THE FIRST ITEM ON THE AGENDA IS THE CITIZENS 'S INPUT OF THE AGENDA.

THE NEXT ITEM ON THE AGENDA IS ITEMS FOR INDIVIDUAL CONSIDERATION THE FIRST ITEM 5A IS CONSIDER AND TAKE ACTION ON THE PRELIMINARY PLAT FOR VILLAS AT LONG BRANCH.

THE 7.548 ACRE SITE IS LOCATED AT THE NORTHEAST CORNER OF MILLER ROAD AND RELLA ROAD, CITY OF ROLLA, DALLAS COUNTY, TEXAS. MS. BRADLEY?

>> THANK YOU. THE PURPOSE OF THIS PLAT IS TO CREATE TWO SINGLE-FAMILY LOTS AND THREE OPEN AND COMMON AREA LOTS. THIS PROPERTY IS LOCATED AT THE NORTHEAST CORNER OF MILLER AND RELLA ROAD AND THE PROPERTY IS ZONED LAND DEVELOPMENT FOR SINGLE-FAMILY USES WITH A BASE OF SF FIVE. ACCESS TO THE SITE CAN BE FROM MILLER ROAD AND THERE'S TWO POINTS OF ACCESS. ONE WOULD BE EMERGENCY ACCESS, AND THE OTHER ONE IS THE FULL ACCESS. SO WITH THIS PRELIMINARY PLAT IS JUST CAPTURING THERE'S 32 RESIDENTIAL LOTS THEY PLAN TO DEDICATE RIGHT AWAY ALONG MILLER ROAD AND 50 FEET OF RIGHT-OF-WAY ALONG RELLA ROAD. THE PLANT ABOUT 700,009 SQUARE FEET OF PLANNING AREA TO ACCOMMODATE RESIDENTIAL LOTS AND ALSO TO PROVIDE THE SITE FROM TWO POINTS OF ACCESS ALONG MILLER ROAD AND ONE BEING EMERGENCY INGRESS EGRESS AND PROVIDE 10 FOOT UTILITY EASEMENTS LOCATED ALONG THE FRONT OF THE RESIDENTIAL LOTS AND 20 FOOT EASEMENT ALONG THE REAR PROPERTY BOUNDARY. AS YOU CAN SEE HERE, IT'S A PRELIMINARY PLAT IS BEING SHOWN ON THE SCREEN. The 2.6-acre site is located at the southwest corner of Lakeview Parkway and President George Bush Turnpike Frontage Road, in the City of Rowlett, Dallas County, Texas.]

APPROVED UNANIMOUSLY. ITEM 5B. CONDUCT A PUBLIC HEARING AND MAKE A RECOMMENDATION TO CITY COUNCIL REGARDING A REQUEST BY LG LAKEVIEW LLC FOR A MAJOR WARRANT TO INCREASE THE ALLOWABLE MAXIMUM SIZE OF AN AWNING SIGN FROM 10 SQUARE FEET TO 30 SQUARE FEET AND ALLOW THE SIGN TO PROJECT ABOUT THE ONLY AT THE SHOPS AT LAKEVIEW.

THE ZONING IS FOR URBAN VILLAGE DISTRICT. A LITTLE BIT OF BACKGROUND AS TO WHAT THE INTENTIONS OF THE PCODE AR. SECTIONS 5.4.1 OF THE FOREIGN-BASED CODES STATES AWNING SIZE WILL NOT EXCEED 10 SQUARE FEET IN THE ZONING AREA AND WILL ONLY BE LOCATED ON THE FACE SURFACE OF THE AWNING AND NOT PROJECT ABOVE IT.

YOU CAN SEE SOME EXAMPLES THE CODE SHOWS TO THE RIGHT OF YOUR SCREEN.

THE APPLICANT IS REQUESTING THIS WARRANT FOR A 30 SIGN. SECTION 1.5.3 OF THE FORM-BASED CODE STATES MAJOR WARRANT MAY BE ACTED UPON THE CITY COUNCIL FOLLOWING THE RECOMMENDATION OF THE PLANNING AND ZONING COMMISSION. THE APPLICANT IS REQUESTING THIS MAJOR WARRANT TO ALLOW DESIGN TO PROJECT ABOUT THE ONLY CONSISTENT WITH THE WALL SIGN AREA REQUIREMENT OF 30 SQUARE FEET AS POSTED AND 10 SQUARE FEET THAT THE AWNING ALLOWS. THE ARCHITECTURE OF THE BUILDING FRONTAGE PLACES A NUMBER OF THREE-STORY WINDOWS OR WINDOWS THAT ARE ABOVE A ONE-STORY SPACE ABOVE THE AWNING MAKING IT VERY DIFFICULT FOR ANY PEDESTRIAN LEVEL SIGNS TO BE INSTALLED WITHOUT BEING OBSTRUCTED BY THE AWNING ITSELF. THE APPLICANT HAS STATED VISIBILITY OF THE SIGNS WILL BE COMPROMISED BY THESE WINDOWS. IF THE SIGN IS PLACED ABOVE THE WINDOWS. IT WOULD BE COMPROMISED AS IT WOULD NOT BE READILY VISIBLE BY PEDESTRIAN TRAFFIC AND IS PLACED BELOW THE WINDOWS, THE AWNING ITSELF WILL BLOCK VISIBILITY OF THE SIGN. SO IF APPROVED THIS REQUESTED SIGN WILL NOT INTERRUPT THE ARCHITECTURAL OF THE PROPORTIONS FOR THE CONTEMPORARY AWNING.

THIS IS A COUPLE OF EXAMPLES SHOWING WHAT THE COMPARISON WITH THE 10 SQUARE FOOT ALLOWED IF IT WERE PROJECTING ABOVE THE MODERN CANOPY WORK MODERN AWNING VERSUS THE 30 SQUARE FEET. YOU CAN SEE THAT AT 10 SQUARE FEET THE SIGN IS HARDLY VISIBLE. AND SO THEY ARE ASKING FOR THIS CHANGE.

HERE IS ANOTHER EXAMPLE THAT WOULD BE OCCURRING IN THE SAME DEVELOPMENT FOR THE BUSINESS.

10 SQUARE FEET ON THE LEFT, 30 SQUARE FEET ON THE RIGHT. >> SOME CONSIDERATIONS ON THE PLANNING AND ZONING COMMISSION OF THE CITY COUNCIL HAVE ACTED ON TWO MAJOR WARRANTS PREVIOUSLY IN THIS AREA. ONE FOR VETERANS WHICH YOU MAY REMEMBER WAS A MONUMENT SIGN WHICH WAS APPROVED IN MARCH OF LAST YEAR AS WELL AS CAMP BOW WOW WHICH WAS A REQUEST TO INCREASE THE WALL SIGN SITES FROM 30 SQUARE FEET, THE ALLOWABLE FORM-BASED CODE AREA TO 126 SQUARE FEET WHICH WAS DENIED BY PNC AND WITHDRAWN BEFORE CITY COUNCIL.

THE REQUEST TO ALLOW THE SCIENTIFIC AREA TO BE 30 SQUARE FEET FRONT AWNING SIGN DOES MEET THE INTENT OF THE PEDESTRIAN VISIBILITY OF A WALL SIGN AND IN THIS SCENARIO.

HERE ARE SOME SIGNS ÃOR SOME PICTURES OF THE CURRENT CONDITIONS OF THE SITE THESE ARE THE TWO BUILDINGS IN WHICH THE SIGNS WOULD BE PLACED. THERE ARE CURRENTLY TWO SIDES AND YOU CAN SEE TO YOUR LEFT OF THE SCREEN IN JERSEY MIKE'S SIGN THAT CURRENTLY MEETS THE 10 FOOT REQUIREMENT AND AS WE MOVE FORWARD YOU WILL SEE HOW LOW VISIBILITY IS ON THE SITE.

THEY INSTALLED THIS SIGN MOSTLY BECAUSE THEY ARE NOT ALLOWED TO OPERATE WITHOUT A SIGN, AND SO THEY WENT AHEAD AND MET THE REQUIREMENTS BUT ARE STILL PART OF THIS OVERALL BUNDLE SO THAT THEY CAN INCREASE VISIBILITY ESPECIALLY ALONG LAKEVIEW PARKWAY.

VERIZON IS A ONE MORE TIME AND THEY WERE ALSO ABLE TO MEET THE 10 FOOT REQUIREMENT NOTIFICATIONS WERE SENT ON FEBRUARY 24. 12 NOTICES WERE MAILED TO PROPERTIES WITHIN 200 FEET AND 12 PERCENT AND A 500 FOOT RADIUS.

AS OF MARCH 6, WE HAVE RECEIVED ONLY ONE IN OPPOSITION. OUR RECOMMENDATION IS APPROVAL OF THE MAJOR WARRANT TO MAXIMIZE THE SIGN FROM 10 SQUARE FEET TO 30 SQUARE FEET AND TO ALLOW THE SUN TO PROJECT ABOVE THE AWNING AND KEEPS THE INTENT OF THE ESTABLISHED

SO HOPEFULLY, THEY WILL TAKE THE TIME TO SHOW UP FOR THE CITY COUNCIL MEETING IF THIS ITEM ÃHOWEVER IT TURNS OUT.
