THE ELECTION YOU MADE TWO COMMENTS THAT I WANT TO PUT ON THE PUBLIC RECORD. NUMBER ONE, YOU WOULD NOT BRING BACK THE DEI COMMITTEE AND NUMBER TWO YOU WOULD NOT PUT TRAILS BEHIND THE TAKE AREA OF ANY LAKEFRONT PROPERTY SO I WANT THAT ON THE PUBLIC RECORD GIVEN I AM HERE MAKING THESE STATEMENTS. NUMBER THREE TODAY I VOTED AND THERE WAS AN ELECTION IRREGULARITY I WANTED TO BRING TO YOUR ATTENTION. IN THIS CASE SF-40 DISTRICT DOES NOT HAVE LOT COVERAGE REQUIREMENTS OF THE CODE TELLS US TO LOOK BACK AT THE REAR LOT AREA AND APPLY THE SAME CONCEPT. BASED ON CALCULATIONS PROVIDED BY THE APPLICANT WE CONCLUDED IT MEETS THE 35% THRESHOLD FOR THE REAR LOT COVERAGE. I WANT TO POINT OUT DURING MY PRESENTATION TO THE PLANNING AND ZONING COMMISSION I DID NOT NOTICE PART OF THE EXISTING DRIVEWAY COVERED PART OF THE REAR LOT SO I ADDED THAT TO TOTAL CALCULATION AND IT STILL FALLS WITHIN 35% THRESHOLD. SO THE HEIGHT REQUIREMENTS , THE APPLICATION PROVIDED TO US STILL MEETS REQUIREMENT OF THE PRIMARY STRUCTURE BEING TALLER THAN THE PROPOSED ACCESSORY STRUCTURE. IN TERMS OF SETBACK THE SAME THING, THE APPLICANT MEETS THE REQUIREMENTS OF A THREE FOOT SETBACK REQUIREMENT FROM THE REAR END THE SITE AND I HIGHLIGHT SPECIFICS OF MY PRESENTATION. IN ADDITION TO THE EIGHT FEET FROM THE PRIMARY STRUCTURE. THE CODE ALSO TELLS US ANY TYPE OF ACCESSORY USE IS INCIDENTAL TO PRIMARY YEARS AND IN THIS CASE THE APPLICANT IS USING IT TO STORE ANTIQUE VEHICLE A PERSONAL WORKSHOP AND STORAGE OF HOUSEHOLD GOODS. WE DID SEND NOTICES WITHIN 200 TO 500 FOOT AND RECEIVED TWO IN FAVOR IN TWO IN FAVOR WITHIN 200 AND 500 BUFFER. PLANNING AND ZONING COMMISSION AT THE MAY 27 MEETING DID RECOMMEND APPROVAL OF THE ITEM 7-0 AND TODAY YOU AS THE APPROVING BODY GET TO PROVE WITH CONDITIONS OR DENY A REQUEST.
