[5A. Update from the City Council and Management: Financial Position, Major Projects, Operational Issues, Upcoming Dates of Interest and Items of Community Interest. ]

THE ITEM ON OUR AGAIN IS ITEM 5, 5 A FINANCIAL POSITION MAJOR PROJECTS I HAVE ONE ANNOUNCEMENT IF ANYBODY HAS SOMETHING AFTER ME I WILL CALL ON YOU AT THAT TIME. WE WOULD LIKE TO THANK THE 2020 CENSUS COMPLETE COUNT COMMITTEE FOR THEIR SERVICE THIS YEAR THE COMMITTEE WAS COMPROMISED OF NINE MEMBERS APPOINTED BY THE CITY COUNCIL WHO SERVED UNTIL SEPTEMBER OF 2020. THOSE MEMBERS WERE JEFF, DEBBIE, LUCY MASSEY, CAN YOU TELL PUPPER, ROBERT AND LISA BOWERS. THE RESPONSIBILITY OF THE 2020 INCLUDED RAISING AND PROMOTING PARTICIPATION IN ROWLETT RESIDENTS WITH THE HELP THE ROWLETT RESPONSE RATE FOR 5.4% OVER THE RESPONSE RATE FROM 2010.

THE RESPONSE RATE WAS 67%. THE RESPONSE RATE IN THE STATE OF TEXAS WAS 62.8%. IN THE CITY OF WAS 81.4%.

WE JUST WANTED TO TAKE A MOMENT TO APPRECIATE THE TIME AND EFFORT OF THE COMPLETE COUNT COMMITTEE IN HELPING TO ENSURE THAT EVERY NEIGHBOR IN ROWLETT THANK YOU VERY MUCH TO THAT COMMITTEE.

LAST SATURDAY WE HAD A PHARMACEUTICAL TAKEBACK AND WE TOOK IN 556 POUNDS OF DRUGS OFF THE STREET.

WE HAD PROBABLY FIVE TIMES AS MANY AS WE'VE EVER HAD BEFORE. I TOOK NONE NUMBERS TO THE FIRE STATIONS THEY WERE SHOCKED.

IF YOU RECALL IN EARLY SEPTEMBER THE CITY COUNCIL INDICATED A DESIRE TO HAVE ADDITIONAL OVERSIGHT IN THE APPROVAL MULTIFAMILY USE. HELP ME OUT, THANK YOU.

>> AS IT STANDS CURRENTLY THE MULTIFAMILY DEVELOPMENT IN THREE ZONING DISTRICTS THE OPEN NEIGHBORHOOD ZONING DISTRICT. THERE ARE SPECIFIC BUILDING TYPES AND ALL MIXED RESIDENTIAL, MIXED USE PERMIT CURRENTLY PERMIT MULTIFAMILY APARTMENT SHOULD IT BE APPROVED TONIGHT AN S.U.P. WOULD BE REQUIRED FOR MULTIDEVELOPMENTS. IN ADDITION TO THE CODE WE ALSO HAVE STRATEGIC AREAS ONE BEING THE NORTH SHORE FRAMEWORK PLAN. WE ADOPTED THE NORTH SHORE ASSOCIATED WITH THE NORTH SHORE AREA.

SO IN THE MIXED RESIDENTIAL WHICH IS PRIMARILY YOUR MULTIFAMILY DEFINITION THE FORM-BASED CODE USES THE WORDS MIXED RESIDENTIAL AS OPPOSED TO MULTIFAMILY INCH THE MIXED RESIDENTIAL COMPONENT YOU HAVE APARTMENTS. WITH THAT, AGAIN, THE IT HAS ALWAYS INTENDED WAS ALWAYS INTENDED TO HAVE SOME FORM OF INTEGRATED LAND USES IN USING THE TERM INTEGRATED IN LAND USES. ADDITIONALLY, WE ALSO ADDED THAT REVIEW APPROVAL PUBLIC HEARING AND NOTICE PROCEDURES FOR THIS SPECIAL USE PERMIT WILL BE AS SET FORTH IN THE ROWLETT DEVELOPMENT CODE WHICH AGAIN IS MERELY IDENTIFYING WHAT THOSE PUBLIC HEARING PARAMETERS ARE. THE NORTH SHORE ALSO HAS A FRAMEWORK PLANNED RESULT THERE'S SOME SPECIFICITY -- IN THIS CASE FOR COMMENTS AND INDUSTRY -- WOULD HAVE TO BE AMENDED. BASICALLY THE AMENDMENTS -- AS IT RELATES TO THE MAXIMUM ALLOWANCE FOR UP TO 25% OF THE LAND AREA, IN THE COMMERCIAL BECAUSE THE COMMERCIAL DISTRICT IN THE URBAN VILLAGE DISTRICT DOES NOT TIP LATE THIS REQUIREMENT SO WE'RE REALLY TRYING TO ALIGN THE TWO DOCUMENTS IN ESSENCE BECAUSE THAT S.U.P. REQUIREMENT WILL FULFILL THESE PARAMETERS.

WE ALSO NOTIFIED THE RADIUS AS A RESULT 688 NOTICES WERE WE DID RECEIVE -- FOUR IN FAVOR OF THE AMENDMENT.

SECTION 211060 OF THE LOCAL GOVERNMENT CODE DOES REQUIRE A SUPERMAJORITY OR NO LESS THAN MEMBERS TO VOTE IN AFFIRMATIVE SHOULD ANY CHANGE TO A LAND USE REGULATION OR ZONING DISTRICT BE OPPOSED BY 20%.

THE REQUIREMENT FOR MAJORITY OR SUPERMAJORITY DOES NOT APPLY TO THE AREA OF THE CITY COVERED BY THE CODE AS ONLY 14% OF THE LAND AREA IS OWNED BY THOSE EXPRESSING THEIR OPPOSITION. HOWEVER OWNERS ABOUT SUBMIT A RESPONSE IN OPPOSITION. WE DID HAVE AN OPPORTUNITY TO SPEAK TO SOME OF THE INDIVIDUALS WHO SUBMITTED OPPOSITION RESPONSES IN OPPOSITION THEIR PRIMARY

CONCERN IS THEY WERE NOT ABLE TO MULTIFAMILY IN THE AREA. AS A RESULT, -- BUT A SUPERMAJORITY WILL BE REQUIRED.
