BACKGROUND INFORMATION ON THIS ITEM, THE EXISTING BUILDING RIGHT NOW IS AROUND 6600 SQUARE FOOT OF A COMMERCIAL BUILDING DIVIDED INTO FIVE TENANT SPACES. THE SUITE IN QUESTION IS 104 WHEN THE APPLICANT IS PROPOSING A MASSAGE ESTABLISHMENT WHICH WILL INCLUDE THREE TO FIVE TREATMENT ROOMS, RESTROOM, LAUNDRY AREA, AND A STORAGE ROOM AND THE PROPOSED HOURS OF OPERATION ARE FROM 10:00 A.M. TO 9:00 P.M. ASIDE FROM THE REGULATIONS WITHIN THE ROWLETT DEVELOPMENT CODE, THE APPLICANT NEEDS TO ABIDE BY ANY OF -- NEEDS TO COMPLY WITH CHAPTER 10, ARTICLE 5 OF THE ROWLETT CODE OF ORDINANCES WHICH SPECIFICALLY TALK ABOUT HOW WE REGULATE MASSAGE ESTABLISHMENT . IN ADDITION, THE STATE LICENSING REQUIREMENTS THE APPLICANT WILL ALSO NEED TO FOLLOW. I WANTED TO SHARE SOME SITE CONDITIONS, THIS IS HOW THE SITE LOOKS LIKE TODAY WITH THE FIVE TENANT USES RIGHT NOW, THE ONLY VACANT IS 104 WHICH IS TRYING TO OPERATE AS A MASSAGE ESTABLISHMENT. THE FUTURE LAND USE FOR THIS AREA IS DESIGNATED AS RETAIL-COMMERCIAL OFFICE, DRE ENVISIONS COMMERCIAL ESTABLISHMENTS THAT PROVIDE GOODS AND SERVICES, TYPICALLY ALONG A MAJOR THOROUGHFARE LIKE LAKEVIEW PARKWAY AND SERVING RESIDENTIAL AREAS . THE ALLOWED USE AS YOU WOULD SEE IN THIS CLASSIFICATION IS SINGLE AND MULTITENANT BUILDINGS , RETAIL STORES, RESTAURANTS, SPECIALTY SHOPS, SALONS, AND OFFICES, A PERSONAL SERVICE SUCH AS A MASSAGE ESTABLISHMENT OPERATION IS USUALLY CONSIDERED WITHIN THIS LAND-USE DESIGNATION AS A SECONDARY USE TO THE PRIMARY USE WHICH IS THAT RETAIL COMPONENT.

AGAIN, AS I MENTIONED, THE ZONING IS PD WITH A PLAN DEVELOPMENT WITH A BASE ZONING OF C-2, THAT C-2 USUALLY ACCOMMODATES PRIMARILY RETAIL AS A SECONDARY USE, YOU WOULD SEE OFFICES AND THINGS OF PERSONAL SERVICE SUCH AS A MASSAGE ESTABLISHMENT . FOR CONSIDERATION TONIGHT AND WHY THIS IS IN FRONT OF YOU, WHEN WE LOOK AT THE TABLE OF ALLOWED USES, IT TOLD US THAT ANY MASSAGE ESTABLISHMENT WITHIN THE CITY OF ROWLETT WILL NEED A SPECIAL USE PERMIT AND THAT IS IN SECTION 70 731 OF THE ROWLETT DEVELOPMENT CODE , ASIDE FROM THAT, WE LOOK AT WHETHER OR NOT THERE WAS ADEQUATE PARKING WITHIN THE BUILDING TO SUSTAIN THE NEED FOR THE OPERATIONS OF A MASSAGE ESTABLISHMENT AND WHAT IS ALREADY EXISTING ON THE PREMISES, PRIMARILY RETAIL. WHAT THE APPLICANT CONFIRMED WITH US, THERE WAS ABOUT 34 PARKING SPACES AVAILABLE ON SITE . WHEN WE TOTAL THE CALCULATIONS OF ALL THE RETAIL THAT IS ALREADY EXISTING ON SITE PLUS THIS NEW OPERATION, THE TOTAL CAME OUT TO BE 22 PARKING SPACES WHICH MEANT THAT THERE IS ENOUGH PARKING TO MEET THE NEED. AS YOU ALL HAVE REVIEWED , THE STAFF REPORT WE SHARED WITH YOU ALL, THERE IS A REVIEW CRITERIA THAT WE HAVE WHEN WE RECOMMEND -- WHEN YOU ALL WOULD RECOMMEND A DECISION TO THE CITY COUNCIL AND THE APPROVING BODY WOULD APPROVE OR DENY AND TO CONSIDER CRITERIA AS SHOWN ON THE SLIDE IN FRONT OF YOU AND ON THE STAFF REPORT. THE SETBACK REQUIREMENTS IN THIS CASE, THE CODE TELLS US THAT, WHEN AN ACCESSORY STRUCTURE IS LOCATED TO THE BACK OF THE PROPERTY, IT IS -- THREE FOOT SETBACK IS REQUIRED. IN THIS CASE, THE PROPOSED STRUCTURE WOULD BE ABOUT 60 FEET FROM THE REAR PROPERTY LINE AND ABOUT FIVE FEET FROM THE NEAREST SITE SETBACK, WHICH IS THE EASTERN SIDE. PER SECTION 7711 OF THE ROWLETT DEVELOPMENT CODE, IT TELLS US THE DEFINITION FOR AN ACCESSORY STRUCTURE IS PERMANENT BUILDING OR STRUCTURE AFFIXED TO THE GROUND, SUBORDINATE TO THE PRIMARY STRUCTURE, THE USE OF WHICH IS INCIDENTAL TO THE DOMINANT USE OR THE PRIMARY STRUCTURE ON THE PREMISE, IN THIS CASE, THE APPLICANT IS PROPOSING TO USE THE ACCESSORY STRUCTURE TO STORE PERSONAL VEHICLES. ADDITIONALLY, THE ACCESSORY STRUCTURE IS SMALLER THAN THE PRIMARY STRUCTURE AND THE USE IS CLEARLY INCIDENTAL TO THE PRIMARY STRUCTURE.
