IN TAKING A LOOK AT THEM, I WAS CONCERNED THERE WAS NO EXPIRATION OF THE OPTION TO POSSIBLY LOCATE THE STORM WATER SEWER LINE ALONG MILLER ROAD FROM DELL ROCK GOING WEST TO THE RAILROAD AND THEN FOLLOWING THE RAILROAD UP TO THE LAKE. THIS IS WHERE THE EXISTING STORM WATER ALREADY FLOWS AND SEVERAL ENGINEERS HAVE SAID THAT'S A LOGICAL WAY TO CONSTRUCT THE STORM WATER, BUT THAT WAS NOT INCLUDED IN THE ANALYSIS AND POSSIBLY IT SHOULD HAVE BEEN. THEN GOING TO THE MEMORANDUM THE DOWN UNDER DESIGN OF THE PROJECT AND MY UNDERSTANDING IS THAT YOU ALL HAVE RECEIVED THIS ALSO. IT SAYS STORM SEWER LINE E. THAT'S WHAT WE'RE TALKING ABOUT, WAS DESIGNED IN THE CENTER OF THE OUTSIDE LANE OF PAVEMENT TO MINIMIZE WHEEL LOADS ON THE PIPE. THIS IS THE PAGE (INAUDIBLE)

TO SECURE THESE RIGHT-OF-WAYS. SO, THE PROJECT IS CONTINUED WITH THE BID PROCESS AND NO DELAYS TO EXPLORE OTHER SEWER LINE LOCATIONS WITH ALL OF THESE INCONSISTENCIES, (INAUDIBLE)

I WAS HAPPY AT THE FEBRUARY 15TH MEETING WHEN THE ANNUAL COMPREHENSIVE REPORT WAS PRESENTED HEARING THAT FISCAL YEAR 2021 EXCEEDED EXPECTATIONS AND I REMEMBER BRIAN SAYS THAT THE CITY'S IN THE BEST FINANCIAL SHAPE THAN IT'S BEEN IN THE 19 YEARS OF TENURE AND THAT'S GREAT AND TONIGHT'S BUDGET AMENDMENTS PAINTED A GREAT PICTURE. I LIKED THE $365,000 EXTRA SALES TAX. I'M HOPING THAT WE'LL SEE THAT FIGURE INCREASE MUCH MORE AS THE CITY AND CHAMBER AND ECONOMIC DEVELOPMENT BOARD AND OTHER GROUPS WORK TOGETHER TO WRING IN MORE STRAPPEDS AND RETAIL ESTABLISHMENTS AND AS THE DREAM OF SAPPHIRE BAY COMES TO FRUITION. I WOULD LIKE TO COMMENT ON 7B THE APPOINTMENT OF THE STAKE HOLDERS GROUP, I THINK THAT UPDATING THE RDC AND THE FDC TO CREATE A UNIFIED COMPREHENSIVE CODE IS A GREAT IDEA AND MUCH NEEDED TO RELIEVE THE CONFUSION ON THE PART OF THE CITIZENS AND SOMETIMES ON PARTS OF THE DEVELOPERS AND EVEN THOSE OF US ON PLANNING AND ZONING.

I'M HAPPY TO SEE YOU GETTING SO MANY CITIZENS INVOLVED AND ALSO OTHER IMPACTED INDIVIDUALS LIKE DEVELOPERS. THERE ARE REAL GREAT NAMES ON THE LIST FROM THE NEIGHBORHOODS AND THE BUSINESS COMMUNITIES, AND THE NON-PROFIT, AND PLANNING AND ZONING AND DEVELOPERS WHO HAVE BEEN INVOLVED IN OUR CITY. AND I DID NOTICE THAT THE TWO COUNCIL MEMBERS WHO'LL BE PART OF THE GROUP AREN'T NAMED AND I WAS WONDERING WHETHER THE COUNCIL WAS WAITING UNTIL THE NEW COUNCIL IS SEATED AND APPOINT THOSE COUNCIL MEMBERS NOW. I WOULD SUGGEST THAT YOU MIGHT AT LEAST APPOINT ONE MEMBER FROM THE CURRENT COUNCIL AND MAY BE WAIT UNTIL THE NEW COUNSEL'S SEATED TO APPOINT THE SECOND MEMBER. THAT'S JUST A SUGGESTION. AND FINALLY, THE PTS PROGRAM FOR FIRST RESPONDERS, THAT GRANT THAT'S 7G WHICH I UNDERSTAND HAS BEEN PULLED FROM THE CONSENT AGENDA.

DURING THE TIME I WAS A POLICE OFFICER AND A INSTRUCTOR AT THE POLICE ACADEMY, I SAW MANY OFFICERS AND SOME OF THE RECRUIT THAT IS I SAW SUFFERED THE CONSEQUENCES OF TRAUMATIC STRESS WHICH INCLUDES, DEPRESSION, DIVORCE, ALCOHOL ABUSE AND DRUG ABUSE. AND I EVEN HAD A FRIEND WHO TOOK HIS OWN LIFE. I'M VERY MUCH IN SUPPORT OF THIS GRANT AND IF WE DIDN'T GET THE GRANT I'M IN SUPPORT VERY MUCH OF FINDING A WAY TO EXPAND.

AS OF THE 19TH OF JANUARY IT NOW SAYS THAT ONLY THE CITY COUNCIL CAN REQUEST TO HAVE IT MOVE FOR REMOVAL FROM CONSIDERATION. THE REASON I THINK IT'S IMPORTANT FOR THE CITIZENS, IS I KNOW YOU ALL WORK VERY HARD AND PEOPLE ARE BEING TERMED OUT AND I APPRECIATE THE WORK OF ALL THE COUNCIL. BUT IF YOU HAVE A CONSENT AGENDA WITH A LIST OF FIVE OR SIX ITEMS AND ONE IS QUESTIONABLE, AND IT'S JUST HUMAN NATURE TO FLOW WITH THE EASY PATH. WHEREAS IF A CITIZEN WANTS TO HAVE YOU TALK ABOUT IT OR AT LEAST INDIVIDUALLY VOTE SO WE COULD SEE HOW EACH PERSON VOTED I THINK THAT'S IMPORTANT AND YOU'RE TAKING THAT AWAY FROM THE CITIZENS. I LOOKED ON THE CITY CHARTER AND ALL OVER FOR TWO DAYS TO FIGURE OUT WHERE OR WHY THAT CHANGED AND I CAN'T FIND A DOCUMENTATION ABOUT IT. MAY BE IT WASN'T A REQUIREMENT, MAY BE IT WAS A THING THAT THE CITY COUNCIL DID AS A COURTESY TO CITIZENS. I THINK AS A NEW COUNCIL AND MAYOR IS ELECTED, IT'S IMPORTANT TO BRING THAT BACK. WHAT DOES IT TAKE YOU, IF Y'ALL AGREE, YOU JUST DO ONE MORE VOTE FOR AN ITEM. TO ME, IT'S NO BIG DEAL FOR THE AMOUNT IT TAKES YOU, I DON'T MEAN THAT TO BE DEROGATORY, BUT FOR A CITIZEN, PARTICULARLY COMING UP CLOSE TO ELECTION TIME, YOU KNOW, AND THE PARTICULAR ITEM I HAD A QUESTION ON IS THE HULU/DISNEY, I CAN'T REMEMBER THE OTHER COMPANY, NETFLIX FRANCHISE TAX THING. THE REASON YOUR FRANCHISE REVENUE FOR INTERNET ACCESS AND CABLE TV ACCESS IS GOING DOWN IS BECAUSE THE CONSUMERS IS NOT GETTING WHAT THEY WANT. AND YOU'RE MISSING THE BIG GORILLA.

IT'S 3200 SQUARE FOOT HOME CONVERTED INTO A HOTEL. OVER THE SUPER BOWL WEEKEND, THERE WAS 20 PLUS PEOPLE IN THAT HOME AND EIGHT CARS THAT I CONFIRM TIDE TO THAT RENTAL, POSSIBLY 10. THEY CONVERTED THE GARAGE TO A GAME ROOM AND REDUCED THE PARKING SPACES FOR THAT HOME BY TWO. WHICH IS, WHAT THE ZONING DEPARTMENTS HAVE SAID THEY CAN'T ADD TO THE PARKING PROBLEM. AND WE HAVE A PARKING PROBLEM, ALREADY, IN THAT NEIGHBORHOOD BECAUSE PEOPLE PARKING ON BOTH SIDES OF THE STREET, BUT, UM, WE THOUGHT THAT THEY WERE RENTING IT FOR A SUPER BOWL PARTY, THEY LEFT BEFORE THE SUPER BOWL EVEN STARTED. AND THIS IS THERE WAS PROBABLY CLOSE TO 30 PEOPLE AT THAT HOUSE SUPER BOWL WEEKEND. THE TRASH SINCE IT BECAME A RENTAL IS GOTTEN OUT OF HAND. IT'S CAUSING, IT'S ATTRACTING RODENTS BECAUSE THEY LEAVE IT OVERFLOWING IN THE RECEPTACLES, I WILL SAY THAT CODE ENFORCEMENT HAS WORKED WELL WITH ME UP TO THIS POINT, BUT I THINK IT'S SOMETHING THAT A LOT OF CITIES NEED TO LOOK AT IN REGARDS TO THEIR ZONING.

BASICALLY, WE HAVE ZONED VACATION RENTAL BY OWNERS TO OPERATE HOTELS IN SINGLE-FAMILY NEIGHBORHOODS. AND IT'S THAT'S

AND THE REASON I BRING UP THE PARKING WITH THEM PARKING MORE CARS ON THE STREET, WE HAVE A BIG ENOUGH PROBLEM FOR FIRE-FIGHTER, AMBULANCES, PEOPLE GOING DOWN THE STREET WHEN CARS ARE PARKED ON BOTH SIDE. AND I KNOW THIS IS PROBABLY AN ISSUE THAT THE CITY IS VISITED BEFORE BUT, I DON'T WANT TO GO TO ENFORCING PARKING ON ONE SIDE OF THE STREET, I KNOW THAT WOULD INCONVENIENCE SOME HOMEOWNERS, BUT IT WOULD BE SAFER FOR THE POLICEMEN, FIRE-FIGHTERS, CHILDREN AND PETS. AND IT'S SOMETHING THAT I FEEL THAT THE CITY COUNCIL AND MAYOR SHOULD LOOK INTO. I NORMALLY COME WITH SOLUTIONS. (INAUDIBLE)

SOME OF OUR CONCERNS EXIST WITH RESIDENTIAL AND CITY LAWN CARE CONTRACTORS, ARE THEY FOLLOWING THE CITY CODE TO PICK UP LITTER RATHER THAN MOWING AND BLOWING LITTER AWAY HOW ABOUT LEAVES AND TRASH BLOWN ON THE STREETS AND LATER WASHED COUNCIL THE SEWERS WHEN STORMS COME. BUSINESS OWNER WHO DON'T TAKE THE TIME TO MAKE CERTAIN THAT THEIR PARK WILL THES ARE COMMENT CLEAR OF LITTER. IT'S A NORMAL RESPONSE TO EXPOSURE TO (INDISCERNIBLE) OF STRESS, IT'S ESTIMATED THAT BETWEEN 18-24% OF ALL COMMUNICATION OFFICERS AND APPROXIMATELY 35% OF ALL POLICE OFFICERS EXPERIENCE PTSD, OR POST TRAUMATIC STRESS IN THEIR CAREERS. NOT SURE EXACTLY WHAT THE STATS ARE FOR FIRE DEPARTMENT PERSONNEL, BUT I WOULD BE WILLING TO BET THAT IFFED PERSONNEL SUFFER FROM THE SAME RATIO AS WHAT POLICE OFFICERS SUFFER FROM. THE REQUEST FOR THE ALTERNATIVE COMPLIANCE WOULD BE TO REDUCE THE LANDSCAPING BUFFER WIDTHS FROM THE LEFT TO THE RIGHT. AND REMOVE PLANTINGS REQUIRED TO BE LICED IN THE BUFFERS ELSEWHERE ON THE SITE. THE TWO REQUESTS WOULD BE TO REDUCE THE 20-FOOT LANDSCAPE BUFFER ALONG LAKEVIEW PARKWAY, AND THE COMPATIBILITY BUFFER BETWEEN TWO COMPATIBILITY USES. THEY WOULD REDUCE THE LAKEVIEW PARKWAY FIVE FEET AND ON THE WEST SIDE, REQUESTING TO REDUCE THE 6-FOOT WIDE BUFFER TO A 4-FOOT WIDE BUFFER. TALKING MORE ABOUT THE LANDSCAPING ALONG LAKEVIEW PARKWAY, THE PRIMARY REASON IS TO KEEP THE CURRENT PAVEMENT FOR CIRCULATION AND PARKING. BASED UPON WHAT THE APPLICANT IS PROPOSING FOR THE NEW DEVELOPMENT, THERE WOULD BE 58 PARKING SPACES REQUIRED. THE SITE PLAN WHICH HAS BEEN PROPOSED AND APPROVED HAS 79 PARKING SPACES ON THAT. OUR CODE TRY TOSS LIMIT SITE FROM BEING OVERPARKED BUT THERE'S A PROVISION THAT ALLOWS FOR OUR DIRECTOR TO ALLOW FOR ADDITIONAL PARKING. BECAUSE OF THE NATURE OF THE BUSINESS PROPOSED FOR THIS PROPERTY, THE AMOUNT OF DRIVE-THRU AND WALK UP TRAFFIC, PEOPLE DRIVING TO THE LOCATION AND GOING INTO EITHER TAKE THEIR FOOD FOR TAKEOUT FOR TO EAT AT THE LOCATION, WE BELIEVE THAT ADDITIONAL PARKING IS WARRANTIED. SO, KEEPING THE PARKING CURRENTLY ON THE SITE IS A REASONABLE JUSTIFICATION FOR KEEPING THAT AND RETAINING THE PARKING. THE EVERGREEN SHRUBS WOULD REMAIN WITHIN THAT 5-FOOT WIDE BUFFER. THE FUTURE IMPROVEMENTS TO DALRACK AND LAKE EVERGREEN SHRUBS TO THE EAST YOU SEE THEM ILLUSTRATED IN THE PINK COLOR THERE, THERE ARE FIVE TREES REQUIRED WHICH WOULD REMAIN IN THE BUFFER AND 73 EVERGREEN SHRUBS OF WHICH 49 WOULD BE PLACED IN THAT BUFFER.

AGAIN, SINCE, PLANTS NEED ROOM TO GROW AND THRIVE, THE APPLICANT IS REQUESTING TO RELOCATE THOSE TO ANOTHER SPOT ON THE SITE. SO, WITH THE REQUIREMENTS FOR CONSIDERATION OF AN ALP INCLUDE THAT THERE ARE UNIQUE CHARACTERISTICS OF THE PROPERTY THAT WARRANT SPECIAL CONSIDERATION TO MODIFY AND THAT THOSE CONDITIONS ARE NOT SELF-CREATED.
