THIS MONTH RECOGNIZES AND EXPRESSES APPRECIATION FOR THE DEDICATION OF OUR CODE ENFORCEMENT OFFICERS AND CODE ENFORCEMENT PROFESSIONALS AND AS YOU KNOW OUR CODE ENFORCEMENT TEAMS ARE HIGHLY VISIBLE IN OUR COMMUNITY AND THEY ARE FACE OF OUR CITY. THEY ARE OUR FRONT LINE.

AND THEN THIS MONTH'S SPOTLIGHT WHICH JUST GOT RELEASED TODAY IS FOCUSING ON ANIMAL SERVICE. I HOPE YOU HAVE A CHANCE TO READ THAT. ONE OTHER THING I WANT TO MENTION ABOUT CODE ENFORCEMENT BEFORE I READ THE PROCLAMATION IS WE HAVE OVER A 90% SUCCESS RATE OF RESOLUTION OF CODE VIOLATIONS VOLUNTARILY. AND THAT IS REAL IMPORTANT.

THAT IS A PRETTY HIGH RATE AND THAT MEANS THAT ONLY 10% HAVE TO GET RESOLVED IN ANOTHER MANNER. SO OUR RESIDENTS REALLY CARE ABOUT OUR COMMUNITY AND THEY WORK VERY HARD TO MAKE SURE THEY ARE IN COMPLIANCE AND THANK YOU TO ALL OF OUR CODE ENFORCEMENT OFFICIALS THAT ARE WORKING REALLY HARD TO KEEP OUR COMMUNITY IN A WONDERFUL BEAUTIFUL STATE.

WHEREAS CODE ENFORCEMENT OFFICERS PROVIDE FOR SET OF AND WELFARE FOR CITIZENS THROUGHOUT THE CITY OF ROWLETT FACING VARIOUS ISSUES OF BUILDING ZONING HOUSING, ANIMAL CONTROL, HEALTH AND LIFE SAFETY AND WHEREAS CODE ENFORCEMENT OFFICERS OFTEN HAVE A CHALLENGING AND DEMANDING ROLE AND OFTEN DO NOT RECEIVE RECOGNITION FOR THE JOB THAT THEY DO IN IMPROVING LIVING AND WORKING CONDITIONS FOR RESIDENTS IN OUR COMMUNITY AND WHEREAS THE CODE OF MANY OFFICERS HAS EXPANDED WITH THE INCREASED NUMBER OF FORECLOSED AND ABANDONED HOMES AND COMMUNITIES IMPACT ECONOMICALLY AND WHEREAS OFFICERS ARE DEDICATED AND HIGH QUALIFIED PROFESSIONALS WE SHARE THE GOALS OF PREVENTING NEIGHBORHOOD -- -- AND NUISANCE CODES AND ORDINANCES AND WHEREAS CODE ENFORCEMENT OFFICERS HAVE A HIGHLY VISIBLE ROLE IN THE COMMUNITIES THEY SERVE AND REGULARLY INTERACT WITH A VARIETY OF STATE OFFICIALS, COUNTY OFFICIALS, FIRST RESPONDERS, LEGISLATIVE BOARDS AND COMMISSIONS AND BODIES AND WHEREAS OFFICERS ARE CALLED UPON TO PROVIDE QUALITY SERVICE TO THE RESIDENTS AND BUSINESSES OF THE CITY OF HOWL LET AND WHEREAS CITY OF ROWLETT WANTS TO RECOGNIZE AND BRING AWARENESS TO THE COMMUNITY.

The 10.98 acres site is located approximately 228 feet east of the intersection of Chiesa Road and Lakeview Parkway in the City of Rowlett, Dallas County, Texas.]

THOSE ITEMS PASSED. THE APPLICANT SECURED A ZONING CHANGE FOR THIS SUBJECT PROPERTY TO DEVELOP AN AGE RESTRICT RESIDENTIAL MULTI-FAMILY RESIDENTIAL COMPLEX W THAT APPROVAL AND THE ZONING CHANGE THE CONCEPT PLAN REFLECTED 518 PARKING SPACES AND THE APPLICANT IS REQUESTING TO REDUCE IT TO 405 SPACES. AS I MENTIONED IN 2017 EXACTLY THE PROPERTY WAS REZONED TO ALLOW AN AGE RESTRICT MULTI-FAMILY COMPLEX. WHEN WE ASSESSED AT THAT TIME AND REVIEWED THE PARKING RATIO REQUIREMENTS WE USED THE MULTI-FAMILY USE AS WE DO NOT HAVE A SPECIFIC RATIO ALLOCATION FOR A AGE RESTRICT RESIDENTIAL COMMUNITY.

JUST A LITTLE BIT OF BACKGROUND. WE'RE ALL FAMILIAR WITH THIS PROPERTY BUT JUST TO GIVE YOU A LITTLE MORE INFO ON THE SITE

IT'S APPROXIMATELY ELEVEN ACRES AND IT'S BEING DEVELOPED CURRENTLY. THERE ARE TWO POINTS OF ACCESS TO THE PROPERTY OFF OF LAKE VIEW PROPERTY.

SPECIFICALLY THE APPLICANT IS HERE BEFORE US TONIGHT TO REQUEST A REDUCTION IN THE REQUIRED PARKING DARK -- CALCULATIONS. THE CODE DOES NOT HAVE SPECIFIC REQUIREMENTS FOR THIS USE AND THE REQUEST WAS REVIEWED UNDER THE MULTI-FAMILY DISTRICT STANDARDS.

THOSE TABULATIONS FOR PARKING ARE REQUIRED IN THE TABLE IN FRONT OF YOU. THE TOTAL UNITS WERE 272.

OF THOSE 152 ARE TWO BED AND 60 ARE STUDIOS AND BASED ON THE PARKING RATIO RATES THAT ARE STIPULATED WHICH IS IN THE THIRD COLUMN THE TOTAL NUMBER WOULD BE 4476 UNITS.

I DO WANT TO ADD THAT THROUGH THE COURSE OF THE YEARS WHEN WE WERE REVIEWING THE SITE PLAN FOR APPROVAL THERE WERE SEVERAL ITERATIONS THAT WE WENT THROUGH AND THE NUMBER OF PARKING SPACES DID FLUCTUATE BETWEEN 463 AND 508 SPACES.

ULTIMATELY WE DID APPROVE THE PLAN WITH 506 PARKING SPACES AND IN MARCH 2019. BECAUSE IT DID NOT COMPROMISE THE MINIMUM REQUIRED NUMBER OF PARKING SPACES.

AS WE CONSIDER THIS REQUEST COUNCIL OUR ROLE WAS TO UNDERSTAND THE SPECIFIC USE AND DETERMINE IF THE PARKING DEFICIT WOULD BE CREATED. KNOWING THAT WE DON'T HAVE THIS USE IN OUR SCHEDULE OF USES THE APPLICANT WENT AND CONDUCTED A SURVEY ON TWO SPECIFIC DEVELOPMENTS.

TWO 55 PLUS LIVING FACILITIES. ONE IS IN OUR OWN COMMUNITY WHICH IS THE EVERGREEN COMMUNITY.

AND THEY CONDUCTED A SITE ASSESSMENT ON WEDNESDAY AND SATURDAY. TO DETERMINE THE PARKING GENERATED. THEY ALSO WENT AND CONDUCTED A SITE ASSESSMENT AT SAVANNAH AT GATEWAY IN PLANO.

EVERGREEN HAS 136 UNITS. THE WEEKDAY DEMAND ON WEDNESDAY REALIZED .82 PARKING SPACES PER UNIT WHICH CAME OUT TO 113 PARKING SPACES. SATURDAY THE DEMAND WAS ACTUALLY AT .78 PARKING SPACES GIVING US ABOUT 107 PARKING STALL COUNT.

THE STAPEDES THAT WE APPROVED AS -- IT WAS APPROVED WITH 156 PARKING SPACES AND THE RATIO WAS 1.2.

TO FURTHER UNDERSTAND WHERE THE PROPOSED REQUEST IS IN KEEPING WITH THIS TYPE OF USE, PLANO HAS 292 SUN ITS -- UNITS.

BASED ON THAT THE STUDY THAT THE APPLICANT CONDUCTED CONCLUDED THAT A RATE OF 1.42 PARKING SPACES PER DWELLING UNIT WOULD MEET THE DEMAND FOR THE SENIOR FACILITY UNDERSTAND CONSTRUCTION AND BASED ON 1.42 PARKING RATIO 386 PARKING SPACES WOULD BE REQUIRED. THE APPLICANT IS PROPOSING 405 PARKING SPACES. IN ADDITION INDICATED TO US AND THIS IS CONDITIONED AS PART OF THEIR PD CONDITIONS THAT THEY WOULD PROVIDE TRANSPORTATION FOR THE RESIDENTS FIVE DAYS A WEEK FROM 10:00 A.M. TO 4:00 P.M. WITHIN A FIVE MILE RADIUS OF THE FACILITY. ALL OF THESE FACTORS WERE CONSIDERED AS PART OF OUR ASSESSMENT OF THIS REQUEST.

THIS SLIDE GIVES A FURTHER DISCUSSION POINT AS TO WHY WE WERE WHERE WE ARE TODAY. NOT ONLY DID THE PARKING STUDY BASED ON THE APPLICANT THAT IT WAS OVER PARKED BUT AS THEY WERE PROGRAMMING THEIR FACILITY AND WORKING ON THE DETENTION REQUIREMENTS THEY REALIZED THAT THE EARLIER PROPOSAL ON THE CONCEPT PLAN THE DETENTION AREA WAS INDEED NOT APPROPRIATE IN SIZE AND IT WOULD BE MORE APPROPRIATE TO EXPAND THAT.

AS A RESULT SOME OF THE PARKING SPACES HAD TO BE REMOVED AND WHAT I'M REFERRING TO IF YOU LOOK AT THE IMAGE TO YOUR LEFT

IT SHOWS TO THE SOUTHERN BOUNDARY OF THE PROPERTY AN ORANGE WRECK TANGLE AND WITHIN IT A BLUE TRIANGLE WITH PARKING SPACES AROUND IT. IN ORDER TO ASSURE THAT IT WAS SIZED APPROPRIATELY SOME OF THE PARKING WOULD HAVE TO BE ELIMINATED. THE APPLICANT ALSO INDICATED THAT IF THEY WILL NOT BE USING THAT AMOUNT OF PARKING WOULD THEY WANT TO INCREASE THE AMOUNT OF CONCRETE WITHIN THE AREA OF THAT SITE? I'M GOING TO -- THE APPLICANT WAS ABLE FOR JUSTIFY A GO WITH A PARKING RATIO THAT DIDN'T REQUIRE 518 PARKING SPACES. BECAUSE THE CONCEPT PLAN AND THE PD WAS APPROVED WITH THE DETENTION FACILITY SHOWN AS IT IS AND WITH THE PARKING SPACES SHOWN AS IT AN AMENDMENT TO THE PD WAS REQUIRED. WE SENT PUBLIC NOTICES ON AUGUS.

WE RECEIVED 2 RESPONSES IN FAVOR AND NO OTHER RESPONSES WERE RECEIVED. NEXT SLIDE.

THIS ITEM WAS HEARD AT THE SEPTEMBER 8TH PLANNING AND ZONING COMMISSION AND THEY UNANIMOUSLY APPROVED WITH A 6-0 VOTE. AS WELL AS THE ASSOCIATED CONCEPT PLAN WITH THE CONDITION THAT THE APPLICANT PROVIDE SCHEDULED TRANSPORTATION AS DESCRIBED EARLIER.

AND THAT THE DEVELOPMENT WILL REMAIN AS AN AGE RESTRICT COMPLEX. FOR AT LEAST 30 YEARS.

SHOULD ANY CHANGES OCCUR POST THAT THEN THE PARKING STANDARDS THE EXISTING PARKING STANDARDS AT THAT TIME WILL HAVE TO BE MET OR THOSE PARKING RATIO REQUIREMENTS.

THE APPLICANT HAS UNDERSTOOD THESE ELEMENTS OF THE REQUEST AND WITH THAT I'LL TRY TO ANSWER ANY QUESTIONS.

ALL OF OUR RESIDENTS HAVE ACCESS TO PARK THEIR CARS DIRECTLY IN FRONT OF THEIR BUILDING EITHER ON THOSE SIDES OR ON THE INTERNAL SIDE.

85% ARE STUDIO AND ONE BEDROOMS. OUR AVERAGE AGE IS ABOUT 74 AND WE HAVE QUITE A FEW HANDICAPPED RESIDENTS THAT ARE UNABLE TO DRIVE. SO THEY RELY ON THE VAN SERVICE TO GET AROUND SO WE WOULD NOT BE REDUCING THE PARKING IN ANY WAY AND IF IT WERE A PROBLEM AND ON TOP OF THAT WE'RE NOT DOING ANYTHING WITH THE LAND ON THE LEFT-HAND SIDE SO IF WE REALLY NEEDED THE ADDITIONAL SPACES WE COULD ALWAYS COME BACK AND ADD THEM. SO THIS IS REALLY ALL ABOUT ENVIRONMENT INSTEAD OF PARKING BUT WE'RE NOT DOING ANYTHING WITH THE SPACE THAT PRIMARILY RUNS ALONG THE CREEK SO IF WE WERE UPPED PARKED WE WOULD STILL HAVE THE ABILITY TO COME BACK AND ADD THE PARKING IF THE CITY DETERMINED THAT WE WERE CREATING
