WHICH IS DISCUSS RECOMMENDED GUIDELINES RELATED TO THE HANDLING OF PUBLIC INFORMATION.

SINCE THAT TIME WE MET A FEW INSTANCES WITH A GROUP OF FOLKS HAVE BEEN TALKING ABOUT VARIOUS ASPECTS OF A POTENTIAL POLICY. TONIGHT, WE WANTED TO GO OVER THE ESSENTIALS OF DATA PROVIDE YOU THE OPPORTUNITY TO HAVE A DISCUSSION REMARK -- REGARDING THE MAIN FEATURES OF A PROPOSED POLICY THAT IS CENTERED ON -- YOU WILL SEE A SLIDE -- TALKING ABOUT THE SCOPE OF THE POLICY BUT IT'S FOCUSED ON THE OFFICERS, THOSE DEFINED AS OFFICERS IN CHAPTER 552 WHICH ARE CITY COUNCIL MEMBERS AND MEMBERS OF THE PLANNING AND ZONING COMMISSION AND THE BOARD

SO JUST A LITTLE BIT OF BACKDROP. I WILL GO OVER A LOT OF INFORMATION.

JUST TO BRING EVERYBODY UP TO SPEED, SOME OF THE CHANGES THAT TOOK EFFECT IN CHAPTER 552, WHICH IS THE PUBLIC INFORMATION ACT WERE BROUGHT ABOUT THE PASSAGE OF SENATE BILL 944 IN THIS LAST LEGISLATIVE SESSION. THOSE CHANGES BECAME EFFECTIVE ON SEPTEMBER 1 OF THIS YEAR, 2019. WE WANTED TO MAKE SURE THAT WE HAD SOMETHING IN PLACE SOON AFTER THAT. THE GOAL WAS TO GET SOMETHING IN PLACE TO COINCIDE WITH SEPTEMBER 1 AND FOR LARGE MEASURE WITH RESPECT TO HOW PEOPLE ARE USING THIS.

>>> THE IMPORTANT THING IS IS THAT THE LAWS THEY ARE AND INDIVIDUALS ARE COMPLYING WITH THE LAW. BUT THE POLICY IS GOING TO PUT SOME KIND OF POLICY STATEMENT INTO EFFECT IN THE PROVIDE SOME GUIDANCE ON SOME OTHER THINGS THAT WE WILL TALK ABOUT AS WE GO IN. THERE'S A LONG DEFINITION OF WHAT PUBLIC INFORMATION IS THAT WHAT WE WANTED TO DO WAS PROVIDE SOME DEFINITIONS AND

AS CITY COUNCIL MEMBERS YOU ARE GETTING INPUT FROM ALL OVER THE PLACE AND YOU ARE GETTING IT THROUGH MULTIPLE CHANNELS.

THIS IS DESIGNED TO GIVE YOU GUIDANCE ABOUT THE VARIOUS CHANNELS AND THOUSAND HANDLE THE PUBLIC INFORMATION AS YOU INTERACT WITH PEOPLE THROUGH THOSE CHANNELS.

AT A HIGH LEVEL I'VE TRIED TO CONDENSE WHAT THE 7 PAGES YOU HAVE IN THE DOCUMENT SAY. AND REALLY WHAT WE'RE TRYING TO DO IS GUIDE AWE WAY FROM USING PERSONAL ACCOUNTS TO HANDLE PUBLIC INFORMATION. THAT'S REALLY I THINK THE BOTTOM LINE. HOW DO WE DO THAT EFFECTIVELY IS WHERE EACH OF THESE SUCCESSIVE POINTS COMES FROM.

BUT THE REAL ISSUE MAKING SURE THAT WE TRY TO DISSUADE YOU FROM USING PERSONAL ACCOUNTS TO HANDLE THAT INFORMATION.

FOR THOSE OF YOU GETTING ONLY EMAILS TO OR TEXT OR VOICE MESSAGES, YOU CAN EASILY DISTINGUISH BETWEEN A PERSONAL NUMBER, AN ACCOUNT VERSUS AN OFFICIAL NUMBER.

SO TO THE EXTENT YOU ARE RECEIVING EMAILS, TEXTS AND VOICE MESSAGES, WE CAN SAY THAT THOSE THAT ARE OFFICIAL GO INTO THE OFFICIAL BUCKET AND THOSE THAT ARE PERSONAL GO INTO THE PERSONAL BUCKET. DIVIDING THE PERSONAL ACCOUNTS AND THE OFFICIAL ACCOUNTS IS FAIRLY EASY TO DO.

IT GETS WAY MUDDIER AND A LITTLE MORE COMPLEX WHEN YOU START TALK ABOUT THINGS LIKE SOCIAL MEDIA, THE PREVALENCE OF THE NUMBER OF PLATFORMS , THE TYPES OF COMMUNICATION THAT HAPPEN ACROSS THOSE PLATFORMS, HOW THEY ARE TO BE PRESERVED AND TRANSFERRED IN THE EVENT THAT THEY DEAL WITH PUBLIC INFORMATION, THOSE KINDS OF THINGS. AND SO AS YOU GO DOWN THIS, THESE ITEMS ON THIS SLIDE, WHAT YOU'LL FIND IN THE POLICY, ONE OF THE GUIDE PIECES OF GUIDANCE THAT WE WANTED TO DISCUSS THIS EVENING IS FOR THOSE THAT PREFER TO HANDLE PUBLIC INFORMATION ON SOCIAL MEDIA PLATFORMS THAT HAS BECOME A NORMAL WAY FOR A LOT OF PEOPLE TO COMMUNICATE. SO IF YOU CHOOSE TO DO THAT, THE POLICY ISN'T SAYING YOU MUST OR YOU SHOULDN'T, IF YOU CHOOSE TO DO THAT, WE WOULD PREFER THAT YOU DO THAT ON THE PLATFORMS THAT THE CITY PRESENTLY ARCHIVES.

AND FOR THIS PURPOSE THOSE ARE FACEBOOK, TWITTER, INSTAGRAM, PINTEREST, FLICKER, YOUTUBE AND VINIO.

THOSE ARE PLATFORMS WE HAVE SOFTWARE CURRENTLY ARCHIVES THOSE PLATFORMS. IF YOU HANDLE PUBLIC INFORMATION ON ONE OF THOSE, WE SUGGEST YOU CREATE AN OFFICIAL ACCOUNT.

>> IT'S A POLICY MUST CREATE AN OFFICIAL ACCOUNT.

AT PRESENT WE HAVE THOSE 7 ARCHIVED. THERE WILL BE TIMES FOR WHATEVER REASON, WHETHER LIKE SOMETIMES WE TALKED ABOUT THIS QUITE A BIT WHERE YOU HAVE MULTIPLE EMAILS ON A DEVICE AND YOU CHOOSE THE WRONG ONE AND SEND OUT AN EMAIL FROM YOUR PERSONAL ACCOUNT AND YOU MEANT TO DO IT FROM YOUR OFFICIAL ACCOUNT.

IF THOSE INSTANCES HAPPEN , THE STATE LAW COMES INTO PLAY AND REQUIRES YOU A TEMPORARY CUSTODIAN TO PRESERVE THAT

WE STILL WOULD -- THE GUIDANCE WOULD BE THAT YOU MUST CREATE AN OFFICIAL ACCOUNT TO USE THOSE. THE ISSUE THEN IS HOW DOES THAT INFORMATION BECOME PRESERVED AND TRANSFERRED BECAUSE THERE IS NO ARCHIVE MECHANISM THAT THE CITY MANAGES.

AND SO WE FALL BACK ON THAT THE INDIVIDUAL IS RESPONSIBLE AS THE TEMPORARY CUSTODIAN AND SO YOU ARE EITHER HAVING TO ARCHIVE IN BULK AND TRANSFER OR ON A MESSAGE BY MESSAGE BASIS YOU ARE BACK AT THE IMAGE SCREEN CAPTURE EMAIL YOUR ACCOUNT NOTE GET THOSE RECORDS INTO THE HANDS OF THE PERMANENT CUSTODIAN.

THERE ARE TONS OF SOCIAL MEDIA PLATFORMS OUT THERE THAT WE'VE NOT EVEN DISCUSSED. AND THERE WILL BE MORE IN THE FUTURE AS THIS CONTINUES TO EVOLVE AND SOME OF THESE WILL LIKELY FALL OFF AND BE REPLACED BY OTHERS.

THAT ENCOMPASSES CITY COUNCIL, ZONING AND THE BOARD OF ADJUSTMENT. THE OTHER BOARDS ARE ADVISORY IN NATURE SO THEY ARE NOT COVERED BY THESE REQUIREMENTS ALTHOUGH IF THEY CHOOSE TO FOLLOW THEM, THEY ARE GOING TO PROTECT

AND SO WHEN YOU TAKE SOCIAL MEDIA OUT OF THE QUESTION , THE NUMBER OF THINGS YOU HAVE TO COVER SHRINKS BACK DOWN TO ESSENTIALLY VOICE MESSAGES, EMAILS AND POSSIBLY TEXT.
