AND WE HAVE EXITED OUR EXECUTIVE ITEM X INTO A WITH NO CHANGES. WE WILL KNOW MOVE ON TO WORK SESSION ITEM 3A, REQUEST FOR APPOINTMENT OF A SUBCOMMITTEE TO REVIEW AND RECOMMEND REVISIONS OF THE CODE OF ETHICS. AM I GOING TO THE RIGHT ITEM? YES? OKAY, GOTCHA. OKAY.

>> OKAY. THIS IS SOMETHING -- THIS PARTICULAR REQUEST MOVED OUT OF OUR COMMISSION SUBCOMMITTEE DISCUSSIONS. BUT THIS IS SOMETHING THAT I HAVE BEEN ASKING FOR SINCE I GOT ON THE COUNCIL. TO HAVE A REVIEW OF RECOMMENDED REVISIONS FOR THE CODE OF ETHICS BECAUSE IT WAS LAST AMENDED IN 2020 , AND THAT WAS A GOOD AMENDMENT. BUT THERE WERE SOME UNINTENDED CONSEQUENCES WITH THOSE AMENDMENTS, AND THERE WERE SOME REVISIONS THAT WERE BROAD, OR VAGUE, OR OPEN TO INTERPRETATION , AND THE PROCESS IN PARTICULAR FOR ENFORCEMENT THE PERSON WHO IS THE SUBJECT OF A CODE OF ETHICS IS A CITY COUNCILMEMBER IS A LITTLE BIT -- IT PUTS THE COUNCIL THEY ARE AS THE ACCUSER, THE INVESTIGATOR, THE JUDGE, THE JURY, AND ALL IN ONE. THAT MAY NOT BE THE BEST AND FAIREST WAY TO DO THAT. I THINK THAT THE PROCESS IN PARTICULAR REALLY NEEDS TO BE REVIEWED. SO, OUR SUBCOMMITTEE CAME UP WITH SOME RECOMMENDATIONS. THE CODE OF ETHICS IS A PART OF THE COMMISSION'S HANDBOOK THAT WE WERE REVISING . WE THINK THAT IT IS IMPORTANT ENOUGH AND IT IS BIG ENOUGH THAT IT NEEDS TO BE DONE AS A SEPARATE PROJECT.

AND ALSO, THAT THE CODE BE APPLICABLE TO ALL OF THE MEMBERS, AND NOT JUST THE AUTHORS OF THE CITY, WHICH WE THINK THE CITY COUNCIL CAN HANDLE. THAT WOULD BE SOMETHING ELSE FOR THE SUBCOMMITTEE THAT IS BEING REQUESTED TO DISCUSS, AND COME UP WITH A RECOMMENDATION ON.

OBVIOUSLY, I WOULD LIKE TO BE A PART OF THAT, BECAUSE THAT IS SOMETHING THAT I HAVE BEEN INTERESTED IN DOING FOR A VERY

DON'T REMEMBER IT. WAS IT 2020? OH, WOW. YOU KNOW, THE AMENDMENT, AS YOU SEE HERE , OR THE ONE THAT WAS PASSED PREVIOUSLY WAS A COMPROMISE. IT WAS NOT MY INITIAL HOPE IN DEVELOPING A FINAL DRAFTED OR FINAL ADOPTED CODE OF ETHICS .

IN THE MAIN PART OF IT THAT I WASN'T PLEASED WITH, ALTHOUGH IT WAS PART OF THE COMPROMISE , WAS THAT THE COUNCIL, IN EFFECT, IS THE JUDGE AND JURY HERE. AND I THOUGHT THAT THAT PUTS US IN AN UNCOMFORTABLE, UNSUITABLE, UNFAIR POSITION AS MEMBERS OF THE COUNCIL AND THE POLITICAL BODY TO BE TAKING THAT ROLE . THAT IS NOT DONE IN MANY SERIES THAT I HAVE DONE RESEARCH ON BACK THEN, AND THAT IS FOR A GOOD REASON. IT IS FOR THE REASON THAT YOU FAST-FORWARD TO 2022 , AND YOU ALL KNOW WHAT HAPPENED GOOD AND WELL WITH ME. I DON'T LIKE TO USE THE WORD VICTIM, BUT BEING A SUBJECT OF AN ETHICS COMPLAINT THAT WAS BASED UPON FALSE ALLEGATIONS. MY SUGGESTION AS PART OF THIS PROCESS IS THAT WE NOT ONLY LOOK AT THE CODE OF ETHICS HOLISTICALLY, WE GO BACK AND COMPARE AGAIN. I DID THE COMPARISON, GO BACK, COMPARE AGAIN, SEE IF ANYTHING ELSE HAS CHANGED , AND THEN CONSIDER ADOPTING A POLICY THAT IS MORE IN LINE WITH WHAT IS TRADITIONALLY DONE , WHICH IS THAT THE CITY ATTORNEY , THIS IS WHAT I HAVE SEEN. THIS MAY NOT BE THE RIGHT ANSWER. THAT THE CITY ATTORNEY WOULD APPOINT AN OUTSIDE BOARD OR A DIFFERENT INDIVIDUAL TO DO AN INDEPENDENT INVESTIGATION INTO AN ALLEGATION. IF THAT ALLEGATION HAS SUBSTANCE.

ALL RIGHT. THIS IS EXCITING. ANOTHER VETERANS RECOGNITION CEREMONY. SO, TONIGHT, WE CONTINUE THE TRADITION OF HONORING RELICS VETERANS, AND IT WAS INITIATED IN 2017. IT IS A TESTAMENT TO OUR GRATITUDE AND COMMITMENT TO THOSE WHO HAVE SERVED OUR NATION. WE ARE REAFFIRMING OUR COMMUNITY TO REMEMBER, HONOR, AND SUPPORT OUR VETERANS, NOT JUST IN WORDS, BUT IN ACTIONS LIKE THESE THAT HAVE THE DIGNITY, RESPECT, AND GRATITUDE THAT THEY SO DESERVE. IT IS WITH GREAT HONOR THAT WE RECOGNIZE OUR 32ND VETERAN , MR. ANDREW DORCAS, WHO IS A RELIC POLICE OFFICER, AND WHO SERVED AS THE UNITED STATES MARION FROM 1982 THROUGH 1989 WHERE HE WAS HONORABLY DISCHARGED AS A SERGEANT E- FIVE. OUR SELECTION PROCESS COMES WITH A HIGH PRIORITY FOR THOSE INDIVIDUALS WHO SERVE OUR COUNTRY BETWEEN THE 1940S AND 2000. THAT IS OUR HIGH LEVEL.

DORCAS SERVED A TOTAL OF 30 YEARS IN THE MILITARY. 19 YEARS OF ACTIVE DUTY, AND 11 YEARS OF RESERVE DUTY. HE STARTED HIS CAREER WITH THE MARINE CORPS IN 1982 -- THERE YOU GO. FROM 1982 TO 1985, HE WAS TO WESTPAC TO NUMEROUS COUNTRIES IN SOUTHEAST ASIA. FROM 1985 TO 1989, HE WAS STATIONED IN NORTH CAROLINA AS AN AMPHIBIOUS ASSAULT VEHICLE CREW CHIEF. FROM 1985 TO 1989, -- I SAID THAT ALREADY. LET THE MARINE CORPS IN 1989, AND JOINED THE U.S. ARMY IN 1991. FROM 1999 , HE SERVED AS A FORWARD OBSERVER RESPONSIBLE FOR CALLING AIRSTRIKES , NAVAL GUNFIRE ARTILLERY, AND MORE GUN FIRE ON ENEMY POSITIONS. HE SERVED ONE YEAR IN KOREA, AND THEN WAS ASSIGNED TO THE TRAINING CENTERS IN LITTLE ROCK ARKANSAS AS AN OPPOSING FORCE FOR LIFE INFANTRY TACTICS AND TRAINING. THIS WAS AN AIRBORNE INFANTRY REGIMENT TO THE U.S. ARMY. THERE WAS A LOT MORE DETAILS THAT ANDREW GAVE ME THAT I HAD TO CUT AND

PASTE OUT OF HERE, BECAUSE IT IS A LOT. HE DID A LOT FOR OUR COUNTRY. LATER, HE WAS ASSIGNED TO THE TO THE 82ND AIRBORNE DIVISION , AND CONTINUES TO BE A FORWARD OBSERVER. FROM 1996 TO 1999, HE SERVED AS A U.S. ARMY RECRUITER IN SOUTHERN CALIFORNIA. FROM 1999 TO 2014 , MR. DORCAS LEFT THE ARMY INTO THE ARMY RESERVE IS A SPECIAL AGENT FOR THE N86 CRIMINAL INVESTIGATION DIVISION. DURING HIS TIME, HE INVESTIGATED FELONY CRIMES AT THE U.S. ARMY HAD. IN 1999, HE JOINED THE LOS ANGELES POLICE DEPARTMENT, AND BEGAN HIS LAW ENFORCEMENT CAREER. WHILE WORKING FOR THE LAPD, HE WAS ASSIGNED TO PATROL NARCOTICS AND DETECTIVES. HE ALSO SERVED AS A SENIOR DRILL INSTRUCTOR FOR LAPD'S BOOT CAMP PROGRAMS FOR TROUBLED YOUTH. FROM 2003 TO 2005, HE WAS CALLED BACK INTO ACTIVE DUTY, WHERE HE WAS DEPLOYED TO IRAQ FOR THE MAIN MISSION OF OUR UNIT PROTECTIVE SERVICES UNIT. WHILE IN IRAQ, HE CONDUCTED OVER 300 COMBAT MISSIONS TO INCLUDE PROVIDING PROTECTION FOR UNITED NATIONS DELEGATES TO VISIT THE VILLAGES THROUGHOUT IRAQ IN AN ESTABLISHED SET OF ELECTIONS FOR IRAQ. ALSO, ON THIS ASSIGNMENT, HE CONDUCTED HUNDREDS OF DIGNITARY PROTEST DETAILS TO INCLUDE BEING ON THE U.S. SECRETARY OF DEFENSE, PROTECTIVE DETAIL FOR -- LOCAL AND FOREIGN TRAVELS. ALTOGETHER, MR. DORCAS VISITED 32 DIFFERENT COUNTRIES. DURING HIS MILITARY CAREER , HE RECEIVED THE FOLLOWING AWARDS AND METALS . THE SERVICE APPOINTMENT RIBBON FOR FOUR DEPLOYMENTS, GOOD CONDUCT SERVICE MEDAL, THE NATIONAL DEFENSE MEDAL, THE MERITORIOUS SERVICE MEDAL, THE JOINT SERVICE ACCOMMODATION METAL , THE GOLD RECRUITER BADGE , SENIOR PARACHUTIST, THE BRONZE STAR, AND THE, ACTION BADGE. CURRENTLY, MR. DORCAS WORKS FOR THE ROLLA POLICE DEPARTMENT. HE'S ONE OF OUR LOCALS. HE STARTED IN 2017, AND HAS WORKED IN PATROL AS A DETECTIVE. THAT AGREEMENT REQUIRED THE CONSTRUCTION OF A NEW 15 INCH GRAVITY MAIN THAT FOLLOWS COTTONWOOD CREEK DOWN TO THE ENCLAVE . I AM HAVING TROUBLE. THERE WE GO. SO, IT IS THIS SEGMENT RAY HERE. THE ENCLAVE IS HERE. THE ENCLAVE IS AN ET J PROPERTY, BUT IT IS SERVED BY SEWER. THE AGREEMENT ALSO REQUIRES THE UPGRADE OF THE ENCLAVE LIST STATION THAT SERVES THE ENCLAVE , AND AND UPSIZING OF A THREE INCH FORCE MAIN ON LIBERTY GROVE ROAD FROM THE ENCLAVE TO WATERS LANE, AND THEN UPSIZE THIS LITTLE BIT RIGHT HERE THAT IS AN EXISTING 12 INCH. SO, TRAIL CREEK PARTNERS IS REQUESTING AND A PROVEN AGREEMENT THAT BASICALLY, IN GENERAL TERMS, WILL SECURE THE INSTALLATION OF THESE REQUIRED IMPROVEMENTS THAT WILL ENABLE TROPHY PARTNERS TO SUBMIT A FINAL PLAT BEFORE THOSE IMPROVEMENTS ARE COMPLETED . THEY WILL THEN BE ABLE TO PULL BUILDING PERMITS. SO, WE KNOW THE TROPHY PARTNERS IS REQUIRED TO CONSTRUCT THE INFRASTRUCTURE . THE ON-SITE IF THE STRUCTURE IS MOSTLY COMPLETE. PROPERTY MUST BE PLOTTED, BUT A PROPERTY CANNOT BE PLOTTED UNTIL THE PUBLIC AND THE STRUCTURE IS COMPLETED. THEREFORE, TROPHY PARTNERS ARE LOOKING TO SECURE THIS INFRASTRUCTURE. THE FINANCIAL GUARANTEE IN WHICH THEY WILL DO SO ARE TO .2 MILLION ANY REMAINING BALANCE IN THE BONDS, AND THEN ALMOST A $4,000,000.00 PERFORMANCE BOND FOR A TOTAL OF $6,200,000.00 IN GUARANTEED CONSTRUCTION SIDES. THE PHASE ONE ON-SITE IMPROVEMENTS ARE WORTH ABOUT 1.1 MILLION , THE OFF-SITE

THERE IS SOME CAVEATS. AT THE CONSTRUCTION EXCEEDS THE BOND PROCEEDS, THE DEVELOPER REIMBURSES THE CITY . IF THE CONSTRUCTION IS UNDER THE BOND PROCEEDS, WE, AS A CITY, REIMBURSE THE DEVELOPER. OF COURSE, THAT BOND IS RELEASED WITHIN 30 DAYS AFTER COMPLETION. ONE MORE THING .

THE NUMBER OF BUILDING PERMITS IS GOVERNED BY THIS SCHEDULE OF MILESTONES. THE EXISTING INFRASTRUCTURE, PLUS THE 15 INCH GRAVITY AID, WHICH HAS BEEN COMPLETED, WILL GRANT THEM 66 LOTS.
