEMENT.

IF FOR SOME REASON THERE IS A MATERIAL BREACH IN THE CONTRACT, THEN THEY GET 180 DAYS TO CURE. THE SAME THING FOR THEM, IF WE ARE DELINQUENT FOR MORE THAN SIX MONTHS, THEY CAN OBVIOULY TELL US TO TAKE A HIKE. NOT THAT THIS IS REALLY A CONCERN BECAUSE YOU'LL REMEMBER EVEN WHEN WE WERE IN A PRETTY BIG DISPUTE WITH GARLAND AT ONE TIME A FEW YEARS AGO, AGAIN, WE NEVER ALLOWED IT TO GET TO THIS POINT.

WE STILL PAID THEM MINIMUM PAYMENTS JUST TO MAKE SURE WE WEREN'T BEHIND. IT IS THE EXCESS PAYMENTS WE HELD ON TO. WE NEVER WOULD HAVE REACHED THIS ISSUE. NEXT SLIDE.

BEFORE I TURN IT OVER TO QUESTION FROM COUNCIL, I WANT TO THANK OUR PUBLIC WORKS DIRECTOR FOR WORKING ON THIS FOR ESSENTIALLY SEVERAL YEARS. I THINK IT IS FAIR. I THINK WE'LL BE IN GOOD SHAPE.

THERE IS NO EXPECTATION FROM OUR STAFF OR OUR CONSULTANTS THIS METER WILL CAUSE A DIFFERENCE IN WHAT WE ARE PAYING TO GARLAND AT THIS TIME. I THINK WE HAVE A LOT OF CONFIDENCE BECAUSE NOT ONLY THE PROOF OF CONCEPT BUT THE TIMELINE THEY INSTALLED THE CHECK METER, HOW LONG WE HAVE SEEN THE RESULTS OF THE CHECK METER, THEY PAID FOR LESS WATER TO BE TREATED OVER THIS PAST YEAR THAN WHAT WE DID DURING THE YEARS WHEN WE WERE ESTIMATING. IT HAS -- I THINK WE WERE JUST BELOW 1.6 BILLION GALLONS WHERE WE HAD BEEN QUITE A BIT ABOVE THAT FOR SEVERAL YEARS. WE HAVE ROOM BUDGETARILY AND USAGE BEFORE WE WOULD START SEEING, YOU KNOW, SOME SORT OF A PRICE ISSUE. GUYS, THAT IS OUR PRESENTATION.

IN OUR INITIAL RESPONSE THROUGH THE WEEK OF FEBRUARY 14, FCC MONITORING THE WEATHER FORECAST TO DEPLOY CREWS SO WE COULD START SAFELY BEGINNING COLLECTIONS AGAIN.

THE FCC DEPLOYED EACH REAR LOADER WE HAD, EVEN THE SPARE ONES TO ASSIST WITH COLLECTING SOLID WASTE AND RECYCLE ROUTES.

WE KNEW THERE WOULD BE TWO WEEKS OF TRASH DOWN.

WE KNEW IT WOULD BE DIFFICULT TO GET IT UP.

BY THE END OF BUSINESS ON SATURDAY 27, ALL TRASH AND RECYCLING ROUTES WERE COMPLETED. THE 27TH WAS A SATURDAY.

WE GOT THERE AND FOUND A WAY TO GET IT IN.

WE WERE ABLE TO WORK AHEAD OF ROUTES IN ANTICIPATION OF HEAVY BULK SETOUTS. THAT DIDN'T MATERIAL UNTIL THE END OF THE FIRST WEEK, BEGINNING OF THE SECOND WEEK OF MARCH.

DURING THIS WEEK WE HAD MULTIPLE DRIVERS AND CREWS THAT WORKED
