AS AUTHORED BY SECTION 551.071 OF THE TEXAS GOVERNMENT CODE, THIS MEETING MAY BE CONVENED INTO CLOSED EXECUTIVE SESSION FOR THE PURPOSE OF SEE SEEKING CONFIDENTIAL LEGAL ADVICE. THE CITY RESERVES THE RIGHT TO RECESS OR REALIGN ANY SESSION OR CALL EXECUTIVE SESSION OR ORDER OF BUSINESS AT ANY TIME PRIOR TO ADJOURNMENT.

INDIVIDUAL CONSIDERATION, ITEM 4A CONSIDER AND TAKE ACTION ON THE ROWLETT RETAIL PLAZA FINAL PLAT. THE 3.054-ACRE SITE IS LOCATED NORTHEAST OF THE INTERSECTION OF ROWLETT ROAD AND PRIMROSE LANE, IN THE REASON CRIST SURVEY, ABSTRACT NUMBER 225, IN THE CITY OF ROWLETT, DALLAS COUNTY TEXAS.

>> THANK YOU FOR YOUR TIME TODAY, AS YOU JUST READ, WE'RE HERE TO DISCUSS THE ROWLETT RETAIL PLAZA FINAL PLAT. THIS IS APPROXIMATELY 3.5 ACRES AND LOCATED AT THE CORNER OF ROWLETT AND PRIMROSE LANE, JUST SOUTH OF THE FIRE STATION. SO, THE SEASONING IS C-1 FOR LIMITED RETAIL COMMERCIAL, AND THERE'S AN IMPROVED DEVELOPMENT PLAN. LOT TWO, RATHER AN APPROVED DEVELOPMENT PLAN FOR LOT TWO. SO, YOU COULD SEE ON THE GRAPHIC, LOT ONE AND LOT TWO, WHICH IS PART OF TODAY'S SUBDIVISION. AND PLATTING, AND SO, THE ACCESS TO THE SITE WILL OCCUR OFF OF THOSE TWO ARROWS THERE. THERE IS AN ACCESS EASEMENT OFF LOT ONE THAT WILL PROVIDE THE SECONDARY ACCESS FOR LOT TWO AS WELL AS PROVIDE KIND OF FIRE CIRCULATION AND FIRE HYDRANT ACCESS. ACCESS -- SORRY, THE PLAT WILL DEDICATE FIVE FEET OF RIGHT-OF-WAY FOR ROWLETT ROAD AND THAT WILL COMPLETE ON THAT SIDE OF THE ROAD, THE FULL WIDTH OF THE PROPOSED ROWLETT OR FUTURE ROWLETT ROAD. THERE'LL BE NO DEDICATION ON PRIMROSE LANE, AND AS YOU KNOW THERE ARE ADDITIONAL WATER EASEMENTS, UTILITY EASEMENTS THAT WILL BE DEDICATED AND ACCESS EASEMENTS THAT WILL BE DEDICATED WITHIN THAT LOT IN ORDER TO COMPLETE CIRCULATION OF FIRE ACCESS AS WELL AS WATER LOOPS. THE CLOSE-UP OF THE PLAT LOOKS LIKE THIS. YOU SEE THE TWO ACCESS POINTS THERE ON THE BOTTOM LEFT, AS WELL AS THE INTERNAL LEACIRCULATION. THE ACTUAL PLATS LOOKS LIKE THIS.

RECOMMENDATION IS FOR APPROVAL OF THE FINAL PLAT AS ALL TECHNICAL REQUIREMENTS RELATED TO THE ROWLETT CODE AND THE TEXAS GOVERNMENT CODES HAVE BEEN ADDRESSED. I'M HAPPY TO ANSWER

The subject property is located at the northwest corner of Dalrock Road and Schrade Road, and is part of Lot 1, Block 1 Providence Presbyterian Church Addition, in the City of Rowlett, Dallas County, Texas]

ITEM 4B, CONSIDER AND MAKE RECOMMENDATION TO THE CITY COUNCIL ON A QUESTION BY CHRISTOPHER BIGGERS DUNAWAY ASSOCIATES ON BEHALF OF THE PROPERTY OWNER SHAHID IMRAN, FOR APPROVAL OF A TREE REMOVAL PERMIT PLAN FOR AN APPROXIMATELY 66,600 SQUARE-FOOT BUILDING FOR AN ASSISTED LIVING FACILITY ON A 5-ACRE TRACT ZONED LIMITED COMMERCIAL/RETAIL, C-1 DISTRICT.

THE SUBJECT PROPERTY IS LOCATED AT THE NORTHWEST CORNER OF DALROCK ROAD AND SHH RAID ROAD. AND IT'S PART OF THE LOT 1 BLOCK ONE PROVIDENCE PRESBYTERIAN CHURCH ADDITION.

JUST BACKGROUND, ON APRIL 4TH, 2023, PNZ APPROVED THE SITE DEVELOPMENT PLAN FOR APPROXIMATELY 66,000-SQUARE FOOT BUILDING FOR A SENIOR ASSISTED LIVING FACILITY. THE REQUEST HAS BEEN REQUESTED TODAY, IS ESSENTIALLY, UM, THE REMOVAL OF FOUR TREES TO DEVELOP THE SITE AS APPROVED IN THE PREVIOUS SITE PLAN. SECTION 77504 H, THE REMOVAL OF MORE THAN THREE TREES SHALL BE APPROVED BY CITY COUNCIL UPON RECOMMENDATION OF THE PLANNING AND ZONING COMMISSION AND IS THE REASON WHY WE'RE HEARING IT TODAY. SO, ESSENTIALLY, UM, THIS IS A TREE REMOVAL PERMIT, THERE'S TWO ESSENTIALLY, THESE TREES WOULD HAVE TO BE REMOVED SO THAT THEY COULD CARRY OUT THE SITE PLAN AS REQUESTED. THERE'S TWO UP THERE ON THE COURT YARD AS WELL AS THREE AT THE BOTTOM, BUT, OUT OF THOSE, ONLY FOUR ARE PROTECTED.

BUT, ESSENTIALLY FOR THE DRIVEWAY AND FOR THAT BUILDING TO BE BUILT, THOSE WOULD HAVE TO BE REMOVED. AND THREE WOULD BE STAYING ON-SITE TO THE BOTTOM LEFT. SO, ESSENTIALLY, THERE'S INCHES ON SITE FOR THE TREES, THERE'S 99 INCHES AND THERE'S 8 TREES. OUT OF THAT, ONLY SEVEN TREES ARE PROTECTED AND FOR THAT, THE TREES THEY'RE ASKING TO REMOVE WOULD BE 55. WE DO GET A CREDIT FOR INCHES SAVED PER THE TREES THAT ARE THERE WHICH ACCUMULATE TO 36. AND ESSENTIALLY, THEY'RE PLANTING 16 TREES, FOUR CALIPERS EACH, SO THAT WOULD MITIGATE THE OTHER I THINK IT WOULD BE 19 THAT WOULD BE LEFT IF THEY HAD MITIGATED IT THAT WAY. SO, ESSENTIALLY, THE REMAINING INCHES TO BE MITIGATED WOULD BE ZERO. AND THEY'RE NOT LOOKING TO CONTRIBUTE TO THE REFORESTATION FUND BECAUSE THEY'RE REPLACING WITH TREES.

SO, THE PLANNING AND ZONING COMMISSION MAY RECOMMEND THE DENIAL OF THE TREE REMOVAL PERMIT IF THEY DETERMINE THAT THE REMOVAL OF THE TREES ARE NOT RAREED TO CONDUCT RECENT ACTIVITIES OR THE PURPOSES AND THE IS NOT BEING MET BY THE APPLICANT. STAFF RECOMMENDATION IS FOR APPROVAL OF THE TREE
