PRESENTATION PROCLAMATION RECOGNIZING THE WEEK OF THE 22ND THROUGH THE 23RD AND WE HAVE COUNCILMEMBER LANNING DOING THE PRESENTATION TONIGHT.

>>AS A FORMER CHAIR OF THE CHAMBER OF COMMERCE THIS IS DEFINITELY AN HONOR AND A PRIVILEGE TO MEET TO GIVE THEM THIS PROCLAMATION TONIGHT. THE ROWLETT CHAMBER OF COMMERCE WAS ESTABLISHED IN 1924 AND SERVES A FUNDAMENTAL PART OF THIS COMMUNITY WITH NUMEROUS PROGRAMS PROMOTING STEADY AND BALANCED ECONOMIC WELL-BEING WITHIN OUR CITY. THAT IS A MOUTHFUL. THE TEXAS CHAMBER OF COMMERCE WEEK IS COORDINATED ANNUALLY THROUGH THE TEXAS CHAMBER OF COMMERCE EXECUTIVES.

TCC IS AN ORGANIZATION OF CHAMBER EXECUTIVES AND PROFESSIONAL STAFF FROM ACROSS THE STATE WORKING TOGETHER TO IMPROVE THE BUSINESS CLIMATE IN TEXAS. THE ROWLETT CHAMBER OF COMMERCE MEMBERS, STAFF AND VOLUNTEERS ROUTINELY BEEN INVOLVED IN MANY ACTIVITIES THROUGHOUT OUR COMMUNITY.

THESE INCLUDE THE ROWLETT ECONOMIC DEVELOPMENT ADVISORY BOARD AND OTHER BOARDS AND COMMISSIONS, BUSINESS RECRUITMENT AND RETENTION, EDUCATION AND WORK WITH DEVELOPMENT. COMMUNITY DEVELOPMENT AND BEAUTIFICATION AMONG OTHERS. LET'S READ THE PROCLAMATION.

>> WHEREAS MORE THAN 3000 CHAMBER OF COMMERCE IN THE UNITED STATES DISTINGUISH THEMSELVES AS THE VOICE OF BUSINESS AND MORE THAN 500 LOCAL CHAMBER OF COMMERCE IN TEXAS ACTIVELY SERVE THEIR BUSINESS COMMUNITIES. WHEREAS THE WORK ACCOMPLISHED BY LOCAL CHAMBERS HAS BENEFITED OUR STATE THROUGH THEIR ECONOMIC ELEMENT, VISITOR SERVICES AND COMMUNITY DEVELOPMENT PROGRAMS. WHEREAS LOCAL CHAMBERS OF COMMERCE INCLUDING THE ROWLETT AREA CHAMBER AND VISITOR CENTER HAVE DISTINGUISHED THEMSELVES THROUGH THE UNCEASING PROMOTION OF THEIR LOCAL COMMUNITIES. WHEREAS THE ROWLETT AREA CHAMBER AND VISITOR CENTER HAS ADVOCATED ON BEHALF OF THE BUSINESS COMMUNITY AT THE FEDERAL, STATE AND LOCAL LEVEL IS A CATALYST FOR BUSINESS GROWTH, COVENANTOR OF LEADERS AND INFLUENCERS AND A CHAMPION FOR A STRONGER UNITY. WHEREAS THE ROWLETT CHAMBER AND VISITOR CENTER HAS PROVIDED ONGOING EDUCATIONAL OPPORTUNITIES FOR THE BUSINESS COMMUNITY, IS A VOICE FOR CALM AND REASON AND IS THE SOURCE OF INFORMATION, EDUCATION AND SUPPORT DURING UNCERTAIN TIMES OF CRISIS. THE ITEM BEFORE US CONCERNS MERIT VILLAS A PROJECT, MIXED-USE PROJECT THAT IS A FORM -BASED CODE PROJECT IN THE NORTH SHORE DISTRICT ON THE NORTHWEST CORNER OF HICKOX ROAD AND MERIT ROAD. A DEVELOPER OF THAT PROPERTY IS 8600 MERIT PROPERTY OPERATOR LLC AND WE WILL REFER TO THEM AS MERIT PROPERTY THROUGH THE PRESENTATION. IT'S AN 11 ACRE TRACT AND IT CONSISTS OF 71 LOT THAT ARE MIXED-USE DEVELOPMENT. THERE ARE 60 TOWNHOMES, 10 COMMON AREA HOA LOTS AND A SINGLE LOT THAT WILL BE USED FOR 79 BY FAMILY UNITS IN ABOUT 1900 SQUARE FEET OF COMMERCIAL SPACE. THE ROWLETT DEVELOPMENT CODE REQUIRES DEVELOPERS TO BUILD ROADS THAT ARE LOCATED ADJACENT TO THEIR PROPERTY THAT THEY ARE GOING TO DEVELOP. WHEN THAT STREET IS A COMPONENT OF THE CAPITAL IMPROVEMENTS PLAN FOR ROADWAY IMPACT FEES, WE DON'T ENFORCE THAT REQUIREMENT AS DILIGENTLY AND LESS THERE ARE SOME MITIGATING CIRCUMSTANCES AND IN THIS CASE MERIT PROPERTY DOES NEED SOME EMERGENT C AND CIRCULATORY ACCESS. AND THE MASTER THOROUGHFARE PLAN AND THE CAPITAL IMPROVEMENT PLAN FOR ROADWAY IMPACT FEES FORECAST THE EXTENSION OF HICKOX ROAD. THAT CONSTRUCTION WOULD SATISFY THE OBLIGATION TO EXTEND HICKOX UNDER THE MASTER THOROUGHFARE PLAN AND CAPITAL IMPROVEMENT PLAN FOR IMPACT FEES. IT WILL ALSO PROVIDE A SECOND POINT OF ACCESS FOR EMERGENCY INGRESS AND EGRESS TO THE PROJECT. IT, TOO, INCLUDED THE CONSTRUCTION OF FAYETTEVILLE AVENUE. SO, LET ME GIVE YOU SOME INFO ON FAYETTEVILLE AVENUE ITSELF. THE MASTER THE FAILTHOROUGHFARE PLAN WILL INCLUDE A 54 FOOT CONCRETE ROADWAY HAVING TO TRAVEL LANES AND THE LOSS WILL INCLUDE PARALLEL ON STREET PARKING. IT WILL ALSO INCLUDE A 14 FOOT MEDIAN AND THAT IS IMPORTANT BECAUSE THAT MEDIAN WILL THEN BE OR CAN BE A CONVENIENT BREAK POINT THROUGH THE MERIT VILLA PROPERTY AND THE UNDEVELOPED PROPERTY TO THE SOUTHEAST.

WHEN THIS IS EXTENDED OR FAYETTEVILLE AS IT IS NOW KNOWN IS CONSTRUCTED IT CAN FUNCTION AS A TWO-WAY ROADWAY AND WILL LOOK JUST LIKE A LOCAL RESIDENCE IEETS AND SIDEWALKS.

LET'S TALK ABOUT IMPACT FEES. BY CONSTRUCTING FAYETTEVILLE AVENUE MERIT PROPERTY WILL HAVE RELIEVED THE CITY AT LEAST PARTIALLY BECAUSE HER ONLY BUILDING HALF OF IT OF THE CITY'S RESPONSIBILITY TO EXTEND HICKOX ROAD AS DEFINED IN THE MASTER THOROUGHFARE PLAN AND CAPITAL IMPROVEMENT PLAN. WHEN WE LOOK AT THE ROWLETT CITY CODE UNDER IMPACT FEES WE CAN SEE THAT THE CODE DOES ADDRESS THE SITUATION WHERE A DEVELOPER BUILDS INFRASTRUCTURE THAT THE CITY OTHERWISE WOULD BE OBLIGATED TO CONSTRUCT BECAUSE OF THE IMPACT FEE CAPITAL AND MOVEMENT PLAN AND THAT SOLUTION IN THE CODE IS TO OFFER AND IMPACT FEE CREDIT TO THE DEVELOPER. AND, TONIGHT MERIT PROPERTY IS REQUESTING A CREDIT OF IMPACT FEES IN EXCHANGE FOR BUILDING FAYETTEVILLE AVENUE. SO, WHAT IS THAT CREDIT? HOW MUCH CREDIT SHOULD WE ALLOW MERIT PROPERTY? IF WE LOOK AT THE CONSTRUCTION COST, WE HAVE MERIT PROPERTIES CONCRETE PROPERTY LINE UNIT PRICES AND FROM THE CONSTRUCTION DRAWING WE KNOW HOW BIG, HOW MUCH SURFACE AREA AND HOW MANY SQUARE YARDS FAYETTEVILLE AVENUE IS WE CAN EASILY CALCULATE THE COST TO CONSTRUCT FAYETTEVILLE AND THAT COST IS $238,532. NOW WE NEED TO LOOK AT THE IMPACT FEES. HOW MUCH CAN WE EXPECT TO COLLECT FROM THIS TYPE OF PROJECT? ONE OF THE DECIDING FACTORS TO CALCULATE IMPACT IS WHEN THE PLAT WAS RECORDED BECAUSE IMPACT FEES ARE ASSESSED AT THE TIME OF CLADDING. THE PLAT FOR MERIT VILLAS WAS RECORDED ON JULY 22, 2021. THE IMPACT FEE SCHEDULE THAT WAS ADOPTED BY COUNSEL ON DECEMBER 19, 2019 PROCEEDS THAT DATE AND SO THOSE ARE THE RATES THAT GOVERN AND HAVE BEEN NO UPDATES TO THE IMPACT FEE SCHEDULE SINCE THEN. THOSE RATES ARE STILL IN EFFECT

. MERIT VILLAS IS NORTH OF 66 AND FROM A MAP AND THE IMPACT FEE OF EIGHT THAT WE DID IN 2019 WE KNOW THAT MERIT VILLAS IS LOCATED IN SERVICE AREA ONE. SO, WE KNOW THAT THERE ARE 60 SINGLE FAMILY HOMES AND WE CAN LOOK UP IN THE MASTER FEE SCHEDULE AND SEE THAT EACH SINGLE-FAMILY TOWNHOME IS ASSESSED AT A RATE OF $1674. THIS FIRST COLUMN IS SERVICE AREA ONE IN THE MASTER FEE SCHEDULE. THERE ARE 79 MULTI FAMILY DWELLING UNITS THAT WILL BE BUILT INTO THREE-STORY BUILDINGS. A THREE-STORY BUILDING IS CONSIDERED A MIDRISE MULTIFAMILY HOUSING AND SO WE CAN LOOK UP IN THE FEE SCHEDULE AND SEE THAT EACH DWELLING IS ASSESSED AT $3063 PER UNIT. AND LAST IS THE COMMERCIAL SPACE ON THE GROUND FOR OF ONE OF THE MULTIFAMILY BUILDINGS AND IT IS 1892 SQUARE FEET AND HERE, WE COME TO A LITTLE BIT OF A DILEMMA. A DECISION THAT WE HAVE TO MAKE, HOW MUCH CAN WE EXPECT TO COLLECT ON THAT SPACE WIN A BUILDING PERMIT IS PULLED FOR THE BUILDOUT OF THAT INTERIOR SPACE? THERE ARE MANY DIFFERENT COMMERCIAL CATEGORIES, LAND USE CATEGORIES THAT ARE ASSESSED IMPACT FEES AND THEY ARE ALL ASSESSED AT DIFFERENT RATES AND DIFFERENT UNIT. WHEN YOU LOOK THROUGH THE LIST THERE ARE SOME THAT ARE NOT GOING TO BE VIABLE. A LOT OF THE AUTOMOBILE RELATED USES ARE NOT ALLOWED IN THIS ZONE. SOME OF THE USES HAVE DRIVE-THROUGH WINDOWS AND GIVEN THAT THIS SPACE IS IN THE BOTTOM FLOOR OF A MULTIFAMILY UNIT IS NOT SET UP FOR A DRIVE THROUGH. YOU LOOK FOR THE HIGHEST VALUE, HIGHEST RATE THAT COULD BE ASSESSED ON JESUS THAT IS POTENTIALLY VIABLE IN THIS DEVELOPMENT AND THAT WOULD BE THE FAST FOOD RESTAURANT WITH THE DRIVE-THROUGH WINDOW.

THAT USE IS ASSESSED AT $20,290 PER THOUSAND SQUARE FEET. THAT IS OF GROSS FLOOR AREA. SO, WE CAN DO THE MATH AND WE KNOW THAT THERE ARE SO MANY RELEVANT UNIT P WE KNOW THE RATE PER UNIT. IT IS A SIMPLE MOLD KITCHEN FOR TOWNHOMES, THE ESTIMATED FEES ARE OVER ONE HER THOUSAND. FOR THE MULTIFAMILY IMPACT FEE WOULD BE TO A $41,977 AND IF A FAST FOOD RESTAURANT WERE TO MOVE INTO THAT SPACE WE COULD COLLECT AS MUCH AS $38,389. ADDING THEM ALL UP TOGETHER, 380,806 DOLLARS IS WHAT WE COULD POTENTIALLY COLLECT IN ROADWAY IMPACT FEES FOR THE MERIT IT WAS PROJECT. BY A SIMPLE COMPARISON IF WE LOOKED BACK WE COULD SEE THE CONSTRUCTION COSTS ARE TU233,000 SO THE POTENTIAL IMPACT FEES ARE MORE IN THE CONSTRUCTION COST AND WE WANT TO LIMIT THE CREDIT TO THE AMOUNT OF THE CONSTRUCTION COST. AND, JUST TO TALK A LITTLE BIT ABOUT FINANCIAL CONSIDERATIONS, THE DEVELOPER WOULD BE GIVEN A CREDIT OF THAT 233,000. THAT REPRESENTS LOST IMPACT FEE REVENUE TO THE CITY AND IN RETURN GET A ROADWAY THAT WE ADD TO OUR ASSET AT THAT SAME VALUE AND WE DON'T HAVE TO CONTRACT FOR DESIGN. WE DON'T HAVE TO GO OUT FOR PUBLIC BID AND WE DON'T HAVE TO MANAGE CONSTRUCTION. SINCE THE POTENTIAL FEES THAT WE CAN COLLECT ARE MORE THAN THE CONSTRUCTION COST THE DIFFERENCE WOULD REPRESENT SOME ADDITIONAL ROADWAY IMPACT FEES THAT WE CONTINUE TO COLLECT ON THE PROJECT AMOUNTING TO OVER TUNA 70,000. MOREOVER IN ADDITION TO THE ROADWAY WE WILL COLLECT WASTEWATER IMPACT FEES AND WE ESTIMATE THOSE AT OVER $200,000. OUR RECOMMENDATION
