TEXAS LOCAL GOVERNMENT CODE, SPECIFICALLY CHAPTER 211. AND WITH THAT, THIS PLANNING AND ZONING COMMISSION BECOMES A RECOMMENDING BODY FOR THE CITY COUNCIL.

IT CONSISTS OF SEVEN MEMBERS, WHICH YOU ALL KNOW. AND THEN WE HAVE THREE ALTERNATES TOO. AND WITH THAT YOU HAVE A CHAIR AND VICE CHAIR.

WE JUST WENT THROUGH AN ELECTION. SO THAT BEING SAID, YOU HAVE THREEALTERNATE MEMBERS .WHEN YOU DON'T HAVE A QUORUM AND YOU NEED TO HAVE A QUORUM, YOU CAN UTILIZE THE THREE ALTERNATES AND THEY BECOME VOTING MEMBERS OF THE BOARD.

IT IS A TWO-YEAR TERM FOR ALL OUR MEMBERS. AGAIN, THE CITY COUNCIL POINTS THE TWO ALTERNATES ANNUALLY FOR SERVING THE PLACE THE VOTING MEMBER IN THE EVENT OF AN ABSENTEE. NEXT SLIDE, PLEASE. AND I WAS SPEAKING TO THIS SLIDE. THIS IS FOR OUR VIEWING AUDIENCE JUST TO REITERATE.

AND ALTERNATE NUMBER ONE SERVING IN PLACE OF THE SAME RIGHTS AND PRIVILEGES OF A VOTING MEMBER OF THE PLANNING AND ZONING COMMISSION. THE COMMISSION MEETS ON THE SECOND AND FOURTH TUESDAY OF EVERY MONTH. SOMETIMES WE HAVE SPECIAL MEETINGS AND WE ALSO HAVE A JOINT MEETING WITH THE CITY COUNCIL ONCE A YEAR WERE WE GIVE THEM AN UPDATE ON ACCOMPLISHMENTS, NEEDS AND THOSE TYPES OF THINGS.

THERE IS AN ATTENDANCE POLICY AND THAT IS 75 PERCENT OF ALL MEETINGS HAVE TO BE ATTENDED.

THE PACKETS YOU RECEIVED THIS FRIDAY IS TYPICALLY WHEN YOU WILL RECEIVE YOUR PACKETS.

REZONING CZAR IN THE FORM OF CHANGING BOUNDARY DISTRICTS FOR SPECIFIC ZONING DISTRICTS FOR FRAMEWORK PLANS FOR THE FORM-BASED CODE. MAJOR WARNS OR VARIANCES TO GIVE YOU A SEMBLANCE OF WHAT THAT MEANS. WITH DEVIATIONS TO THE FORM-BASEDCODE.

SPECIAL USE PERMITS, ALTERNATIVE LANDSCAPE PLANS, SPECIFIC TREE REMOVAL PERMITS AND ANY REGULATORY CHANGES TO THE CODE . WE HAVE ONE SPECIFIC ITEM ON THE AGENDA TONIGHT TO TALK ABOUT THAT.EXT SLIDE, PLEASE.

LET'S TALK ABOUT ZONING CODE W TOUCHED ON THAT ON AN EARLIER SLIDE .

I KNOW SOME OF YOU ARE FAMILIAR WITH THIS. JUST TO BRUSH UP AGAIN, ZONING IS GENERALLY DEFINED AS THE DIVISION OF JURISDICTION INTO DISTRICTS.

SUCH AS SINGLE-FAMILY ZONING DISTRICT, COMMERCIAL ONE ZONING DISTRICT.

WITHIN WHICH THERE ARE SPECIFIC PRESCRIBED DESCRIPTION SUCH AS BUILDING HEIGHT, BUILDING SETBACKS OR DENSITY OR THE LAYOUT AND THOSE TYPES OF THINGS.

IF THERE IS A CHANGE IN ZONING THAT COMES FOR YOU, ZONING RECOMMENDATIONS HAVE TO BE MADE AND REVIEWED IN ACCORDANCE WITH THE CITIES COMPREHENSIVE PLAN AND THE ZONING ORDINANCE.

AND TO ENSURE THEY VERY SUBSTANTIAL RELATIONSHIP TO THE PUBLIC HEALTH SAFETY AND GENERAL WELFARE OF THE COMMUNITY. NEXT SLIDE, PLEASE.THE ZONING CHANGE, WANT TO INTEGRATE A ZONING CHANGE IS A DISCRETIONARY PROCESS FOR THE ADOPTION OF AMENDMENT OF THE ZONING ORDINANCE. THE COMMISSION MAKES RECOMMENDATION TO THE CITY COUNCIL BASED ON THE FOLLOWING ELEMENTS.ONSISTENCY OR COMPLEMENTING A COMPREHENSIVE PLAN, PROTECTING AND ENHANCING THE HEALTH, SAFETY AND MORALS OF PUBLIC WELFARE REINJURE TRANSPORTATION AND FACILITIES OR INFRASTRUCTURE CAN SERVICE THE SUBJECT PROPERTY OR THE PROPERTY IN QUESTION. THE SUITABILITY OF THE SUBJECT PROPERTY OF THE EXISTING AND PROPOSED ZONING. YOU WILL SEE THAT IN YOUR REPORTS IN YOUR PACKET YOU RECEIVED BECAUSE WE HAVE TWO ZONING CASES.

THE CITY OF ROWLETT AS A COURTESY MAIL OUT AS WELL WHERE WE MAIL A NOTICE OUT WITHIN 500 FOOT OF THE SUBJECT PROPERTY FOR PUBLIC NOTICES ARE PLACED IN THE NEWSPAPER ON THE 15TH DAY OF THE PUBLIC HEARINGS 15 DAYS BEFORE THE PUBLIC HEARING. AND REZONING SIGN IS ALSO PLACED ON THE PROPERTY.

THE COMPREHENSIVE PLAN IS A LONG-RANGE TOOL. IT IS ADOPTING AN AMENDED BY THE CITY COUNCIL. COVERS A PLAN SIX TO ESTABLISH A VISION FOR THE CITIES FUTURE.

IT PROVIDES POLICY GUIDANCE FOR GROWTH AND DEVELOPMENT AND HAS SPECIFIC GOALS TO ENSURE THE CITIES VISION CAN BE IMPLEMENTED AND GUIDES THE ESTABLISHMENT AND DEVELOPMENT OF REGULATIONS ENCUMBRANCER PLAN WAS RECENTLY UPDATED IN 2019 AND THE FUTURE LAND USE WAS ALSO ADOPTED AS PART OF THIS. SO THAT IS A BIG ACHIEVEMENT ON OUR PART TO ADOPT AND INCORPORATE THE FUTURE LAND USE PLAN AS PART OF OUR COMPREHENSIVE PLAN.EXT SLIDE, PLEASE. ANOTHER FUNCTION OF THE PLANNING AND ZONING COMMISSION IS RELATED TO PLANTSOR THE SUBDIVISION ORDINANCE WHO THIS IS A MINISTERIAL PROCESS . IN THIS INSTANCE, A PLOT IS WHEN LAND IS FORMALLY SUBDIVIDED THROUGH A DOCUMENT CALLED A PLAT. THE SUBDIVISION OF LAND IS GENERALLY DEFINED AS THE DIVISION OF THE TRACT OF LAND INTO TWO OR MORE PARCELS AND INCLUDES LAYING OUT LOT LINES, STREETS, ALLEYS, THE REQUIRED EASEMENTS OR INFRASTRUCTURE TO SERVICE THE PROPERTY WOULD AND THESE PLATS AND SUBDIVISIONS ARE REVIEWED IN ACCORDANCE WITH THE RELEVANT DEVELOPMENT CODE IN THE FORM-BASED CODE IN THE TEXAS LOCAL GOVERNMENT CODE REGULATIONS BEAUTIFUL THESE ELEMENTS ARE IN ORDER, THE PLANT HAS TO BE APPROVED.

PLOTS ARE REVIEWED BY THE CITY STAFF AND IN SOME INSTANCES CAN BEADMINISTRATIVELY APPROVED FOR THE PLATS THAT COME BEFORE YOU, SUCH AS PRELIMINARY PLANTS AND FINAL PLOTS , THOSE REQUIRE YOUR APPROVAL. NEXT SLIDE, PLEASE, LORD. PLAT REVIEW IS SERIAL IN NATURE AND IS COMPLETED TO CONFIRM COMPLIANCE WITH CITY STANDARDS. ALSO UNLIKE ZONING, PLATS ARE KNOWN DISCRETIONARY. SO IF ALL THE REQUIREMENTS HAVE BEEN MET AND IF YOU KNOW IN OUR PACKETS WE DO STATE THAT ALL REQUIREMENTS HAVE BEEN MET IN THE RDC.

THE PLAT IS REQUIRED TO BE APPROVED. WITH A 30 DAY CLOCK ON THE REVIEW AND APPROVAL OF THE PLA . ACTION TAKEN PLOTS THEREFORE HAVE TO ãWOULD BE APPROVAL OF A DISAPPROVAL OR CONDITIONAL APPROVAL.

IN A NUTSHELL, WE HAVE HAD SEVERAL CONVERSATIONS WITH THE CITY COUNCIL AND THEY'VE INDICATED A DESIRE TO HAVE ADDITIONAL OVERSIGHT AS IT RELATES TO SPECIFIC STANDALONE MULTIFAMILY DEVELOPMENT IN THE FORM-BASED CODE AND TO REQUIRE SPECIAL USE PERMIT MULTIFAMILY USES.

THAT IS THE INTENT OF THIS ITEM. I KNOW WE ARE RUNNING SHORT ON TIME SO I WILL TRY TO SUMMARIZE IT AND WE HAVE IN THE FORM-BASED CODE THREE ZONING DISTRICTS THAT COMMIT TO MULTIFAMILY DEVELOPMENT, WHICH IS ACTUALLY REFERRED TO AS MIXED RESIDENTIAL IT AND SO THE ONLY CAVEAT TO THE MOST AMENDMENT HERE IS TO INCLUDED SEP REQUIREMENT . WILL GUIDE AND THE DETAILS OF THE PUBLIC HEARING.

IN ORDER TO ACCOMMODATE THIS CHANGE OR THIS REQUIREMENT, WE AS STAFF ARE PROPOSING TO AMEND SEVERAL SECTIONS IN THE FORM-BASED CODE TO STREAMLINE THE PROCESS AND ENABLE AN SEP REQUIREMENT.HAT YOU NOTICE WE HAVE STATED THAT THE NORTH SHORE WOULD HAVE TO BE AMENDED TOO AND THAT IS TO ACCOMMODATE THE SEP REQUIREMENT AS WELL. SO IN A NUTSHELL, BUT WE ARE ULTIMATELY DOING IS REQUESTING RECOMMENDING AN AMENDMENT TO THE FORM-BASED CODES TO REQUIRE SPECIAL USE PERMIT FOR MULTIFAMILY USES. AND THAT WAS TO SOLICIT THEIR INPUT AND MORE IMPORTANTLY TO LET THEM KNOW THIS IS A PROPOSED AMENDMENT TO READ AGAIN, NO ZONING BOUNDARIES ARE BEING CHANGED, NO ZONING DISTRICTS ARE BEING CHANGED.
