GENTLEMEN. WELCOME TO THE PLANNING AND ZONING COMMISSION MEETING FOR MARCH 12, 2024. IT'S 7:00.WE HAVE A QUORUM.

AND AS AUTHORIZED BY SECTION 55 1. 0 71 BY THE TEXAS GOVERNMENT BOARD, THIS MORNING AND INTO THE CLOSE'S EXECUTIVE SESSION FOR THE AGENDA ITEM HERE, IN THE CITY OF ROWLETT, RESERVES THE RIGHT TO CALL A EXECUTIVE SESSION OR ORDER OF BUSINESS AT ANY TIME PRIOR TO ADJOURNMENT. THE PROCESS FOR PUBLIC INPUT -- IF YOU ARE NOT ABLE TO ATTEND IN PERSON -- YOU MAY COMPLETE THE CITIZENS INPUT FORM ON THE CITY'S WEBSITE 3:30 P.M. BY THE DAY OF THE MEETING. ALL FORMS WILL BE FORWARDED TO THE PLANNING AND ZONING COMMISSION PRIOR TO THE STARTING OF THE MEETING. Conduct a public hearing and make a recommendation to City Council regarding a request by Alvie Plumlee, regarding a Special Use Permit to allow an enclosed accessory structure with an area greater than 500 square feet on a property zoned Form Based Rural Neighborhood (FB-RN). The property is addressed 8914 Merrit Road. The approximately 1.128 lot is situated northwest of the intersection of Merritt Road and Hickox Road, also described as Plumlee Addition No. 2 in the City of Rowlett, Dallas County, Texas.]

ONTO INDIVIDUAL ITEMS FOR CONSIDERATION, WE HAVE CONDUCT A PUBLIC HEARING AND MAKE A RECOMMENDATION TO THE CITY COUNCIL REGARDING A REQUEST BY ALBIE PLUMLEY REGARDING A SPECIAL USE PERMIT TO ALLOW AN ENCLOSED AND CURSORY STRUCTURE WITH AN AREA GREATER THAN 500 SQUARE FEET ON THE PROPERTY ÚZONE-BASED RURAL NEIGHBORHOOD, FB-RN, THE PROPERTY AT 8914 MERRITT ROAD. APPROXIMATELY 1.120 LOT IS SITUATED NORTHWEST OF THE INTERSECTION OF MERRITT ROAD AND HICKOX ROAD, ALSO DESCRIBED AS PLUMLEE ADDITION NUMBER TWO IN THE CITY RALAT,

DALLAS COUNTY, TEXAS. >> SOME BACKGROUND ON IT, IT IS APPROXIMATELY 1.2 ACRES WIDE, AND IT IS ZONED FOREIGN-BASED ROAD NEIGHBORHOOD. THE REQUEST TONIGHT IS FOR SPECIAL USE PERMIT TO CONSTRUCT AN APPROXIMATELY 2500 SQUARE FOOT DETACHED ENCLOSED ACCESSORY STRUCTURE. LEARNING AND ZONING COMMISSION, AT THEIR OCTOBER 24TH, 2023 MEETING, HAD VOTED TO DISAPPROVE THE SPECIAL USE PERMIT BY BOOK OF 5-1.WHEN YOU GUYS PREVIOUSLY SAW THIS, BOTH OF THE LOTS WERE SPLIT INTO ONE, AND THE ACCESSORY STRUCTURE WITH BASICALLY BEING BUILT ON ONE MORE AND NO LONGER HAD A PRIMARY STRUCTURE. THE APPLICANT HAS NOW GONE AND PLANTED THE PROPERTY, SO THERE IS A PRIMARY STRUCTURE NOW ON THE PLANT. THAT WAS APPROVED JANUARY 24TH, 2024. SO, THE FORM -BASED DOES NOT ONLY ADDRESS THE ACCESSORY STRUCTURES, THEREFORE, THE STANDARDS FOR THE ENROLLMENT CODE SECTION APPLY. IN TERMS OF COVERAGE, FOR THE REAR OF THE MAXIMUM AMOUNT COVERAGE SHALL BE NO MORE GREATER THAN

35%. THE REAR YARD ON THE LOT IS, ESSENTIALLY, 24,000 SQUARE FEET, WHICH 35% OF THAT IS APPROXIMATELY 8400. THIS CENTURY STRUCTURE IS 2500 SQUARE FEET, AND THIS IS JUST UNDER THE 3500 -- 35% MAX LONG COVERAGE. THEN, WE LOOKED AT HEIGHT , THE ACCESSORY STRUCTURE SHALL NOT EXCEED THE HEIGHT OF THE PRIMARY STRUCTURE. THE EXHIBIT PROVIDED BY THE APPLICANT, THERE IS A STRUCTURE THAT IS APPROXIMATE 17-FOOT HIGH, AND THEN A PRIMARY STRUCTURE ON THE SITE THAT WAS SHOWN WITHIN THE ATTACHMENT IS 20-FOOT OFFICE 20 FEET -- AT THE PEAK. IN TERMS OF SETBACKS FOR THE CENTRAL STRUCTURE LOCATED IN THE REAR YARD, REQUIRES A MINIMUM OF THREE-FOOT SETBACK. THE ACCESSORY STRUCTURE IS APPROXIMATELY 6 FEET FROM THE REAR, THE CLOSEST SIDE YARD WOULD BE 24 FEET. PER SECTION 7711 NOT 05, THE ACCESSORY STRUCTURE BUILDING OR ACCESSORY STRUCTURE IS A PERMANENT BUILDING OR STRUCTURE AFFIXED TO THE GROUND SUBORDINATE TO THE PRIMARY STRUCTURE, THE USE OF WHICH IS INCIDENTAL TO THE DOMINANT USE OF THE PRIMARY STRUCTURE ON THE PREMISES, AND THIS WOULD ONLY BE USED, JUST AS A WORK STRUCTURE, AS AN ACCESSORY TO THE MAIN BUILDING, WHICH IS THE RESIDENCE. FOR THE PROPOSED ADOPTED 500-SQUARE-FOOT ACCESSORY AS LARGER THAN THE PRIMARY STRUCTURE, THE PROPOSED USE ITSELF IS MORE INCIDENTAL, AND THE DOMINANT STRUCTURE USE WILL BE FOR RESIDENTIAL. THIS IS IN ADDITION TO THE ACCESSORY STRUCTURE MEETING THE 35-SQUARE-FOOT MAXIMUM ALLOWED COVERAGE, HEIGHT, AND SETBACK REQUIREMENTS ON TOP OF THAT. RURAL NEIGHBORHOOD DISTRICT IS INTENDED FOR A STATE HOME , FARMHOUSE, AGRICULTURAL BUILDINGS, AND FOR THE ABOVE-MENTIONED REASON, THE ACCESSORY STRUCTURE DOES NOT HAVE SIGNIFICANT IMPACT ON THE SURROUNDING EXISTING FABRIC OF THE NEIGHBORHOOD CHARACTER. SO, WE DID NOTIFY -- WE DID 12 NOTICES WITHIN 200 SQUARE FEET, AND WITHIN THE 500, THERE WAS 14 NOTICES . WE DID NOT RECEIVE ANY BACK BY MAIL. WE HAVE RECEIVED, THROUGH CITIZENS' INPUT, 1 IN OPPOSITION TODAY.

SO, IT IS STAFF RECOMMENDATION FOR THE APPROVAL FOR THE SOP TO INCLUDE THE ADOPTED 500-SQUARE-FOOT ACCESSORY STRUCTURE DUE TO THE PRIMARY STRUCTURE HAVING A LOWER OR LESSER IMPORTANCE THAN THE PRIMARY STRUCTURE. AND BECAUSE IT DOES MEET THE RDC STANDARDS THE MAXIMUM OF 35% REAR-YARD CONDITION, THE HEIGHT, AND THE SETBACK REQUIREMENTS FOR THE YARD ITSELF.
