RESIDENCE.. >> I AM SHIRLEY ARROW. I LIVE AT 3101 MARKIN LANE HERE IN ROWLETT AND I AM A MEMBER AT THE RECREATIONAL CENTER. I HAVE SPOKEN TO THE DIRECTOR OF THE RECREATIONAL CENTER AND OTHER EMPLOYEES. I AM HERE DUE TO THE FACT THAT ROWLETT IS CONSIDERED AN AARP FRIENDLY SOCIETY. IT MEANS THAT THEY ARE FRIENDLY TO THEIR SENIOR CITIZENS. MANY OF THE SENIOR CITIZENS THAT ARE PART OF THE RECREATIONAL CENTER ARE ON A LIMITED BUDGET WHICH MEANS THAT SOME OF THE FEES THAT HAVE BEEN IMPLEMENTED AT THE REC CENTER ARE A LITTLE BIT MUCH. IF YOU WILL NOTICE, THERE ARE CLASSES THAT HAVE MONTHLY FEES OF $16 OR $20. THESE CLASSES ARE CLASSES THAT ARE NOT ALWAYS ABLE TO BE ATTENDED FOR WHATEVER PERSONAL REASONS.

IF THEY ARE NOT ABLE TO ATTEND, THEY ARE LOSING MONEY. ALSO THE FACT THAT IF THEY WANTED TO GO TO TWO CLASSES BY THE END OF THE YEAR, BY THE MONTHLY FEES, THEY WOULD BE PAYING OUT $432 A YEAR FOR SOMEBODY THAT IS ON A FIXED INCOME. I AM STILL WORKING WHICH, I AM STILL ELIGIBLE FOR THE SENIOR DISCOUNTS AND STUFF LIKE THAT BUT I AM THINKING OF THE WOMEN AND THE MEN THAT GO TO THE PARKS DEPARTMENT RECREATIONAL CENTER THAT ARE DEPENDENT ON THE ACTIVITIES. THERE WAS YOGA.

THERE IS A LOT OF PEOPLE IN YOGA THAT HAVE PHYSICAL DISABILITIES AND DEPEND ON THE ACTIVITIES AND THE FRIENDSHIPS THAT THEY DEVELOP, THAT THESE FEES ARE A HARDSHIP. I AM HOPING THAT SOMEONE WILL FIND A BETTER WAY OF ACCRUING -- I KNOW THEY WANT A MONTHLY INCOME AND YOU CAN'T BLAME THEM. THE WORLD IS GETTING MORE EXPENSIVE BUT THERE HAS TO BE A BETTER WAY OF ALLOWING TO BUDGET THE MONIES THAT ARE NEEDED FOR THE RECREATIONAL CENTER. THEY COULD RAISE THE PRICE OF THE YEARLY FEE. THAT WAY YOU COULD BUDGET $35, $40. IT IS FAIRLY LOW RIGHT NOW. OR, THEY COULD USE THE PUNCHCARDS THAT WE ARE USED USING WHICH MEANS IT IS AS YOU NEED, AS YOU GO. JUST RAISED THE PRICE ON THAT AND THAT WAY THEY'RE NOT LOSING MONEY WITH THE PUNCHCARDS. THEY ARE STILL USING THE MONEY BUT THEY'RE USING IT WHEN THEY ARE ABLE TO. I AM JUST ASKING FOR SOMEONE TO HELP THEM LOOK AT A MONTHLY BUDGET THAT IS NOT SUCH A HARDSHIP FOR THE PEOPLE THAT ARE ON A FIXED INCOME. THAT IS THE GIST OF THE REASON WHY I AM HERE.

THE GREATEST THING, I THINK IT ELIMINATES WHEN YOU PULL PUNCHCARDS, IS THE FLEXIBILITY OF SCHEDULING THAT SENIORS NEED. THEY HAVE DOCTORS APPOINTMENTS. THEY MAY NEED TO GO VISIT THEIR GRANDCHILDREN. IT IS MISCELLANEOUS ITEMS THAT THEY NEED FOR FLEXIBILITY. I CAN UNDERSTAND THAT BUDGETING IS AN ISSUE AND THERE ARE RESOURCES THAT ARE USED. THERE IS A SWEET LADY THAT HAS BEEN TEACHING FOR A NUMBER OF YEARS BUT THERE ARE OTHER ACTIVITIES AT THE REC CENTER THAT ALSO REQUIRE RESOURCES, BE IT GLOBAL BALLS OR THIS ADDITIONAL CUSTODIAL SERVICES. THERE ARE MANY OTHER EXPENSES. WHILE IT IS EASY TO JUDGE THE COST OF THE TEACHER IS THIS MUCH, ALL OF THE OTHER RESOURCES AT THE OTHER ACTIVITIES -- I THINK THERE NEEDS TO BE A PROPER ACCOUNTING TO SEE THAT THERE IS SOME LEVEL HERE AND THE REMOVAL OF THE PUNCHCARD IS REALLY -- IT JUST PULLS AWAY SO MUCH OF THE SENIORS' ABILITY TO MAKE DECISIONS. I THINK IT IS JUST -- WHY NOT CHARGE ALL THE ACTIVITIES BY PUNCHCARDS? BY HAVING A DAILY FEE, WHICH THEY SAY IF YOU DON'T DO THE MONTHLY FEE FOR THE ACTIVITY, THEY CAN CHARGE YOU A DAILY FEE FOR THAT ACTIVITY BECAUSE YOU HAVE TO HAVE THE BEGINNING OF THE MONTH THROUGH THE END OF THE MONTH TO SCHEDULE THAT MONTH AND YOU MAY NOT KNOW WHAT THAT MONTH IS. THE OTHER ACTIVITIES DON'T HAVE THAT. IF YOU ARE DOING IT FOR THIS ONE PARTICULAR, THE YOGA, THEN DO IT FOR ALL THE ACTIVITIES MAKE -- ACTIVITIES. MAKE ALL OF THE ACTIVITIES EQUITABLE. THAT IS IT.

USING THE TEXAS COMPTROLLER TAX RATE CALCULATION WORKSHEET AND THE JULY 24 CERTIFIED VALUES THAT ARE PROVIDED, THE FISCAL YEAR 25 RATES ARE CALCULATED BY DALLAS COUNTY THIS YEAR ON JULY 30 AND SUBMITTED TO CITY STAFF. TONIGHT, WITH THOSE RATES IN MIND, COUNCIL WILL VOTE TO SET THE PROPOSED RATE TO PUBLISH FOR THE TAX RATE HEARING PURPOSE OF THIS PROPOSED TAX RATE IS TO PROVIDE A CEILING, OR THE MAXIMUM RATE THAT THE COUNCIL WILL FOR THE FISCAL YEAR. COUNCIL IS NOT ADOPTING THE ACTUAL TAX RATE TONIGHT AND IS NOT REQUIRED TO EVEN ADOPT THIS TAX RATE THAT YOU ARE SETTING AS THE PROPOSED RATE FOR FISCAL YEAR 2025. THIS IS ONLY FOR PUBLICATION AND FOR A LIMITATION PURPOSE FOR THE REMAINDER OF THE BUDGET DISCUSSIONS FROM NOW UNTIL WE ADOPT THE BUDGET LATER ON IN SEPTEMBER. LEE, WE WILL END THE PROCESS WITH A TAX RATE HEARING, A REGULAR COUNCIL MEETING ON TUESDAY, SEPTEMBER 17 AND THEN ADOPT FISCAL YEAR 2025 TAX RATE AT A SPECIAL COUNCIL MEETING ON WEDNESDAY, SEPTEMBER 18. HERE ARE SOME OPTIONS FOR THE PROPOSED TAX RATE AS SHOWN IN THE SECOND COLUMN. FISCAL YEAR 25 CITY MANAGER'S PROPOSED BUDGET TO BE PRESENTED NEXT WEDNESDAY HAS BEEN PREPARED WITH A TAX RATE OF 76.9691. AS A COMBINATION OF COUNCIL BUDGET DISCUSSIONS ON JUNE 17 AND JULY 15 AND SUBSEQUENT CERTIFIED VALUES THAT WERE RELEASED BY THE CENTRAL DISTRICT'S. THIS RATE MAINTAINS THE CURRENT RATE OF 53.134 AND IT INCREASES THE RATE TO 2023.850 WHICH WAS APPROVED BY VOTERS IN THE 2023 ELECTION. THEN NO NEW REVENUE TAX RATE SHOWN IN THE THIRD COLUMN IS A CALCULATED RATE THAT WOULD PROVIDE THE CITY WITH APPROXIMATELY THE SAME AMOUNT OF REVENUE IT RECEIVES IN THE YEAR BEFORE ON THE SAME PROPERTIES THAT WERE TAXED ON BOTH YEARS. IF PRETTY VALUES ARISE, THEN THE NO NEW REVENUE TAX RATE WILL GO DOWN AND VICE VERSA. THIS RATE IS CALCULATED BY DALLAS COUNTY AT A TOTAL OF 69.2442. THEN, FINALLY, THE VOTER APPROVAL RATE SHOWN IN THE LAST COLUMN PROVIDES A TAXING UNIT WITH APPROXIMATELY THE SAME AMOUNT OF TAX REVENUE IT SPENT THE PREVIOUS YEAR PER DAY TO DAY OPERATIONS PLUS A 3.5% INCREASE FOR THOSE OPERATIONS IN ADDITION TO THE UNUSED INCREMENT RATE AND SUFFICIENT FUNDS TO PAY DEBT SERVICE IN THE COMING YEAR. THE VOTER APPROVAL RATE ALSO REPRESENTS THE MAXIMUM RATE THAT THE COUNCIL CAN ADOPT WITHOUT BEING SUBJECT TO AN AUTOMATIC ELECTION IN NOVEMBER AT THE UNIFORM ELECTION DATE. THIS RATE IS CALCULATED BY DALLAS COUNTY AT A TOTAL OF 77.7. TONIGHT, STAFF IS RECOMMENDING APPROVING AND PUBLISHING THE VOTER APPROVAL RATE OF .778612 AS THE PROPOSED TAX RATE WHICH IS COMPRISED OF AN OPERATIONS AND MAINTENANCE TAX RATE OF .50262 AND A DEBT SERVICE OR AN INS TAX SERVICE RATE OF .238350 PER $100 OF TAXABLE VALUE. THIS WILL ALSO ALLOW COUNCIL THE OPTION TO ADOPT UP TO THAT RATE ON A SEPTEMBER 18 IF DESIRED . >> MAYOR, COUNCIL, THANK YOU FOR HAVING ME HERE TONIGHT. I HOPE THAT THIS MEETS EVERYTHING YOU HAVE BEEN EXPECTING. THIS HAS BEEN A LONG TIME COMING. WE ARE HERE TO TALK ABOUT AN UPDATE TO THE ORDINANCE REGARDING TEMPORARY BATCH PLANTS IN THE CITY. THIS BEGAN AT A WORK SESSION IN OCTOBER OF LAST YEAR WHERE THERE WAS SOME DISCUSSION ABOUT AMENDING THE PROCESS IN A WAY THAT COULD GRANT A LITTLE MORE SCRUTINY OR DISCRETION, WHETHER THAT BE STAFF OR COUNCIL LEVEL. THE DIRECTION FROM THAT MEETING WAS TO MAKE SOME AMENDMENTS TO THE ORDINANCE TO THE TEMPORARY USE PERMIT PROCESS. I AM GOING TO TALK THROUGH THOSE CHANGES AND MAKE SURE YOU UNDERSTAND THE ORDINANCE AND MAKE SURE WE HAVE UNDERSTOOD YOUR DIRECTION SO WE DON'T HAVE TO MAKE ADDITIONAL CHANGES. THE CURRENT REGULATIONS IN PLACE RIGHT NOW ALLOW FOR -- REQUIRE STAFF APPROVAL FOR ANY TEMPORARY BATCH PLANTS THAT ARE APPLIED FOR THAT HER OVER 300 FEET FROM ANY OCCUPIED RESIDENCE. THAT IS WHAT IS ON THE BOOKS NOW. GOES FOR STAFF FOR REVIEW AND APPROVAL AND THERE IS NO TRIGGER FOR ANY MECHANISM BY WHICH THEY WOULD COME TO COUNCIL AT ANY DISTANCE FROM HER RESIDENCE. THE PROPOSED CHANGES INCLUDE ONLY ALLOWING STAFF APPROVAL FOR THOSE WHICH ARE 2000 FEET OR MORE FROM AN OCCUPIED RESIDENCE. IF IT IS OVER 2000 FEET, THEN STAFF WOULD GO THROUGH THE SAME PROCESS TODAY AND REVIEWING THE APPLICATION AND APPROVING IT IF THEY BELIEVE EVERYTHING IS MET.

WE DO HAVE ONE ADDITIONAL CHANGE THAT WE ADDED IN BASED ON THE FEEDBACK THAT I HEARD AT THE MEETING IN OCTOBER WHICH WAS RELATED SPECIFICALLY TO THE DUST MITIGATION AND SOME ADDITIONAL STORMWATER PREVENTION PRACTICES. IT SEEMED LIKE THERE WAS CONCERN THAT ANYTHING UNDER ONE ACRE WOULD NOT BE REQUIRING THAT. THIS WOULD ALLOW FOR US TO REQUIRE THAT WITH THE APPLICATION PROCESS REGARDLESS OF THE SIZE OF THE SITE AND WE WOULD GO THROUGH A FULL INTERNAL REVIEW ON THESE TO MAKE SURE EVERY THING IS COMPLIANT. FOR THOSE THAT ARE APPLIED FOR THAT ARE UNDER 2000 FEET BUT OVER 500 FEET, THOSE WOULD AUTOMATICALLY BE REVIEWED BY STAFF AND PRESENTED TO COUNCIL. THIS IS WHAT WE BELIEVE WE HEARD FROM THAT OCTOBER MEETING THAT YOU WANT PERMIT APPLICATIONS TO COME BEFORE YOU SO THAT YOU CAN HEAR FROM THE PUBLIC, NOTIFY THOSE WITHIN THE AREA AND MAKE SURE YOU HAD ALL OF THE FACTS ON THE TABLE BEFORE MAKING DECISIONS. THERE MAY BE SOME

DISCUSSIONS ON WHICH SITE MIGHT BE THE BEST LOCATION AND ANY OTHER SPECIFIC THINGS OR REGULATIONS OR MODIFICATIONS THAT YOU MIGHT HAVE ON THE APPLICATION BEFORE YOU APPROVE IT. IT GIVES YOU MORE DISCRETIONARY AUTHORITY. IF YOU NOTICE HERE, THIS ALSO SAYS OVER 500 FEET. UNDER 500 FEET IS A LITTLE BIT DIFFERENT THAN THE CURRENT ORDINANCE. RIGHT NOW, WE DON'T ALLOW THEM WITHIN 300 FEET. THIS WOULD RAISE IT TO 500. THAT WAS A PRETTY CLEAR DIRECTION IN THE MEETING THAT YOU WANTED TO RAISE THAT INITIAL BUFFER AREA TO TRY TO LIMIT THOSE THAT ARE PROPOSED WITHIN THE 500TH THE DISTANCE OF RESIDENCES. WE HAVE TALKED ABOUT IT INTERNALLY A LITTLE BIT AND WE FEEL THERE MAY BE SOME INSTANCES WHERE IT MIGHT BE THE BEST OPTION WITHIN 500 FEET. WE WANTED TO MAKE SURE THERE WAS AN ABILITY TO CONSIDER THAT AND YOU HAVEN'T WRITTEN YOURSELF OUT OF THE ABILITY TO GRANT THAT. WHILE THE ORDINANCE IS WRITTEN NOT TO ALLOW THE TEMPORARY BATCH IS WITHIN 500 FEET OF ANY OCCUPIED RESIDENCE, THE PROCESS WOULD STILL ALLOW FOR SOMEBODY TO APPLY FOR THAT BATCH PLANT.

STAFF WOULD DENY IT AS WE ARE REQUIRED TO BUY ORDINANCE BECAUSE IT IS NEAR 500 FEET BUT THEN THEY WOULD HAVE THE PROCESS OF BEING ABLE TO APPEAL IT AND THE APPEAL WOULD COME DIRECTLY TO YOU. THE APPEAL WOULD STILL GIVE YOU THAT ABILITY TO MAKE THAT DECISION. IT WOULD DISCOURAGE THEM WITHIN 500 FEET, WHICH IS THE INTENT BUT IT WOULD ALLOW YOU THE ROOM FOR DISCRETION TO ALLOW THEM UNDER HUNDRED FEET. LET ME GO BACK A SLIDE HERE. ANY OF THEM THAT ARE UNDER 2000 FEET, WE WOULD FOLLOW THE ZONING NOTICES FOR PUBLIC HEARING. THE NOTICES WOULD GO TO THOSE WITHIN THE 200 BUT COURTESY AREA JUST LIKE WE DO FOR ALL OF OUR OTHER ZONING NOTICES. FOR THOSE THAT ARE OVER 500 FEET FROM A RESIDENCE, I DON'T ANTICIPATE YOU WILL HAVE A LOT OF PEOPLE THAT COME OUT TO THOSE PUBLIC HEARINGS. WE SEE PUBLIC HEARINGS FOR SENDING NOTICES BECAUSE THEY ARE RESIDENTS CONCERNED ABOUT THE IMPACT. WE WILL FOLLOW THAT PROCESS AND NOTIFY EVERYBODY, WHETHER IT IS A BUSINESS AREA OR WHATEVER IT MIGHT BE BUT I DON'T ANTICIPATE A LOT OF FEEDBACK FROM THOSE. ARE THOSE THAT ARE UNDER 500 FEET FROM A RESIDENCE, WE KNOW THAT WE WILL HAVE RESIDENTS WHO WILL BE IMPACTED BY DISPATCH PLANT IN THE AREA THAT WILL RECEIVE THE NOTICE. THIS HAS A COMPANION ITEM WHICH IS THE FEE SCHEDULE AMENDMENT RELATED TO TEMPORARY BATCH PLANTS. THIS IS JUST EXPLAINING THE PROPOSAL FOR THE NEW FEE STRUCTURE. ALL OF THEM ARE CURRENTLY $350 AND IT WOULD GIVE IT SOMEONE OF A GRADUATED APPROACH. THOSE THAT ARE APPROVED BY STAFF WOULD BE $350 AND WE WOULD RAISE IT UP TO $1000 FOR THOSE THAT ARE APPROVED BY COUNCIL DIRECTLY.

THAT IS JUST DUE TO THE ADDITIONAL WORK AND NOTICING REQUIREMENTS FOR THOSE AND THEN, A LITTLE BIT HIGHER FOR THOSE THAT ARE UNDER 500 FEET THAT MIGHT APPEAL TO YOU. THAT IS BECAUSE WE KNOW THE TIME IT TAKES TO DEAL WITH THE RESIDENTS AND EXPLAINING TO THEM THE STEPS OF THE PROCESS AND HOW THEY CAN MAKE SURE THEY COMMUNICATE TO YOU.
